NOTICE INVITING e-AUCTION NO. 01 (2nd Call) OF 2021-2022 OF THE


SUPERINTENDING ENGINEER, CENTRAL CIRCLE,
PUBLIC WORKS DIRECTORATE

The Superintending Engineer, Central Circle, Public Works Directorate, on behalf of Governor of the state
of West Bengal invites e-Auction for collection of Toll Tax as detailed in the table below (Submission of Bid
through online) with reference No.3836-F(Y)/FA/O/2M/71/14[Pt-II] dated 19.06.0217 of Principal Secretary, Govt.
of West Bengal , Finance (Audit) Department.

1. In the event of e-Filing intending bidder may download the tender document from the website
https://eauction.gov.in directly by the help of Digital Signature Certificate & necessary earnest money through
e-Filling. (Details of which has been narrated in “Instruction to Bidders”).

2. Technical Bid & Financial Bid both will be submitted concurrently duly digitally signed in the Website
https://eauction.gov.in. Tender document may be downloaded from website & submission of Technical
Bid/Financial Bid as per Tender Schedule stated. The documents submitted by the Bidders should be properly
indexed.

4. Eligibility criteria for participation in Bid:

a. WORK CREDENTIAL:-
i) Intending bidders should produce credentials of a similar nature of completed work of the minimum annual
bid value of Rs.63.64 Lakh- during 5(five) years prior to the date of issue of this Bid notice;
or,
ii) Intending bidders should produce credentials of one single running work of similar nature which has been
completed to the extent of 80% or more and value of which is not less than desired value at (i) above;
In case of running works, only those bidders who will submit the certificate of satisfactory running work
from the concerned Executive Engineer, or equivalent competent P.W.D., Govt. of West Bengal will be
eligible for the Bid. In the required certificate it should be clearly stated that the work is in progress
satisfactorily and also that no penal action has been initiated against the executed agency, i.e., the bidder.
iii) Other terms and conditions of the credentials:-
iv) Credential certificate issued by the Executive Engineer or equivalent or competent P.W.D., Govt. of West
Bengal of a State / Central Government, State / Central Government undertaking, Statutory / Autonomous
bodies constituted under the Central / State statute, on the executed value of completed / running work will
be taken as credential.
b. Pan Card, Income Tax (Saral) Acknowledgement receipt for Assessment year 2020-2021, Professional Tax
receipts Challan for the year 2020-2021, Valid 15-digit Goods and Services Taxpayer Identification Number
(GSTIN) under GST Act, 2017. & Trade License to be accompanied with the Technical Bid document. [Non
Statutory Documents].

c. Registered Unemployed Engineers’ Co-operative Societies/ Unemployed Labour Co.- Op. Societies are
required to submit as follows (Non-statutory documents):-
i. Valid Bye-Law, Registration certificate issued by the Co-operation Deptt.
ii. Resolution copy of Annual General meeting/ General meeting/ Committee meet to use D.S.C. in bid
document on behalf of the respective Society.

d. A prospective bidder (including his participation in partnership) shall be allowed to participate in the
work as mentioned in the list of works/table.

e. The partnership firm shall have to submit the registered/Notarized partnership deed and Registered Power
of Attorney. [Non Statutory Documents].

f. A company shall have to submit Registered Article of Memorandum.

5. GST, Royalty & all other statutory levy, Cess, Taxes & Charges (as applicable as per rules & G.O.) will
have to be borne by the Bidder & accordingly considering all aspects Bid rate shall be quoted by the bidders
& in any means their quoted rate shall not be lower down.

6. Agencies shall have to arrange land for buildup shed including lighting, guarding, barricading etc, at their
own cost and responsibility for collection of toll.

7. Bids shall remain valid for a period not less than 120 (one hundred twenty) days from the last date of
submission of Financial Bid / Sealed Bid submission.

9. Earnest Money / Bid Security : The amount of Earnest Money / Bid Security is ₹ 10,00,000.00 (Rupees
Ten lakh) only (Exemption will not be allowed for Registered Co-operative Society Ltd.) or @0.25% of annual
bid value whichever is higher.

