GENERAL INFORMATION
The Executive Engineer & Senior Manager (C), Supreme Court Project Division-II,
CPWD, Additional Building Complex, Supreme Court of India, New Delhi-110001 on behalf of
The President of India invites online bids (on EPC Mode-I) from Eligible CPWD enlisted
contractors of appropriate class in Building & Roads (erstwhile Composite/ Building/
Infrastructure) category and non-CPWD eligible firms in two bid system (Eligibility Bid &
Financial Bid) for the following work:
1. Bidders who fulfil the eligibility requirements prescribed in this bid document shall be
eligible to apply. Joint ventures are not accepted.
2. The intending bidder must read the terms and conditions of CPWD-6 carefully. He should
only submit his bid if he considers himself eligible and he is in possession of all the
documents required.
3. Information and instructions for bidders posted on website shall form part of bid document.
4. The bid document consisting of plans, specifications, schedule of quantities of various
types of items to be executed and the set of terms & conditions of the contract to be
complied with and other necessary documents can be seen and downloaded from website

5. But the bid can only be submitted after deposition of original EMD either in the office of
However, if a tenderer quotes nil rates or does not quote any percentage above/ below
on the lowest amount of the tender or any section/ sub head in percentage rate tender,
the tender shall be treated as invalid and will not be considered as lowest tenderer.
12. The Eligibility bid shall be opened first on due date and time as mentioned above. The
time and date of opening of financial bid of bidders qualifying the Eligibility bid shall be
communicated to them at a later date.
13. Pre-bid conference shall be held at O/o SE cum PD, Supreme Court Project cum
Maintenance Circle, CPWD, Additional Building Complex, Supreme Court of
India, New Delhi-110001, 11:00 Hrs. on 02-05-2024 to clear the doubt of intending
bidders, if any. After pre-bid conference, certain Clarification / modifications may be
issued by uploading on website, all modifications/ addendums/ corrigendum issued
regarding this bidding process, shall be uploaded on website only.
14. When bids are invited in three stage system and if it is desired to submit revised financial
bid then it shall be mandatory to submit revised financial bid. If not submitted, then the
bid submitted earlier shall become invalid.
15. The department reserves the right to reject any prospective application without assigning
If the bidder has not obtained GST registration as applicable, then he shall scan
and upload following undertaking along with other bid documents:
“If work is awarded to me, I/we shall obtain GST registration Certificate, as
applicable, within one month from the date of receipt of award letter or before
release of any payment by CPWD, whichever is earlier, failing which I/We shall be
responsible for any delay in payments which will be due towards me/us on a/c of
the work executed and/or for any action taken by CPWD or GST department in
this regard.”
iii. Enlistment Order for CPWD Contractors who are enlisted in appropriate Class of
Building & Roads Category (Not applicable for Non-CPWD Bidders).
iv. Certificate of Financial Turnover & Profit/Loss from CA in Proforma of Form-A (Not
applicable for CPWD enlisted Contractors in appropriate Class).
v. Banker’s Certificate in Proforma of Form-B or Net Worth Certificate in Proforma of
Form-B1. (Not applicable for CPWD enlisted Contractors in appropriate Class).
vi. Details of eligible similar nature of works completed during the last seven years
ending last day of month previous to the one in which bids are invited in proforma
of form-C (Not applicable for CPWD enlisted contractors in appropriate class).
vii. Details of ongoing works (Projects under execution by the bidder) in Proforma of
Form-C1 certified by Chartered Accountant (Not applicable for CPWD enlisted
Contractors in appropriate Class)
viii. Details of work in support of having successfully completed with the Structural
System Technology proposed to be used in the work in Proforma of Form-C2
ix. Details of existing commitments on ongoing works and calculation of Bidding
Capacity in Proforma of Form-C3.
