WHAT IS BUSINESS PROCESS
OUTSOURCING or BPO?
According to Investopedia, Business process outsourcing (BPO)
refers to the practice of contracting out different business-
related processes to third-party providers.
BPO is often referred to as information technology-enabled
services (ITES) because it relies on technology/infrastructure
that enables external companies to efficiently perform their
roles.
Philippine Laws for the
BPO Sector
Trade and labor laws need to be updated to
protect the industry and the people who work in it.
This was important for the Philippines because a
lot of outsourcing companies were growing there.
Business process outsourcing (BPOs) has helped
enhance the country's income and stabilize the
Philippine economy. As a result, the Philippine
government created programs to uphold Philippine
law and safeguard and advance the BPO sector.
ADVANTAGES OF BPO There are plenty of reasons why
businesses outsource processes.

Republic Act No. 11165:
Telecommuting Act
The Telecommuting Act is created specifically to support
and protect BPO employees. This republic act grants
them the right to a fair, reasonable pay rate, considering
the nature of their working schedule.
This includes adjustment and incentives such as night
differentials and overtime pay. Aside from this, the
provision also guarantees that they receive the right to
paid leaves and the option to either work or take a leave
on public holidays.
SECTION 5: FAIR TREATMENT
The employer shall ensure that the telecommuting
employee are given the same treatment as that of
comparable employees are given the same
treatment as that of comparable employees working
at the time employer's premises.
An employer must give a telecommuting employee
the chance to regularly meet with their coworkers,
and provide them with access to company
information. The employer must also make sure that
steps are taken to prevent the employee from
feeling isolated from the rest of the working
community at the company.
WHAT DO WE THINK ABOUT THE LAW.....
By establishing a WFH system that is fair to all parties, the
legislation protects fairness by providing employees with the same
benefits and treatment as those who work on the employer's
premises. Employees will profit from a flexible environment, while
employers will gain from greater production owing to lower
absenteeism as a result of this type of arrangement.
WHAT DO WE THINK ABOUT THE LAW.....
RA No. 11165 helps the employee of companies to clearly define its
definition of the nature of their work. In this law was clearly stated
of what are the responsibilities of companies to their employees.
The law also provides the needs of every employee and what are
their rights.
WHAT DO WE THINK ABOUT THE LAW.....
The enacted law is excellent for employees; apart from being
a reward, it also grants them the same rights as employers.
Similarly, others, including one of my family members, have
received different treatment, such as holiday breaks and
workloads that exceed what the contract said. As a result, this
legislation protects them from unjust treatment and power
abuse.
Are BPO companies willing to provide the necessities for both onsite
and WFH employees for the sake of fairness and Equity?
BPO companies would only have the capabilities to provide the necessities for both on-site and WFH
employees for the sake of fairness and Equity if the government sticks and make sure that the BPO
companies will still be eligible for all tax breaks provided by the CREATE Act.
Once this assurance has been secured, BPO companies can now sustain some of the common issues
faced mostly by the WFH employees like longer working hours to compensate “unproductivity”, due to a
bad or nonexistent internet connection which leads to unpaid salary, etc.
By solving this issue, it at the very least make it possible to thoroughly examine a company’s remote
strategy and offer fixes that will make WFH setups advantageous for both employers and employees.

GOOD

Strict implementation of the law will provide
fairness and equality assuring the welfare of the
employees especially in the BPO sector. A well
implemented law will benefit both management and
employees. With enough legal supervision and legal
understanding, management will be able to execute
and obey the rules and privileges that the law
provides.
CONCLUSION
The Telecommunications Act is a fine piece
of legislation on paper, but if not well
implemented, it will lose its purpose. Strict
enforcement of the law ensures fairness and
equality, especially protecting the welfare of
employees in her BPO department. If
employees could spend more time with their
families without sacrificing productivity, it
would benefit everyone. The law itself have
some of its law but it is up to the
management to implement and abide the
rules that will be significant in the
effectiveness of the law.
