Memo to Commissioners
SUBIECT:
Commissioners,
‘This report is not necessarily an update since we have transitioned as per the last
Commission directive, but rather a finding of past conduct ofthe Starke police
department over the past two and a half months. Sheriff Smith and Ihave worked
‘well together and kept in almost daily communication. The same cannot be said for
‘the Department's cooperation. Several times during this process, [have had to get
‘others involved to have the Chief cooperate as he stated multiple times, he did not
hhave to listen to me or do what | asked. Iam not stating en opinion, however, only
factual information I have been witness to or gathered from others With first-hand
knowledge.
1. February 22, 2024 ~ Police Department
‘a. Met with Sheriff at the police department to go aver the building
'. 2 bottles labeled “oxycontin” from 2013 were found in an office. No
record of how it may have been used. ! had the Sherif?'s Office test
this and it was placebo. Certain procedures should be followed, and
the botle should be secured and in the evidence room according to
the Sheriff's Office

Based on the above information, I have no way of knowing what is and is not
accounted for. Chief Johnson provided several letters stating what was transfered
however, I do not know if this is everything. I recommend a forensic audit to
properly account forall purchases, inventory, transfer, contracts, cash transactions,

Mullins ~the Commission voted that all equipment needed to be

everything together and inventoried. I sent you a list of what I

Mallins -“you don't know who has what or what's ben assigned?
‘What about the ears?”
Johnson —"I guess they’re all here. I don’t know. One could be in
California forall I know.”
Mullins “well the Commission said everything was suppose to be

Johnson ~"I'm done. I'm not listening to you anymore, 'm elected
and I don’t have to listen to you.”

‘4. Ms. Davis emailed me asking about the police department's petty
cash fund. “Have the petty cash fund and receipts been tuned in? If
‘no, would you find out when they will be turned in?”.I forwarded
this email to Chief Johnson stating that we needed to know how the
petty cash was used, accounted for, location, logs, data/iles.
Johnson replied, “'l bring you what I was given”, Email attached
b. Johnson brought me a note on the cash with the amounts listed and
the cash bag. The building had been locked and only the Sherif's
Office and me had a key tothe building,
| eannot account as tothe location of the cash prior to Johnson giving it to me, why
itwas not previously given to City Hall, nor any records associated, A forensic
audit may be helpful in determining if there are any losses, misuse, or othe isues
concerning the petty cash fund and its use.

September 19, 2023 ~ Commission Meeting
Chief Johnson announced the retirement of Colonel Barry Warren
‘rom the Starke Police Department afer $0 plus years of service,
. November 2023 ~ Call from Commissioner
Received a phone eal from a Commissioner inguiting about the
Tocation of the blue F-150 Mr, Warren was assigned when he was
employed by the City. I called Chief Johnson and asked. Chief
Johnson stated he was allowing Mr. Warren to keep the F-150 until
December 31, 2023 since he would stil be coordinating the annual
“Shop with a Cop” program.
January 19, 2024
[received a phone call stating that a blue Ford 150 believed to
belong to the City was parked at Camp Blanding. I investigated the
‘matter and went with the Camp Blanding Military Police to
determine the claim. took a picture ofthe truck and license plat,
Called Sheriff's Office to confirm the plate numbers. They
confitmed the truck was the City’s. This was the track Mr. Barry
‘Warren drove prior to is retirement. I called Chief Johnson and suid
‘Commissioner called and sent an email wanting to know the
location of the blue F-150. Johnson sad he didn't think Barry ad
brought it back yet but knows that it needs to be. Said he allowed
him to use it unil after Shop with a Cop atthe end of December.
Stated that Barry works at Blanding during the day and he would

‘me and talk about it because technically you ean tell me what to
do.” At the end ofthe call, he said “things are going to get ugly”. 1
called the Sheriff and asked ifhe could get Barry to bring te truck
‘back the nextday (Ianuary 20, 2024). The Sheriff called Bary and
ssid Barry would bring it back tothe PD the nextday. Ie as
brought back. Fuel records show that Mr. Warren didnot use the
City fuel pumps for fue after his retirement

training on it
There was no check-in procedure of who came in or out ofthe room.
Did not know who had acces to the room.
Started to doa log but was notable to finish due to finding another
job.