x. Performance Report of Eligible Similar works (submitted in Form-C) in Proforma of
Form-D (If Non-government works are shown in support of eligibility, certified
copy of the Tax Deducted at Source (TDS) Certificate shall be submitted along
with the experience certificate and the TDS amount shall tally with the actual
amount of work done)
xi. Certificate of experience in support of having successfully completed one work
with the Structural System Technology proposed to be used in the work
(submitted in Form-C2) in Proforma of Form-D2
xii. Structure and Organization of the bidder in Proforma of Form-E (Not applicable
for CPWD enlisted Contractors in appropriate Class)
xiii. Integrity Pact signed by the bidder in the presence of a witness for works equal to
or above the threshold value given in Schedule-F.
xiv. Letter of Transmittal.
xv. Any other document as specified in the Bid document.
xvi. Undertaking of structural stability and soundness as per prescribed format Form –F.

bid then it shall be mandatory to submit revised financial bid. If not submitted, then then
the bid submitted earlier shall become invalid.
8. Earnest Money in the form of Insurance Surety Bonds, Account Payee Demand Draft,
Fixed Deposit Receipt, Banker’s Cheque or Bank Guarantee (for the balance amount as
prescribed) from any of Commercial Banks (drawn in favour of Executive Engineer,
Supreme Court Project Division-I, CPWD, Additional Building Complex, Supreme
Court of India, New Delhi.) shall be scanned and uploaded to the e-tendering website
within the period of bid submission. The original EMD should be deposited either in the
office of Executive Engineer inviting bids or division office of any Executive Engineer,
CPWD within the period of bid submission. The EMD receiving Executive Engineer
(including NIT issuing EE/AE) shall issue a receipt of deposition of Earnest Money deposit
to the bidder in a prescribed format (enclosed) uploaded by tender inviting EE in the NIT.
A part of earnest money is acceptable in the form of bank guarantee also. In such case,
minimum 50% of earnest money or Rs.20 lacs, whichever is less, shall have to be
deposited in shape prescribed above, and balance may be deposited in shape of Bank
Guarantee of any Commercial Bank having validity for 6 (six) months or more from last
date of receipt of bids which is to be scanned and uploaded by the intending bidders.
The Earnest Money given by all the tenderers except the lowest tenderer shall be
refunded immediately after the expiry of stipulated bid validity period or immediately
after acceptance of bid of the successful bidder, whichever is earlier. However, in case of
two/three bid system, earnest money deposit of bidders unsuccessful during
technical/eligibility bid evaluation etc. shall be returned within 30 days of declaration of
result of technical/eligibility bid evaluation.
Copy of Enlistment Order and other documents as specified in the bid document shall be
scanned and uploaded to the e-tendering website within the period of bid submission.
However, certified copy of all the scanned and uploaded documents as specified in the bid
document shall have to be submitted by the lowest bidder only along with physical EMD
of the scanned copy of EMD uploaded within a week physically in the office of tender
inviting authority. Online bid documents submitted by intending bidders shall be
opened only of those bidders, whose original EMD deposited with any division of
CPWD and other documents scanned and uploaded are found in order.

period specified in Schedule F. This guarantee shall be in the form of Insurance Surety
Bonds, Account Payee Demand Draft, Fixed Deposit Receipt or Bank Guarantee from any
of Commercial Banks in accordance with the prescribed form. In case the contractor
fails to deposit the said performance guarantee within the period as indicated in
Schedule ‘F’ including the extended period if any, the Earnest Money deposited by the
contractor shall be forfeited automatically without any notice to the contractor. The
earnest money deposited along with bid shall be returned after receiving the aforesaid
performance guarantee.
The contractor whose bid is accepted will also be required to furnish either copy of
applicable licenses/registrations or proof of applying for obtaining labour licenses,
registration with EPFO, ESIC and BOCW Welfare Board including Provident fund code no.
if applicable and also ensure the compliance of aforesaid provisions by the sub-
contractors, if any engaged by the contractor for the said work within the period specified
in Schedule F.
11. The description of work as follow:
Expansion of Supreme Court Building for creating Additional Court Rooms
including Constitutional Court, Chambers for the Judges and facilities for
Lawyers & Litigants (EPC Mode-I).
