1. Submission or acceptance of loan application to UGRO Capital Ltd does not imply / inferred to automatic approvalby the Lender and the Lender will decide the quantum
of the loan at its sole and absolute discretion. The Lender in its sole and absolute discretion may either sanction or reject the application for granting the loan.
2. No discount / gift or any other commitment is given or offered to us/me in whatsoever manner, either not documentedin the loan agreement or committed orally, by UGRO Capital
Ltd or any of its authorized representative(s).
3. Copies of Documents as per the list have been provided by me / us voluntarily/ willingly for loan evaluation and i/we understand that the same will not be returned in
the event of rejection. That I / We shall furnish any additional documents as and when required by UGRO Capital Ltd.
4. I/We declare that all the particulars and information and documents provided along with this form are genuine, true, correct, complete and up to date in all respects
and that I/we have not withheld/suppressed any information /document whatsoever. I / we also authorise UGRO Capital Ltd. to use the documents, video record the
KYC documents, personal discussion and any other information provided herewith to extract additional information from various public domains, including but not
limited to CIBIL/Bureau Report, Perfios Report etc, or for any other regulatory & compliance related matters, prior to sanction/post sanction.
5. Any fault or misrepresentation in the document will be my/ our sole responsibility and UGRO Capital Ltd has the authority to take rightful action against any such fault/
misrepresentation.
6. I/ We hereby authorize and give consent to UGRO Capital Ltd to disclose, without notice to me/ us, information furnished by me/ us in the application form(s)/ related
documents executed/ to be executed in relation to the facilities to be availed by me/ us from UGRO Capital Ltd, to other branches/ subsidiaries/ affiliates/ Credit Bureaus/
to the Credit Information Bureau of India (CIBIL) /Rating Agencies/ Service Providers, banks/ financial institutions, governmental/ regulatory authorities or third parties
who may need, process and publish the information in suchmanner and through such medium as it may be deemed necessary by the lender / RBI, including publishing
the name as part of wilful defaulter's list from time to time, as also use for KYC information verification for information verification, credit risk analysis or for any other
purposes as the Lender deemed necessary.
7. I/We acknowledge and understand that the Application / processing fees collected from me/ us by UGRO Capital Ltd, is for reviewing this loan application as per its
own parameters and is not refundable to me/us under any circumstances whatsoever, irrespective of whether UGRO Capital Ltd sanctions this loan application of mine
or not. In the event the customer cancels the loan after sanction, I/We shall be liable to pay the applicable processing fees and stamping/ other charges, if any borne
by the Lender on behalf of the customer. No cash has been given by me/us to any person for whatsoever reason related to the loan application.
8. I/We hereby represent and warrant that I / we have full and adequate authority/legal competency to submit application and such documents for availing the loan from
UGRO Capital Ltd.
9. I/we authorise and give consent to UGRO Capital Ltd. for sharing new products offerings to me/us regularly.
10. Mobile number provide for receiving OTP is registered in the name of borrower/ applicant/ co-applicant or its main promoter/ director/ partner and I / We hereby
authorize you / subsidiaries / affiliates / Service Provider / Third Party Vendor for sending any promotional / transactional SMS. Further i/we confirm that the provided
mobile number/s are not registered with Do Not Disturb (DND).
11. UGRO Capital Ltd shall have a right to either process and disburse the entire loan amount singly or jointly together with other co-lending partners, i.e., bank/NBFCs, as
it may deem fit. I/We hereby authorize such co-lending partners to access the bureau reports/ credit information from the credit information companies, download
records from CKYCR using the KYC identifier submitted, video record the KYC document, personal discussion, use the documents submitted and any other information
provided herewith to extract additional information from various public domains.
12. Consent under the Digital Personal Data Protection Act, 2023:
a) I/ We undertake that I/we have voluntarily submitted my/our personal data to UGRO Capital Limited for the purpose of availing a loan. I/We hereby
authorize and give consent to UGRO Capital Ltd to process all information, documents and details including but not limited to name, an identification number
such as Aadhaar card, PAN, Driving license no., Electoral card number, location data, or other online identifiers, mobile number, borrower entity name,
location or other KYC information submitted/provided by me/us for the purpose of availing a loan for processes including KYC verification, underwriting,
risk assessment and for any other purpose that may be necessary.
b) I/we understand that UGRO Capital Ltd may use my/our personal data that is collected to provide requested products, services and for UGRO’s internal
business purposes, including, but not limited to:
i. Responding to my/our requests for UGRO’s products and services;
ii. To process my/our transactions and to provide me/us with transaction and post transaction-related services, providing, improving,
and marketing UGRO’s products and services, including site content and performance;
iii. Evaluating my/our use of the services;
iv. Providing new products and service offers that might interest me/us;
v. Responding to my/our requests for information;
vi. Communicating with me/us by e-mail, postal mail or courier, and/or telephone about products or services that may be of interest to me/us;
vii. Maintaining and managing my/our account with UGRO;
viii. Keeping me/us updated on the issues that are relevant to my/our relationship with UGRO;
ix. Monitoring my/our compliance with any terms and conditions associated with our products and services, including to confirm
my/our identity;
x. Performing other functions as described to me/us at the time of collection or pursuant to me/us consent.
c) I/We understand and consent to processing of all collected personal data, information, details and documents provided by me/us to UGRO
Capital Ltd’s agents, contractors, subcontractors, service providers, co-lending partners, investors, potential investors, lenders, potential
lenders, lender’s/ potential lenders representatives, trustees, advisors, consultants, insurers, regulators, potential assignees/acquirors and
other business partners.
d) I/We undertake that all information, details and documents provided by me/us are true and complete and that I/we have the right to withdraw
my/our consent under para 12 of this letter at any time by way of giving a duly signed written communication to UGRO Capital Ltd’s branch or
by writing to [email protected]. I/We also understand that in case of any concerns/complaints regarding the processing of my/our
personal data, I/we shall reach out to the Data Protection Officer, UGRO Capital Ltd on [email protected]. If the same is not addressed
by UGRO capital Ltd in reasonable time, I/we shall have the right to approach the Data Protection Board of India.