‘Told not to write down time for some work performed. A follow-up
call with Michael Oschner, former officer, confirmed this as well
Both referenced the unprofessionalism and lack of leadership inthe
Department, Both stated multiple times they rarely saw Chief
Johnson or Colonel Warren.
Oschner stated the procedure typically followed for confidential
informants were not followed and stated when someone was pulled
‘verifound with drugs, they would have the person buy drugs fom
someone else and upon doing so, they would not be charged.
6. February 13, 2024 Email to Chief Johnson.
The Sheriffs Office called and said Captain Riles wanted to buy
another laptop and have it assigned to someone for an officer per
Chief Johnson. Stated e needed to keep all the ammo as well and
«id not need to be transferred tothe Shetil's Office.
Sent an email (attached) to James Hughes and Chief Johnson
regarding the need to freeze all purchases at the police department.
Johnson replied, “I can't order anything” “ still have to purchase
items and continue to operate." I replied “At this time, eoreet”
Johnson replied, “Do to not begin abe to purchase anything, I will
not be releasing any property from the Starke Police Department
until this has been resolved”

8. January 16, 2024— Commission Meeting
‘8, Commission voted to enter into an agreement with Bradford County
‘Sheriff's Office for police services, effectively closing the Stutke
Police Department. Within the agreement, an inventory was to be
taken of vehicles, equipment, etc. by March 1 and the Sheriff's
Office would also do an inventory of what he received,
'. After the vote was taken, audience members and officers in|
attendance began shouting and using foul language directed atthe
Commission.
{Johnson proceeds to ext the meeting. On his way out, an altercation
‘with Harold Hill (please see the attached report filed tothe Bradford
County Sheriff's Office by Mr. Hill)
4. Tealled the Sheriffto send a deputy to the meeting as soon as
possible due to the outbursts from the officers and audience
‘members and the altereaton between the Chief and Me, Hill.
9. January 17, 2024 ~ Bradford County Sheriff's Office
a. First transition meeting
b. Johnson was 15 minutes late to the meeting.
‘c. When Johnson arrived, the Sherif said that applications would be
given tothe 12 employees.
<4. We went over provisions inthe agreement concerning inventory,
vehicles, evidence rooms, transfers, ete
Sheriff sid that terminations letters would need to go out to the
officers stating their last day would be February 29, 2024, Johnson,

hhe would like to attend. At the meeting, applications were given to
everyone, and all were encouraged to apply.

City Manager Bob Milner came before the Commission stating the
Commission needed to approve vehicles being taken home more
than 20 miles ftom City Hall. Commissioner Chastain stated per the
take home policy forthe police department, vehicles cannot be taken
‘outside the county and thought the City had adopted the same
policy.
. Commission Meeting Apeil $,2022:
Chief Johnson had requested the Commission purchase two
vehicles. Commissioner Waters questioned the Chief as to why a
vehicle, that was totaled was, in Sanderson, Johnson sated the
officer "was headed to the house". Commissioner Wates thought
the Commission had stopped allowing vehicles from going out of |
the County limits, Johnson stated the CDC had guidelines during
COVID where you could not have contact and allowed cats tobe
taken outside the County to avoid sickness and instead of sanitizing
the cars each shift he relaxed the policy and “mentioned it at a
‘Council meeting and we tried to find it and we couldn't find it in the
‘meeting where it was but I mentioned it in the Council and I'm not
sure who was thereat the meeting. [know [talked to Tornmy
‘Chastain for sure because he questioned me about it and Isai, listen
‘Tommy, this s the seenavio of what 'm dealing with beeause I'm
‘working 24 houts, seven days a week... Now my apologies it should
hhave been dravn back before. We should have already went back
the original policy and I apologize. It slid, We should have done it
January 1 is when we should have done it..It was my fault. 1

