Dear Sir,

TRIENNIAL GENERAL BODY MEETING OF THE UNITS : OBJECTIONS

With reference to the General Secretary, SBISA Delhi Circle, circular No. GS/
43/2024 dated 01st Feb 2024.

1. The following are the grave objections regarding violation of Rules for
Conducting Unit Elections as:-

(a) The circular was signed on date 01 Feb 2024, by General


Secretary, SBISA Delhi circle. The Electoral College circular of the
Triennial General Council by was neither sent by Registered Post/
Speed Post nor published in any national newspapers for the information
of all the ordinary members/Units.

(b) In terms of Rule 72, period of 7 days Notice time to undertake unit
meeting i.e. for Nomination filing/Nomination withdrawal, election
etc was not served. Then how come all the meeting information,
nomination filing, election etc activity was undertaken at Unit
formation at Branch.

(c) All the New unit formation letter/Register & delegate letters at
Branch are signed before 5 or 6 Feb 2024. When no information
is sought to the common members/Branch either by post or
through print media how come the unit formation was carried out.
The other members have not obtained my consent or in view of
unit election.

(d) In terms of Rule 9(b), neither the unit committee nor the Election
officer has taken verification of unit members whether he is a
bonafide member of association in terms of Rule 5 to 10 by paying
his monthly subscription in the calendar year. If detailed scrutiny is
done it will reveal that maximum are not paying the union
subscription hence not eligible to participate in unit committee
formation thus the Unit elected body shell be considered as
defunct.
(e) In terms of Rule 29, every candidate shall be proposed by a
regular member and seconded by another regular member for the
Triennial General Body Meeting of the Units. Once there are four
regular members in a unit, who will propose as candidate and
seconded by another members to the opponent, so the procedure
applied in Rule 29 is not feasible and reasonable which deny the
justice to the candidate/member as per the bylaws. Also the
procedure applied under Rule 29 will create an atmosphere of
chaos and apprehension among the members and there are very
much chances of generating hooliganism and a feeling of
insecurity among the opponent candidates/ members.

(f) In terms of Rule 29, one member has taken two positions in Unit
formation, violating the SBISA/Chief election officer circular.

(g) In terms of Chief election officer circular Election Procedure para


(f), which spells out that “the election committee shall be appointed
either by the outgoing unit committee or the general body with the
details of election schedule”. It is brought to your kind notice that
no such activity was evident from records of the Branch unit
formation, thus violating the SBISA/Chief election officer circular.

(h) In terms of Chief election officer circular Election Procedure Under


Alternate Delegate:- which spells out as “ Such office/Branch of
state Bank of India where the number of workmen staff employed
is less than 4 (four) no unit of the Association will be formed but a
member at such an office/Branch will either be elected by the
members of the office/Branch or appointed by the General
Secretary who shall be designated as “Representative” and shall
exercises all the powers of unit secretary. It is brought to your kind
notice that no such activity was evident from records of the Branch
unit formation, thus violating the SBISA/Chief election officer
circular.

(i) In terms of Chief election officer circular Election Procedure


wherein it is instructed that “ the copy of the Proceedings of the
triennial general body meeting of the unit must reach to the office
of the chief election officer only by Registered/Speed Post latest
at the under noted address”. Here it is intimated that you yourself
is aware that all such copy of the proceedings in question was
collected forcible by the contesting Bahubali Members and you
have extended the support by extending the same by Hand and
not by the post. On investigation the speed post No or
Registered post no under which you received the same need
to be investigated. Thus violating the SBISA/election bylaws.
(j) The applicant was not afforded opportunity to file the nomination
for unit election. The lawful meeting was not taken place for unit
election. No consent or signature was taken, also the
candidates/members were threatened which let down the high
ethics of SBISA.

2. The applicant is bonafide member and depositing subscription to the


Union on monthly basis. Then, what is the use to be a member of Union?

3. In view of above grave objection and violation, The chief election officer:-

(a) Is urged humbly to undertake through investigation and also


include CCTV footage at branch and statements of fellow members in
his report and all the method and tools used to investigate truth and
prosecute as per SBISA constitution.

(b) Detail an observer for our unit and other units of our Region to
undertake free, fare and lawful unit election.

(c) Take up the matter with Federation Secretary/Chief secretary on


point no 1 (e) above.

(d) Inform the entire above objection to Federation Secretary/Chief


secretary and obtain his guidance and Instruction under intimation to
applicant.

4. Till that time all the anomaly are duly addressed and removed it is kindly
requested that, the election process to be kept in abeyance and the Unit shall be
considered as defunct.

5. Thus in the interest of justice and members faith in SBISA, it is requested


to kindly undertake all necessary steps and draw your findings and initiate steps
as per constitution against the culprits who have defamed the glory of SBISA. It
is also requested that, the decision and finding copy is served to the agitated
member well in time, or it will be presumed that you are biased and prejudiced
and not interested to act as per law, which will compel and force agitated
member to obtain justice by filing a legal suit in the suitable court for necessary
justice and direction in context of ongoing election.