Intending Bidders are advised to inspect and examine the site and its surroundings
and satisfy themselves before submitting their bids as to the nature of the ground and
sub-soil (so far as is practicable), the form and nature of the site, the means of access to
the site, the accommodation they may require and in general shall themselves obtain all
necessary information as to risks, contingencies and other circumstances which may
influence or affect their bid. A bidder shall be deemed to have full knowledge of the site
whether he inspects it or not and no extra charge consequent on any misunderstanding
or otherwise shall be allowed. The bidder shall be responsible for arranging and
maintaining at his own cost all materials, tools & plants, water, electricity access, facilities
for workers and all other Services required for executing the work unless otherwise
specifically provided for in the contract documents. Submission of a bid by a bidder
implies that he has read this notice and all other contract documents and has made
himself aware of the scope and specifications of the work to be done and of conditions
and rates at which stores, tools and plant, etc. will be issued to him by the Government
and local conditions and other factors having a bearing on the execution of the work.
12. The competent authority on behalf of the President of India does not bind itself to accept
the lowest or any other bid and reserves to itself the authority to reject any or all the bids
received without the assignment of any reason. All bids in which any of the prescribed
condition is not fulfilled or any condition including that of conditional rebate is put forth
by the bidders shall be summarily rejected.
13. Canvassing whether directly or indirectly, in connection with bidders is strictly prohibited
and the bids submitted by the contractors who resort to canvassing will be liable to
rejection.
14. The competent authority on behalf of President of India reserves to himself the right of
accepting the whole or any part of the bid and the bidder shall be bound to perform the
same at the rate quoted.
15. The contractor shall not be permitted to bid for works in the CPWD Circle (Division in case
of contractors of Horticulture/Nursery category) responsible for award and execution

of contracts, in which his near relative is posted a Divisional Accountant or as an officer
in any capacity between the grades of Superintending Engineer and Junior Engineer (both
inclusive). He shall also intimate the names of persons who are working with him in any
capacity or are subsequently employed by him and who are near relatives to any gazette
officer in the Central Public Works Department or in the Ministry of Urban Development.
Any breach of this condition by the contractor would render him liable to be removed
from the approved list of contractors of this Department.
16. No Engineer of Gazetted Rank or other Gazetted Officer employed in Engineering or
Administrative duties in an Engineering Department of the Government of India is
allowed to work as a contractor for a period of one year after his retirement from
Government service, without the previous permission of the Government of India in
writing. This contract is liable to be cancelled if either the contractor or any of his
employees is found any time to be such a person who had not obtained the permission of
the Government of India as aforesaid before submission of the bid or engagement in the
contractor’s service.
17. The bid for the work shall remain open for acceptance for a period of 75 (Seventy-Five)
days from the date of opening of Eligibility Bids.
(i) If any tenderer withdraws his tender or makes any modification in the terms &
conditions of the tender which is not acceptable to the department within 7 days
after last date of submission of bids, then the Government shall without prejudice to
any other right or remedy, be at liberty to forfeit 50% of the earnest money
absolutely irrespective of letter of acceptance for the work is issued or not.
(ii) If any tenderer withdraws his tender or makes any modification in the terms &
conditions of the tender which is not acceptable to the department after expiry of 7
days after last date of submission of bids, then the Government shall without
prejudice to any other right or remedy, be at liberty to forfeit 100% of the earnest
money absolutely irrespective of letter of acceptance for the work is issued or not.
(iii) In case of forfeiture of earnest money as prescribed in para (i) and (ii) above, the
bidders shall not be allowed to participate in the rebidding process of the same work.
18. This notice inviting Bid shall form a part of the contract document. The successful bidder/
contractor, on acceptance of his bid by the Accepting Authority shall within 15 days from
the stipulated date of start of the work, sign the contract consisting of:
(i) The Notice Inviting Bid, all the documents including Additional Conditions,
Specifications and Drawings, if any, forming part of the bid as uploaded at the time of
invitation of bid and the Rates quoted online at the time of submission of Bid and
Acceptance thereof together with any correspondence leading thereto.
