Introduction1

In the N am e o f Allah, T he M ost Merciful, T he Bene ficent

Ind eed all praise is du e to Allah. W e praise H im , seek His aid,


ask for His forgiveness and re pe nt to H im . W e seek refuge
w ith Allah from the evil o f o ur o w n souls and fro m the evil of
ou r w icked actions. W ho m soev er Allah guides, then non e can
misguide; and whomsoever Allah misguides, then none can
guide.

I testify tha t non e has the rig ht to b e w orsh ipped except Allah,
alone without any partner; and I testify that Muhammad is His
slave and Messenger. May abundant peace and blessings be
up on him , his family an d all o f his com panions.

Th e text o f this treatise is a translation o f “T he Bo ok O f


Fasting” from the boo k “ al-Fiqh al-Muyassar .”

Shaykh Salih Al al-Shaykh said about this book in his


introduction:

“Th is book comprises o f Fiqh rulings p ertainin g to the


acts o f w orship and d ealings, alon g w ith their evidences
from the noble Book and the authentic Prophetic

The First Issue: The D efinition O f Fasting A n d A Clarification


O f Its Pillars

1. Its D efinition : Siyam in the Arabic langu ag e is to refrain


from som ething.

In the Shari ah [Islamic law] it means to refrain from food,


drink and anything that breaks the fast, with the intention,
from the appearance o f the true Fajr until the setting o f the
sun.

2. Its Pillars: Fro m the re ligiou s defin ition o f Siyam it is clear


that it has two essential pillars, which are:

i. R efraining from a ny thin g that breaks the fast from the


appearance o f Fajr until the setting o f the sun. T he p ro o f for
this pillar is the Sa yin g o f Allah:

“So now have sexual relations with them and seek that
w hic h Allah has ord aine d for yo u (offspring), and eat and
drink until the w hite thread (light) o f daw n appears to
yo u distinct from the black thread (darkness o f nigh t),
then complete your fast till the nightfall.” [Al-Baqarah:
187]

T he m ean ing o f “w hite threa d” and “black threa d” is the


w hiteness o f the day and the darkness o f the night.

ii. The Intention: The fasting person refrains from anything


that breaks the Fast with the intention that this is worship
for Allah, Th e M ighty and M ajestic. Th ro ug h the intention,
actions that are performed as worship are differentiated
from oth er actions.

Similarly, thro ug h the inte ntion acts o f wo rship are


distinguished from one another. So the fasting person
intends by his Fast either the fast o f Ram adan or o ther than
it from the various typ es o f fasts.

T he p ro o f for this pillar is his saying

“Actions are ju d g ed acco rding to the intentions and


every person will receive what they intended.”1

The Second Issue: The Ruling OJ Fasting Ramadan And The Prooj
For This

Allah, The Mighty and Majestic, made it compulsory to fast the


m on th o f Ram adan, and H e m ade it one o f the five pillars o f
Islam.

And this is in His Saying

“O yo u w ho believe! Fas ting is prescribe d for yo u as it


was prescribed for those before you, that you may
becom e rig hteous.” [A l-Baqara h: 183]

And His Saying (d\2j!oU^,):

“T he m on th o f Ramadan in w hich w as revealed the


Q u r’an, a guid anc e for m an kind and clear proofs for the
guidance and the criterion (between right and wrong).
So w ho ev er o f you sights (the crescent on the first nigh t
of) the m on th (of Ram adan), he mu st fast that m o n th .”
[Al-Baqarah: 185]

A nd based up on w hat was narrated by Abdullah Ibn 'Um ar


(iiijfej) w h o said th at the M ess en ge r o f Allah said:

“Islam is built upon five: the testification that none has


the right to be worshipped in truth except Allah and that
M uham m ad is the M essenger o f Allah, the establishment
o f the prayer, pay m ent o f Zakat, the Fast o f Ram adan,
and the Pilgrim age [Hajj] to the sacred house for the one
w ho is able to find a w ay .”1

A nd due to w ha t is narrated by Ta lhah Ibn ‘Ubaidallah (


that a Bedouin with unkempt hair came to the Prophet
and said:

“O M essenger o f Allah, inform m e o f the fasting wh ich


Allah has made obligatory upon me?” The Prophet said:
“T he m on th o f R am adan.” T he m an fu rther asked: “Is
there any oth er [fast] up on m e?” H e said: “No ,
unless you perfo rm the su pere roga tory fasts.. .”2

This nation has unanimously agreed upon the obligation of


fasting R am adan and that it is on e o f the pillars o f Islam, w hich
is known from the religion by necessity, and whoever denies
this is a disbeliever, an apostate from Islam.

Therefore, the obligation to fast Ramadan is established by the


Book, the Sun nah and the consensus o f the Muslims; and the
Muslims agree up on the disbelief o f the o ne w ho rejects this.

The Third Issue: The Types O f Fast

Fasting is divided into two categories: Supererogatory and


obligatory.

The obligatory Fast can be further divided into three


categories:

1. T he Fast o f Ram adan.


2. T he Fast o f expiations.
3. T he Fast o f a vow .

T he discussion here w ill revolve aro un d the Fast o f Ram adan


and the supererogatory Fast; as for the other categories then
they will be [spoken abo ut] at the approp riate place - if Allah
Wills.

The Fourth Issue: The Excellence O f Fasting The M onth O f


Ramadan A n d The W is dom Behind Its Legislation

1. Its V irtue

U po n the authority o f Abu H urairah that the Prophet


said:

“W ho eve r stands in prayer on the n ight o f Divine


D ecree ou t o f true faith and aw aiting his recompense,
the n his previous sins will be forg iven . W h o ev er fasts the
m onth o f Ramadan out o f true faith and aw aiting his
recom pense, th en his previous sins will be fo rgive n.”1
