SANGGUNIANG BARANGAY RESOLUTION NO.

____ SERIES OF 2024

A RESOLUTION CONDUCTING A COMPREHENSIVE BARANGAY ROAD


CLEARING OPERATION AND ENACTING RELATED MEASURES TO MAINTAIN
SAFE AND PASSABLE ROADS WITHIN BARANGAY ____, ZONE _____, PASAY
CITY.

WHEREAS, the State prioritizes public safety and welfare, including the proper management
and control of public roads (reference Local Government Code of 1991, Book 1, Section 16 and
Chapter 3, Article III, Section 447);

WHEREAS, a Supreme Court decision (Dacanay vs Mayor Asistio, Jr., 208 SCRA 404) affirms
public roads are for public use and cannot be used for private gain;

WHEREAS, the Civil Code of the Philippines designates obstructions on public roads as
nuisances subject to removal;

WHEREAS, following the President's directive on January 05, 2024, urging local officials,
including the newly elected village and youth council officials, to take the lead in cleaning up all
roads, canals, markets, and schools;

WHEREAS, Department of the Interior and Local Government Memorandum Circular No.
2024-053 reminds all local chief executives on their roles relative to the conduct of road clearing
operations within their area of jurisdiction, and to guide all concerned in the performance of their
roles and responsibilities in the implementation of road clearing operations under the Bagong
Pilipinas Program;

NOW, THEREFORE, BE IT RESOLVED BY THE SANGGUNIANG BARANGAY OF


[NAME OF BARANGAY], PASAY CITY IN REGULAR SESSION ASSEMBLED:

SECTION 1. Conduct of Comprehensive Barangay Road Clearing Operation.

A comprehensive barangay road clearing operation shall be conducted on [Date] in all barangay
roads, including sidewalks, alleys, and drainage canals. This operation shall involve the removal
of the following obstructions:

 Parked vehicles on sidewalks and designated no-parking zones


 Unattended construction materials and equipment
 Vendor stalls and other structures encroaching on public roads
 Debris, garbage, and other waste materials

SECTION 2. Creation of Barangay Road Clearing Task Force.

A Barangay Road Clearing Task Force is hereby created, composed of the following:

 Punong Barangay (Chairperson)


 Sangguniang Barangay Members
 Sangguniang Kabataan Officials
 Barangay Tanods

The Task Force shall be responsible for the planning, implementation, and monitoring of the
barangay road clearing operation.

SECTION 3. Public Information and Awareness Campaign.

The barangay shall conduct a public information and awareness campaign to inform residents
about the upcoming road clearing operation. This campaign shall utilize the following methods:

 Barangay announcements
 Information dissemination through social media platforms
 Posting of notices in conspicuous areas

The campaign shall also educate residents on the importance of keeping roads clean and free
from obstructions, and their responsibility in maintaining public order.

SECTION 4. Coordination with Law Enforcement Agencies.

The Barangay shall coordinate with the Philippine National Police (PNP), MMDA, City
Government, and other concerned agencies to ensure the smooth conduct of the barangay road
clearing operation. All concerned agencies shall be responsible for:

 Traffic management
 Crowd control
 Enforcement of existing laws and ordinances related to road obstruction
 Removal of electric posts, light posts, etc.

SECTION 5. Continuing Maintenance of Barangay Roads.

The barangay shall establish a mechanism for the continuous maintenance of barangay roads
after the clearing operation. This may include:

 Scheduling of regular clean-up activities


 Implementation of designated waste disposal areas
 Strict enforcement of existing city and barangay ordinances on road use and obstruction

SECTION 6. Funding.

Funding for the barangay road clearing operation may be sourced from the barangay's General
Fund, in accordance with existing budgeting procedures.

SECTION 7. Effectivity.
This Resolution shall take effect immediately upon its approval by the Sangguniang Barangay.