(ii) Standard CPWD Form-7 or other Standard CPWD Form as mentioned.
19. For Composite Bids
(i) The Bid document includes following Components:

Sections:
(ii) The bidders must associate himself, with agencies as per NIT conditions.
(iii) The eligible bidders shall quote rates for all items of major component as well as for
all items of minor components of work.
(iv) After acceptance of the bid by Competent Authority, the EE&SM (C) i.e. Engineer-in-
charge of Major Component of the work shall issue letter of award on behalf of the
President of India. After the work is awarded, the Main Contractor will have to enter
into one Agreement with Engineer-in-charge of Major Component and has also to
sign two or more copies of Agreement depending upon number of Minor
Components. One such signed set of Agreement shall be handed over to Engineer-in-
charge of Minor Component(s). The EE&SM (C) i.e. Engineer-in-Charge of Major
Component will operate the Agreement in general. The EE&SM (E)/DDH i.e. Engineer-
in-charge of Minor Component(s) shall operate relevant Parts of the Agreement
pertaining to respective Minor Components of the work.
(v) Entire work under the scope of composite bid including major and all minor
components shall be executed under one agreement.
(vi) Security Deposit will be worked out separately for each component corresponding to
the estimated cost of the respective component of works.
(vii) The main contractor has to associate agencies for specialized component(s)
conforming to eligibility criteria as defined in the bid document and has to submit
detail of such agency(s) to Engineer-in-charge of relevant component(s). within
prescribed time. Name of the agency(s) to be associated shall be approved by
Engineer-in-charge of relevant component(s).
(viii) In case the main contractor intends to change any of the above agency/agencies
during the operation of the contract, he shall obtain prior approval of Engineer-in-
charge of relevant specialized component(s).
The new agency/agencies shall also have to satisfy the laid down eligibility criteria.
In case Engineer-in-charge is not satisfied with the performance of any agency, he
can direct the contractor to change the agency executing such items of work and
this shall be binding on the contractor.
(ix) The main contractor has to enter into MoU with agency(s) associated by him. Copy of
such MoU shall be submitted to EE/ DDH in charge of each relevant component as well
as to EE in Charge of major component. In case of change of associate contractor,
the main agency(s) has to enter into MoU/agreement with the new contractor
associated by him.
(x) Running payment for the major component shall be made by EE of major
discipline to the main contractor. Running payment for minor components shall be
made by the Engineer- in- charge of the discipline of minor component directly to the
main contractor
20. Part Completion
(A) Phase-I: - The composite work related to Phase-I shall be treated as complete when
all the components of the work related to Phase-I are complete. The completion
certificate of the composite work for such buildings under Phase-I shall be recorded

by Engineer-in- charge of major component after record of completion certificate of
all other components.
(B) Phase-II: - The composite work related to Phase-II shall be treated as complete
when all the components of the work related to Phase-II are complete. The
completion certificate of the composite work for such buildings under Phase-II shall
be recorded by Engineer-in- charge of major component after record of completion
certificate of all other components.
(C) Final bill of whole work shall be finalized and paid by the EE of major component.
Engineer(s) in charge of minor component(s) will prepare and pass the final bill for
their component of work and pass on the same to the EE of major component for
including in the final bill for composite contract.
21. INTEGRITY PACT: The contractor shall download the Integrity Pact which is a part of
tender documents, affix his signature in the presence of a witness, and upload the same
while submitting online bids for all works of estimated cost put to tender equal to or more
than the threshold value given in Schedule-F. In the event of his failure to sign and
upload the Integrity Pact along with other bid documents, his bid shall be rejected.
22. The intending bidders are required to update their profile in CPWD e- tender portal and to
upload their bids well in advance of last date of submission of tender. Any issue related to
updating profile to uploading tender can be resolved through the Executive Engineer &
Senior Manager (C), Supreme Court Project Division-II, CPWD, Additional
Building Complex, Supreme Court of India, New Delhi, (Phone no. 011-20913256,

SECTION-I
1. The proposed project will be carried out in two distinct phases. The entire
development is to be designed adhering to the local body norms/ NBC 2016.
