EXECUTIVE ORDER No. 05
Series of 2022

AN ORDER ORGANIZING THE ECOLOGICAL SOLID WASTE MANAGEMENT


COMMITTEE (BESWMC)

WHEREAS, Section 389 (b) provides that for efficient and economical governance, the purpose
of which is the general welfare of the barangay and its inhabitants pursuant to Section16 of the
Local Government code of 1991,the Punong barangay shall enforce laws and regulations relating
to pollution control and protection of the environments;

WHEREAS, Section 657 of IRR of RA 9003 provide the creation of Barangay Solid Waste
Management Committee and the function and responsibilities;

WHEREAS, section 10 of RA 9003 stipulates that the segregation and collection of Solid Waste
Management shall be conducted at the barangay level specifically for biodegradable,
compostable and reusable wastes;

WHEREAS, DILG MC No. 1996-119 dated June 27, 1996 enjoying all provinces, cities,
municipalities and barangay to adopt a comprehensive Solid Waste Management System;

WHEREAS, DILG MC No. 2000-117 dated August 2000 provides the implementation of Zero-
Waste Management;

WHEREAS, DILG MC No. 2009-168 dated October 27, 2009 provides the strict
implementation of section 17 (H) and 32 of RA 9003 known as the Solid Waste Management
Act of 2000;

WHEREAS, for the implementation and enforcement of the provision of RA 9003 will be
achieved through the reorganization of the BESWMC and to update them on their duties and
functions to RA 9003, and other related policies, laws and issuances;

NOW THEREFORE, I HON. MARIO S. PRADO, Punong Barangay of Barangay Palguyod,


by virtue of the power vested in me, do hereby order the creation of the Barangay Ecologial
Solid Waste Management Committee (BESWMC) with the following provisions;

SECTION 1: COMPOSITION

SECTION 2: DUTIES AND FUNCTIONS OF THE BESWMC.

1. Formulate a community Solid Waste Management Program consistent with the


municipality;
2. Be responsible for the segregation and collection of Solid waste specially for
biodegradable, compostable and reusable waste;
3. Establish within the barangay or cluster barangays a material recovery Facility, a
redemption or eco-center in the barangay owned or lease land or any suitable open space
to the determines by the Sangguniang Barangay;
4. Allocate barangay fund for the barangay ecological waste management Program
approved by the Sangguniang Barangay;
5. Integrate the Ecological Solid Waste Management Program in the Barangay
Development Plan (BDP) and/or Annual Investment Plan (AIP).
6. Find the alternative sources of funds other than the regular barangay budget.
7. Submit a monthly report to the Municipal ESMC on the progress of the program, copy
furnished Municipal DILG Office.
8. Implement policies and plan on the following:

EDUCATION:

a. Develop and disseminate IEC materials on Solid Waste management to every household,
business establishments, and other institution in the barangays;
b. Setting up redemption or eco-centers (MRF) within the barangay for non-biodegradable
or recyclable materials before selling in bulk to junk shops.

ENFORCEMENT:
a. Enact barangay ordinances on the establishment of ward system and other incentive and
functions in the barangay and other rules and regulations to implement the program.

ENTREPENEURIAL:
a. Establish a system of buying and selling of recyclable waste including compost.

SECTION 3: SECRETARIAT
a. Barangay BEWSWMC secretariat shall be formed to assist the committee in the
performance of its function. It shall provide technical and administrative support
whenever necessary. The BEWSWMC shall be composed of its following;

SECTION 4: FUNCTION OF THE PUNONG BARANGAY

1. Strict observed the provisions of RA 9003 and related Department Issuances.


2. Establish a material recovery facility (MRF) in the barangay or in cluster, in a barangay
owned or based land or any suitable open space to be determined by the barangay
through its Sangguniang.
3. Allocate certain parcel of land or to the cluster for the MRF.
4. Initiate information campaign through public consultation in their respective localities.
5. Implement a comprehensive solid waste management system, enacted through an
ordinance
6. Communicate with the concerned municipal environment and natural resources officer or
DENR regional office for technical support in the event there is a need to train LGU
personnel on comprehensive solid waste management.

SECTION 5: EFFECTIVITY

This Executive Order shall take effect immediately upon its approval.
