Topics for Training & Labour Welfare & Labor Laws Aspects:

1. WELFARE
1. Accommodation: Free of cost proper accommodation near the site with adequate lighting &
ventilation be provided.
2. Latrine& urinals: Separate latrines for men & women workers with water facility be provided
from first day of work at the site. Until 100 workers 1:20 ratio of Latrine & workers, there after 1
latrine for every additional of 5 workers be maintained. It should be kept in clean & hygienic
condition as per public Health standard and be accessible to workers at all the time. No needs to
provide urinals if the latrines are provided.
3. Drinking water: A sufficient (5 Liters/person) supply of wholesome drinking water be arranged at
all working site. Such point should be marked “ Drinking water” and should be situated at more
than 6 mts. From any washing place, Urinals & latrines.
4. Tea & Light Refreshment: provide tea & light breakfast to every building worker, everyday.
5. Canteen: To provide & maintain a canteen at every work place wherein not less than 250
workers are ordinarily employed. (a) The charges for foods stuff & beverages are based on “No
Profit No Loss”. (b)Suitable arrangement shall be made for the collection and disposal of garbage
from such canteen. (c) Waste water from such canteen shall be carried away in suitable covered
drain and shall not be allowed to accumulate in the surroundings. (d)The floor of canteen shall be
made of smooth and impervious material.
6. First Aid: First Aid box with a prescribed materials be ensured at all the site at all the time
7. Cretches: Where more than 50 women workers are working , Cretches shall be provided for
children bellow 6 years of age.
2. Labour Laws (some basic provisions of the act)
1. Workmen Register: Fill in all the detail( base on ID proof provided) of worker on the very first day
of joining , take his/her signature in this register without entry & signature no worker will start
the work.
2. Muster Roll & Wage Register: Mark present or absent of every worker on daily basis in muster
roll in this specific register. (Form 16 of contract Labour Act). Get worker sign. In wages Register
(Form 17 of Contract Labour Act) on the day of payment (payment should be made on or before
7th of every month for previous month in case of monthly wagers and at the rate must not be less
than Minimum Wages Rates). In case of termination of worker payment must be paid to him on
his last day work.
3. Other Registers: (a)Register of deduction,(b) Register of Over time, (c) Register of fines,
(d)Register of advances, be maintained at the site for the records purpose.
4. ID Card: Every worker will be issued valid ID card on the first day of his/her work. For that
contractor or worker needs to provide 1passport & 1 stamp size photo on his/her day of joining.
The worker must wear (or carry) his/her original ID card while on duty and produce on the
demand. The worker has to return the ID card to HR Record assistant whenever he/she leaves
the work or go on leave. If he/she does not than penalty for each non returned card at the rate
decide by the management will be charged to the contractor.
5. Display of BOCWA Registration: At every site/ bridge the Registration Certificate issued under
the Building & Other Construction Workers’ (Regulation of employment and conditions of
service) Act,1996, be conspicuously displayed .
6. Working Hours & Day of Rest: (a) No worker shall be required or allowed to work for more than
NINE hours a day or forty-eight hours a week. (b) No worker is allowed to work continuously for
more than five hours unless given an interval of half an hour.(c)each worker shall be allowed a
day of rest every week and be granted for the wages for such rest day.(d) the employer has a
right to keep rest day other than a Sunday.
7. Over Time: When a worker work for more than nine hours on any day or more than forty-eight
hours in any week, he/she shall, in respect of overtime work, be entitled to wages at double the
ordinary wages.
8. Display Notice: As per BOCWR, 238, the employer shall display notice at conspicuous place in
which he shows Rates of wages, hours of work, wage period, date of payment names & address
of inspector having jurisdiction, date of payment of unpaid wages in English, Hindi & Local
language understood by majority of building workers.
