BARANGAY ORDINANCE NO. 01-2021
AN ORDINANCE ADOPTING PROVINCIAL ORDINANCE NO.005-2019 FOR PROMOTING RESPONSIBLE
PET OWNERSHIP PRESCRIBING GUIDELINES AND REGULATIONS FOR THE EFFECTIVBE
IMPLEMENTATION OF RABIES PREVENTION AND CONTROL FURTHER IMPOSING PENALTIES FOR
VIOLATIONS THEREOF IN THE BARANGAY BINITAYAN, DARAGA, ALBAY.
WHEREAS, Section 2 RA 9482 otherwise known as the “Anti-Rabies Act of 2007” declares that it
is the policy of the state to protect and promote the right to health of the people. Towards this end, a
system for the control, prevention of the spread, the eventual eradication of human and animal rabies
shall be provided the health interest of the constituents of the Barangay.
WHEREAS, the Barangay of Binitayan, Daraga, Albay should take measures to prevent and
control the transmission of Rabies Virus in order to protect the health interest of the constituents of the
Barangay.
WHEREAS, RA 9482 shall be adopted and implemented by the Sangguniang Barangay of
Binirtayan in support of the program of the Province of Albay and the National Government;
NOW THEREFORE, on motion of Brgy. Kagawad Joenie V. Baylon, Committee on Agriculture and
duly seconded by Brgy. Kagawad Emelda G. Mendoza, Committee on Health and all the members of the
Sangguniang Barangay present.
ARTICLE 1. GENERAL PROVISIONS
Section 1. Tittle The Ordinance shall be known as “The Responsible Pet Ownership Ordinance”
Section 2. Declaration and Policy – It is the declared policy of the Barangay to protect and promote the
right to health of the constituents towards these ends, a system for the control,
prevention of
the spread and eventual eradication of human and animal rabies shall be provided and the
need for responsible pet ownership established;
Section 3. Definition of Terms – for the purpose of this Ordinance the following terms shall be
understood to have the following terms.
Animals – refers to domesticated dogs and cats
Animal Identification Tag (AIT) – shall refer to the plastic or metal label permanently hanging
around each registered dogs or cat’s neck consisting of such information or serials numbers that would
exactly and clearly identify the pet animal upon which tag is imposed with the registration certificate
issued.
ARTICLE 2.- MANDATORY REGISTRATION AND TAGGING
Section 1. Mandatory Animal Registration – there shall be a compulsory registration of all animal at the
Barangay.
Section 2. Registration Fees – a mandatory registration fee of P50.00 shall be collected from the owner
of the animal on a per head basis. The collected fees shall be prorated accordingly; 50% for
the Barangay, 10% to the Municipality and 40% to the province. Remittance shall be made to
the Brgy. Treasurer and shall constitute as Special Fund for the enforcement of this Ordinance
Section 3. Issuance of Registration Card and Animal Identification Tag. – the Barangay shall issue a
a registration card coming from the province and shall tag the animal with device upon
registration. Tagging Fee shall cost P50.00 per animal.
a. All animal, shall be registered within 90 days from the date of effectivity of this
Ordinance.
b. Within three (3) months after the birth or within ten (10) days after the date of arrival of
the animal within the Barangay , It brought from other areas.
c. The registration shall have a validity of one (1) year thus, required to be renewed within
one (1) week from the expiration and annually thereof.
d. The owners shall notify the Barangay of such death or transfer of animal within three (3)
days in case of loss, immediately thereafter.
Section 4. Duty of Owners. – It shall be the duty of the owner to submit their animal for registration
Tagging to the deputized enforcer/agent and pay the prescribed fees.
Section 5. Duty of the Barangay. – It shall be the duty of the Punong Barangay/Deputized Agent to
implement and supervise the provisions of this ordinance.
ARTICLE 3. – MANDATORY VACCINATION
Section 1. Duty of Owners – the owner shall be responsible to have their dog/act regularly vaccinated
with anti-rabies and maintains a registration card which shall contain vaccinations conducted on their
animal, for accurate record purposes. The owners shall be presented at all the times the vaccination
card.
ARTICLE 4. – ESTABLISHMENT OF ANIMAL POUND
Section 1. Animal Pound – the Barangay shall establish and maintain animal pound where impounded
animal shall be kept in any authorized impounding area in accordance with section 9 of RA 9482.
ARTICLE 5. – IMPLEMENTING RULES AND REGULATIONS
Section 2. Impounding Fees. – the owners shall be liable to pay the corresponding impounding fee in
accordance with this ordinance. The impounded animal shall be released to its owner upon payment of
a fine of P1,000.00 a day from the date of apprehension.
The Sangguniang Barangay shall formulated and issue the necessary implementing rules and regulations
within fifteen (15) days from the effectivity of this ordianace.
ARTICLE 6. – PROHIBITED ACTS AND PENALTIES/ FINE
(AS OF THE PROVINCIAL ORDINANCE NO.005-2019 to be adopted by the Barangay)
a. Pet owners who fail or refuse to have their animal registered and immunized against rabies shall
be punished by a fine of 5,000.00 per animal.
b. Pet owners who refuse to have their animal put under observation after said Dog/Cat has bitten
an individual shall be fine of 2,000.00 pesos.
c. Every animal unleashed and without little catcher brought in the public place Pet Owners shall
be meted a fine of 2,000.00 pesos.
d. Refusal or Failure of the Punong Barangay / Deputized agent to implement and supervise the
enforcement of the provisions of this ordinance pursuant to sec. 06 hereof, shall be held
administratively liable.
e. Collected fines under this Article shall be shared under the following; 40% for the Barangay 10%
for the Municipality and 50% for the Province.
ARTICLE 7. – REPEALING CLAUSE
All ordinances executive orders, rules and regulations inconsistent with the provisions of this
ordinance are hereby repealed or modified accordingly.
ARTICLE 8. – SEPARABILITY CLAUSE
If, for any reasons, any part of the provisions of these Ordinance shall be held unconstitutional
or invalid, other parts or provisions thereof which are not affected thereby shall continue to be in full
force and effect.
ARTICLE 9. EFFECTIVITY
This ordinance shall take effect fifteen (15) days upon ordained by the Sangguniang Barangay.
