DEED OF CONDITIONAL SALE

KNOW ALL MEN BY THESE PRESENTS:

This deed, executed by and between:

PATRECIO V. YOCOR married to AGAPITA SOJOR, of legal age, Filipino, with


residence and postal address at San Miguel, Bacong, Negros Oriental, hereinafter referred to as
the VENDOR,

-and-

MERLYN OYANGORIN CALAGUI, of legal age, Filipino, widow, with residence and
postal address at San Miguel, Bacong, Negros Oriental, hereinafter referred to as the VENDEE.

WITNESSETH:

WHEREAS, the VENDOR is the absolute owner of the entire Lot No. 2877-I-1,
consisting an area of 962 square meters, more or less, which said sub lot is a portion of Lot No.
2877 and is covered by OCT No. 17391, the following parcel of land described as follows:

A parcel of land ( Lot N0. 2877 of the Cadastral Survey of the Municipality of
Bacong, with the improvements thereon, situated at Barangay San Miguel, Municipality
of Bacong. Bounded on the NE by Lot Nos. 2877, 2866 and a Barrio Road; on the SE by
the Mindanao Sea and Lot No. 2878; on the SW by Lot No. 2878 and the San Miguel
Creek; and on the NW by Lot Nos. 2876, 2874, 2866, containing an area of SIXTY
SEVEN THOUSAND FOUR HUNDRED AND EIGHTY FOUR (67,484) SQUARE
METERS, more or less;

WHEREAS, the VENDOR ownership is embraced by the Extrajudicial Settlement of


Estate and Partition dated July 06, 2020, entered as Doc No. 435, Page No. 88, Book No. XII,
Series of 2020 in the notarial register of Atty. Achilles Arturo S. Umbac Jr.;

WHEREAS, for and in consideration of the sum of FOUR HUNDRED FORTY


THOUSAND PESOS (PHP 440,000.00) Philippine Currency, the VENDOR does hereby SELL,
CEDE, TRANSFER and CONVEY unto the said VENDEE, her heirs, successors and assigns,
an area of TWO HUNDRED TWENTY (220) SQUARE METERS, portion of Lot No. 2877-I-1-E,
without improvements, subject, however, to the following terms and conditions:

1. That upon signing hereof, the VENDEE will pay a down payment of TWO HUNDRED
THOUSAND PESOS (PHP200,000.00), thus, leaving the balance of PHP240,000.00;

2. That the remaining balance will be paid every 6 months within one (1) year; That the
VENDEE will pay in FULL on or before May 30, 2025;

3. That only then the Deed of Absolute Sale will be executed by the VENDOR upon full
payment;

4. That if the VENDEE failed to pay the full amount on May 30, 2025, the VENDORS will add on a
10% interest of the remaining balance;

5. That the VENDEE cannot construct a building/residential house in the above-mentioned area
until she is fully paid and has no obligation to the VENDORS;

6. That violation of the herein terms and conditions shall be enforceable in accordance with
law
WHEREAS, the VENDOR hereby warrant to protect and defend the right of the
VENDEE from any adverse claim whatsoever.

IN WITNESS WHEREOF, the parties have hereunto set their hands this

consisting of two (2) pages, including this page and is attested to be personally known to me or
identified by me through competent evidence of identity as defined by the Rules on Notarial
Practice of 2004, and they present to me that the signatures on the instrument as their free and
voluntary affixed by them for the purposes stated in the instrument or document as their free
and voluntary act and deed.