Because we put a policy out and I have a copy of it at the house”
‘Commissioner Nugent asked Chief Johnson again why policy was
bypassed. Johnson stated, “I made the choice as an elected offical to
allow them to do that. Johnson apologized again and said, “it won't
happen again”, Commissioner Mortimer stated, “at this point, ing
forward, you know, I will rest easy knowing that we're not going
outside”. Johnson said “yeah, and if God forbid that something

'. The family stated the gentleman was an inpatient ata hospital when
the alleged crime occurred.
«©. Johnson was asked during the meeting what happened. He
responded that it was still an ongoing investigation, and he could not
comment.
<4. Commissioner Mortimer made a motion forthe City Manager to
seek a proposal from Sheriff Smith for police services.
‘¢. Johnson ripped up a letter (attached) for an item on the agenda later
and proceeded to leave. Later stated atthe January 16 meeting that
he had a commitment to go see his grandchildren at a play and did
nat walk out due tothe vote.
12, February 6, 2024
Johnson presented a surplus letter for vehicles and equipment. One
‘Tahoe to be transferred to Hilliard Fire Department. 3 ofthe 9 pages
had “Gordon Smith Chief of Police” on the letterhead. This was
pointed out in the meeting and Johnson replied, “I didn’t even notice
that, It must have been some od letterhead that it was printed on,
'b. Follow up of all other letters sent to the Commission over the last 2
years and none had letterhead with “Gorcon Smith” as police ehief
‘on them and inspection of the Department on February 22, 2024
showed boxes of letethead with “Jeff Johnson Chie of Police”
were found.
13, February 14,2024 Phone Call with Sherift
‘At that time, the Sheriff's Office had not received an inventory list,
b. Chief asked to keep 5 guns, S laptops, 5 radios, and ammo for the
“S-night watchmen”.
Stated that in a conversation a Statke Police officer (Jeff Smith)
Stated they were taking out negative items from personnel files
‘Admin allowed them to copy their own files.
14, February 14,2024— Meeting with Sheriff and Michael Sweeny at the yard
‘a Sweeny stated there was so much ammunition atthe police
‘department that it would take a significant amount of time to use it
up. (Pictures attached)
'. When they went to the police department 1 inventory weapons,
‘Sweeny stated that no one could produce a key tothe armory. Guns
‘were just open in the eonference room.
Stated the Police Department was unorganized, and they could not
find lst of inventory, who was assigned equipment, when equipment
was returned.
Based on the above information, a forensic audit would be beneficial to locate all
purchases made and a proper inventory list may be produced.

enforcement certification will go inactive in ATMS"
‘The City of Starke Charter states, “No person shall serve as chief of
police for the City of Starke unless such person has satisfied the
‘minimum qualification requirements for police officers pursuant to
FS, 943.13
Based on the facts above, documentation, and photos in this report, I recommend a
forensic audit be conducted to accurately aecount for all purchases, potential
‘equipment loss, pety cash accounting, and various other potential issues whatever
they may be.

Mr. Milner adéressed 300 North Water Street encraachment on city property. He sid the
house and the garage are siting on the city’s right-of-way. The house is up forsale and cannot
be Sold without the city granting a quit claim deed. Commissioner Waters asked why this can’t
be grandfathered in. Attorney Sikes said ths is @ requirement of the tite company, He said a
{uit claim deeds the quickest and the cleanest way to clear ths up. Attorney Sikes sad the city
{does not own the property but ithas aright-of.way, He said the commission can authorize him

\Warcen lives 23 miles away from city hall and Director of Operations Seott Anaheim lives 39
miles from city hall. Commissioner Waters said he did have concerns but he is ok wit it now.
Commissioner Smith asked what vehicles they ae driving. Mr. Miner said Mr. Anaheim is
driving 215 year old Sport Trac and Mr. Warren Is drving @ 17 year ala Ford pickup truck,