Earnest Money for the bid in the form of Bank Draft from any Nationalized Bank /Scheduled Bank
drawn in favour of Executive Engineer, Berhampore Division No.-II, PWD payable at Berhampore
before 01.04.2022 2.00 p.m. against the auction sale and scanned copy of which has to be uploaded
online in between “DOCUMENT SUBMISSION / PAYMENT START DATE AND END DATE
30.03.2022. upto 2.00 p.m. After opening of the bids earnest money of all intending bidders except
highest bidder (H1) will be returned after the acceptance of H1 and after completion of all formalities
and clearance by the competent authority. Any request for early refund of Demand Draft will not be
entertained . Scanned Copies of the Bank Draft will have to be uploaded online at the time of bidding. No
bid will be accepted without the earnest money. The original bank drafts will have to be submitted at the
office of the Superintending Engineer, Central Circle, PWD, Faujdari Court Complex, Berhampore,
Murshidabad latest by the “DOCUMENTS SUBMISSION / PAYMENT END DATE , i.e. 30.03.2022
upto 2.00 p.m. otherwise the online bids will not be accepted by this office.

10. The Bidder, at the Bidder’s own responsibility and risk is encouraged to visit and examine the site of works and
its Surroundings and obtain all information that may be necessary for preparing the Bid and entering into a
contract for the work as mentioned in the Notice inviting Bid, the cost of visiting the site shall be at the
Bidder’s own expense. Traffic management and execution shall be the responsibility of the Agency at his / her
/ their risk and cost.

11. The intending Bidders shall clearly understand that whatever may be the outcome of the present invitation of
Bids, no cost of Bidding shall be reimbursable by the Department. The Superintending Engineer, Central Circle,
P.W. Directorate reserves the right to reject the Bid documents without assigning any reason whatsoever and is
not liable for any cost that might have incurred by any Bidder at the stage of Bidding.

12. Prospective applicants are advised to note carefully the minimum qualification criteria as mentioned in
‘Instructions to Bidders’ before bidding.

13. In case of any objection regarding pre-qualifying an agency, that should be lodged to the Superintending
Engineer within 48 hours (through online) from the date of publication of the list of qualified agencies and
beyond that time schedule no objection will be entertained.

14. Contractor shall have to comply with the provisions of (a) the contract labour (Regulation Abolition) Act.
1970(b) Apprentice Act. 1961 and (c) minimum wages Act. 1948 of the notification thereof or any other laws
relating thereto and the rules made and order issued thereunder from time to time.
The Successful highest Bidder (as lessee) will have to deposit balance amount in addition to specified
initial earnest money to make it equivalent to 30 days of accepted bid money and Income Tax @ 2% of 30
days of accepted bid money, (separate for toll and Income tax) in the shape of Bank draft as security for
the due and faithful performance & observance of the terms and conditions and covenants contained. The
Successful highest Bidder will also have to deposit 30 (thirty) days bid money in advance (separate for toll
and Income tax) before the execution of “Deed of Lease” in the shape of unconditional Bank Guaranty for
a period of 14 (fourteen) months from any Nationalized Bank drawn in favour of the Executive Engineer,
Berhampore Division No.-II, P.W. Directorate during submission of formal agreement to this office, which
shall be lying with the concerned Executive Engineer for the entire period of lease. If the Successful
Bidder (as Lessee) fails to deposit an amount equivalent to 30 (thirty) days of his offered bid money as
security deposit money in advance within the specified time frame as to be mentioned in L.O.A., his / her
/their earnest money will be forfeited to the Govt. as well as his / her /their Bid may be treated as cancelled
and strict penal action will be taken towards debarment of their Firm/Society.
The Successful highest Bidder will execute the deed of lease in prescribed format with the undersigned (as
Leassor) on requisite Non-Judicial stamp paper valuing @ 4% of the total value of bid for the whole
contract period or the rate as per Indian stamp Act and registration act as amended up to date whichever
is higher for the original copy and on the Non-Judicial stamp paper of Rs. 50.00 for duplicate & triplicate
copy each.
15. The successful bidder shall have to pay Income Tax @2% of the total amount collected in terms of Sec-206© of
Income tax Act 1961. The amount will be submitted in the shape of Bank draft separately in favour of the
Executive Engineer, Berhampore Division No.-II, P.W.Directorate within the specified time frame as to be
mentioned in Letter of Acceptance

