In exercise of the powers conferred by the proviso to the Article 309 of the
Constitution of India, the Governor of Bihar is hereby pleased to make amendments to "The
Bihar Dentist Service Rules, 2014" as per the following rules —
1. Short title, extent and commencement:
a. These Rules may be called "The Bihar Dentist Service (Amendment) Rules,
2023."
b. These Rules extends to the entire State of Bihar.
c. This notification will be effective from the date of issue.
2. Substitution of Rule-2(C) of "The Bihar Dentist Service Rules, 2014" :- The said
rule is hereby substituted as follows-
2 (c) Commission means Bihar Technical Service Commission ;"
3. Amendment of Rule-3(2) of "The Bihar Dentist Service Rules, 2014" :- The word
1T' used in the said hindi version rule is substituted by the word '1Ic*ict)'.
4. Amendment of Rule-5(2) and 5(3) of "The Bihar Dentist Service Rules, 2014"
The clause "a government hospital of the state" used in the said rules is substituted
by the clause 'any non-private hospitals (either Bihar government central
government, municipal corporation, panchayati raj institutions or any other
local institutions, including military hospital) within the jurisdiction of the State
of Bihar."
5. Addition of Rule-5(5) after rule 5(4) in "The Bihar Dentist Service Rules, 2014":-
after the said rule, rule 5(5) is hereby added as follows-
5(5)(i) In any transaction of the appointment, the department may extend the
maximum age limit by recording reasons thereof.
(ii) Relaxation of equivalent period of work done as contractual employment in
any non-private hospitals (either Bihar government, Central government,
Municipal corporation, Panchayati raj institutions or any other local
institutions, including Military hospital) within the jurisdiction of the State of
Bihar will be given in the maximum age limit. Herein part of any working year
will also be included.
6. Substitution of Rule-7 of "The Bihar Dentist Service Rules, 2014" :- The said rule
is hereby substituted as follows-
"7. Procedure of Recruitment - (i) For appointment against the vacancies of
both the sub-cadres of this service, the department will calculate the vacancies
separately on the basis of 1st April of the year. Then after getting the roster clearance
done, the department will send the reservation/category wise requisition to the
Commission by 30th April. On receipt of the requisition for recruitment, the
Commission will declare/advertise the number of vacancies to be filled by direct
recruitment in such manner as it deems appropriate and will invite applications from
eligible candidates.

(ii) Candidates will be given marks for competitive examination, interview
and work experience for the selection of dentists for appointment in general
duty/specialist sub-cadre of Bihar Dentist Service. The syllabus of the competitive
examination will be the same as decided by the government. The process for
interview will be decided by the Commission. The total marks prescribed for
competitive examination, interview and work experience will be 100. Out of that 100
marks will be determined as follows:-
(i) For marks obtained in competitive examination - 60 marks
(ii) For an interview - 15 marks
(iii) On the basis of satisfactory service on equivalent post
rendered by the candidate on contractual basis,
maximum weightage of 25 marks at the rate of 25 marks
maximum five marks per year (the proportionate
marks obtained by dividing 365 after multiplying the
number of working days by 5, will be added for any
part of a year), will be given for work experience
obtained in any non-private hospitals (either Bihar
government, Central government, Municipal
corporation, Panchayati raj institutions or any other
local institutions, including Military hospital) within
the jurisdiction of the State of Bihar."
Total marks — 100 marks
NOTE :- (a) The marks to be awarded to a candidate for the marks obtained in the
competitive examination will be determined by multiplying the percentage
of total marks obtained in the said competitive examination by a multiple of
0.6. For example, if a candidate has obtained 50 percent marks in the
competitive examination, then he will be given 50 x 0.6 = 30 marks.
NOTE :- (b) The minimum qualifying marks will be 30.
(iii) 50 percent horizontal reservation will also be applicable in all reservation
categories for the candidates who passed from dental colleges located within the state
of Bihar.
(iv) The Commission will send the merit list prepared on the basis of the above
mentioned rules and the reservation/category wise recommendations as per the
requistioned vacancies to the department, on that basis the appointment may be
considered after the approval of the Government. The above recommendation of the
Commission will remain effective for one year from the date of receipt."
7. Substitution of Rule-9 of "The Bihar Dentist Service Rules, 2014" :- The said rule
is hereby substituted as follows-
"During the probation period, dentists will have to pass the
departmental examination as prescribed. The syllabus of the departmental
examination will be the same as determined by the Central Examination
Committee with the consent of the department."
8. Substitution of Rule-14(1) and 14(2) of "The Bihar Dentist Service Rules, 20 14":-
The said rule are hereby substituted as follows-
"14(1):- The following Dynamic ACP will be admissible to the dentists of
both the sub-cadre of The Bihar Dentist Service Cadre during the entire service
period:-

(a) General duties sub-cadre :- The first Dynamic ACP will be admissible to
the Dentists of general duties sub-cadre after completing four years of service. The
second Dynamic ACP will be admissible after the next five years of obtaining the first
Dynamic ACP or after completing a total of nine years of service. The third Dynamic
ACP will be admissible after four years of obtaining the second Dynamic ACP or
after completing a total of thirteen years of service. Similarly, after the next seven
years of obtaining the third Dynamic ACP or after completing a total of twenty years
of service, the fourth Dynamic ACP will be admissible for the Dentists of general
duties sub-cadre.
(b) Specialist sub-cadre :- The first Dynamic ACP will be admissible to the
Dentists of specialist sub-cadre after completing two years of service. The Second
Dynamic ACP will be admissible after four years of obtaining the first Dynamic ACP
or after completing a total of six years of service. Similarly, after the next seven years
of obtaining the second Dynamic ACP or after completing a total of thirteen years of
service, the third Dynamic ACP will be eligible for the Dentists of specialist sub-
cadre.
14(2) The facility of Dynamic ACP shall be admissible up to maximum pay
Level-14 (unrevised pay scale PB-4, Grade pay 10,000/- )."