17. THE SUCCESSFUL BIDDER (AS LESSEE) WILL ALSO HAVE TO EXECUTE DEED OF LEASE
WITH THE EXECUTIVE ENGINEER, BERHAMPORE DIVISION NO. II, P.W. Dte. (AS LESSOR)
ON REQUISITE STAMP COVERED BY SECTION 2 (16) (C) READ WITH ARTICLE 35 (B) OF THE
INDIAN STAMP ACT FOR THE ORIGINAL COPY OF THE DEED.
And on stamp paper of Rs. 50/- for the duplicate and triplicate copy after purchasing the relevant lease
documents and Terms and Conditions from the office of the Executive Engineer, Berhampore Division No.-II,
P.W. Dte. by Rs. 10,005/- each within 7 days. Lease condition will be prescribed by the Executive Engineer,
Berhampore Division No.-II, P.W. Dte. (as Lessor) in Compliance with due and faithful observance of
provisions of India Toll Act 1951 and as amended upto date. The Lease documents along with other Terms and
Conditions which duly and lawfully shall form part of the Deed of Lease and the Successful Bidder (as Lessee)
shall be bound himself / themselves to abide by the same.
Highest Bid Money may be accepted. In the event of the highest Bid money turning out less than the
specified Reserve Bid Money, it may not be accepted and fresh Bid may be invited. The Superintending
Engineer, Central Circle, P.W. Dte. shall also reserve the right either to accept or reject any or all the Bids
without assigning any reason thereof. The Bid Inviting P.W.D., Govt. of West Bengal may initiate proposal to
higher up the Highest Bid Money with the highest bidder.

18. At the time of execution of lease deed with the u/s the successful bidder would be charged for providing stamp
duty @ 4% or the requisite rate which is in force at the time of agreement of the value of bid for the whole
contract period vide G.O. No- 2100-R/Adl. Dt. 22/08/2000 of P.W. (Roads) Deptt. in the Govt. of West Bengal.

19. Selected bidder will have to deposit Income Tax / GST on the amount of bid offered as per prevalent Govt.
rules.
20. In case of Ascertaining P.W.D., Govt. of West Bengal at any stage of tender process or execution of work
necessary registered irrevocable power of attorney is to be produced.

21. No CONDITIONAL / INCOMPLETE TENDER will be accepted under any circumstances.

22. In case of Quoting rates no multiple Highest rate will be entertained by the Department.

23. The Superintending Engineer, Central Circle, P.W. Dte. reserves the right to cancel the N.I.B. due to
unavoidable circumstances and no claim in this respect will be entertained.

24. During scrutiny, if it is come to the notice to Bid inviting P.W.D., Govt. of West Bengal that the credential or
any other papers found incorrect / manufactured / fabricated, that tenderer will not be allowed to participate in
the tender and that application will be out rightly rejected without any prejudice.

25. Before issuance of the work order, the Bid inviting P.W.D., Govt. of West Bengal may verify the
credential & other documents of the Highest Bidder if found necessary. After verification, if it is found that
such documents submitted by the Highest Bidder is either manufacture or false in that case, work order will not
be issued in favour of the tenderer under any circumstances.

26. If any discrepancy arises between two similar clauses on different notifications, the clause as stated in later
notification will supersede former one in following sequence:
i) Form No. 2911(ii)
ii) NIB
iii) Special terms & Conditions
iv) Technical bid
v) Financial bid

27. Qualification Criteria:


The Bid Inviting and Accepting P.W.D., Govt. of West Bengal will determine the eligibility of each bidder, the
bidders shall have to meet all the minimum criteria regarding:-
a) Financial Capacity
b) Technical Capability comprising of personnel & equipment capability
c) Experience / Credential

The eligibility of a bidder will be ascertained on the basis of uploaded documents in support of the minimum
criteria as mentioned in a, b, c above. If any document submitted by a bidder is either manufacture or false, in
such cases the eligibility of the bidder / tenderer will be out rightly rejected at any stage without any prejudice.

28. Bidder shall have to comply with the provisions of (a) the contract labour (Regulation Abolition) Act.1970 (b)
Apprentice Act. 1961 and (c) minimum wages Act. 1948 of the notification thereof or any other lows relating
thereto and the rules made and order issued there under from time to time.