Phase-I
During this phase, two existing buildings, namely the Annexe Building (with a built-
up area of 8619.14 sqm) and the Museum Building (with a built-up area of 1066.12
sqm), will be demolished. Additionally, the existing underground sump with a
capacity of 540 KL will also be demolished and relocated.
During this phase, a construction project encompassing a total area of 38252.35
sqm will be undertaken. The structure will comprise two basements, ground floor,
and five stories above the ground.
The scope of Phase-I construction includes the following: -
i) Lawyers & Litigant Utilities
ii) 10 Nos. Typical Court Rooms, each with an area of 212 sqm
iii) 1 No. Constitutional Court with an area of 660 sqm
iv) 1 No. Hon’ble CJI Chamber with an area of 200 sqm
v) 14 Nos. Hon'ble Judges Chambers, each with an area of 100 sqm
vi) Hon'ble Judges Lounge & Assembly Hall.
vii) 2 Nos. basements for 266 Nos. car parking.
Phase-II
During this phase of the project will involve the demolition of an East and West
Wing connected with semicircular arc section of the Main Supreme Court Building,
including Court No. 6 to 17, with a built-up area of 18189.61 sqm. This said
demolition work will be carried out only after the completion of Phase-I
construction.
This phase of the project will involve the construction of a total area of 48305.60
sqm. The new structure will comprise two basements, ground floor, and four storeys
above-ground.
The scope of Phase-II construction includes the following: -
i) Lawyers & Litigant Utilities
ii) 18 Nos. Court Rooms, each with an area of 212 sqm.
iii) 28 Nos. Hon'ble Judges Chambers, each with an area of 100 sqm
iv) 4 Nos. Registrar Court Rooms, each with an area of 138 sqm
v) 2 Nos. Court Master Wings
vi) 2 Nos. Registry Offices
vii) Conference Rooms
viii) 2 Nos. National Judicial Data Grid (NJDG) Rooms
ix) 16 Nos. Registrar Chambers, each with an area of 50 sqm
x) 2 Nos. basements for 800 Nos. car parking
As per the requirement of The Hon’ble Supreme Court of India, the conceptual design
of the complex with elevations have been developed based on a
1.0 General:
1.1 Letter of Transmittal and Forms for deciding Eligibility are given in
Section III.
1.2 All information called for in the enclosed forms should be furnished against the
relevant columns in the forms. If for any reason, information is furnished on a
separate sheet, this fact should be mentioned against the relevant column. Even,
if no information is to be provided in a column, a ‘nil’ or ‘no such case’ entry
should be made in that column. If any particulars/query is not applicable in case
of the bidder, it should be stated as ‘Not applicable’. The bidders are cautioned
that not giving complete information called for in the application forms or not
giving it in clear terms or making any change in the prescribed forms (or)
deliberately suppressing the information may result in the bid being summarily
disqualified. Bid made by telegram or telex and those received late will not be
entertained.
1.3 References, information and certificate from the respective clients certifying
suitability, technical knowledge or capability of the bidder should be signed by an
officer not below the rank of Executive Engineer or equivalent.
1.4 The bidder may furnish any additional information, which he thinks is necessary
to establish his capabilities to successfully complete envisaged work. He is,
however advised not to furnish superfluous information. No information shall
be entertained after submission of eligibility bid unless it is called for by
the Employer.
2.0 Definitions:
2.1 In this document the following words and expression have their meaning hereby
assigned to them.
2.2 EMPLOYER means the President of India, acting through Executive Engineer &
Senior Manager (C), Supreme Court Project Division-II, CPWD,
Additional Building Complex, Supreme Court of India, New Delhi-
110001.
3.1 If the bidder is an individual, the application shall be signed by him above his/her
full type written name and current address.
3.2 If the bidder is a proprietary firm; the application shall be signed by the
proprietor above his/her full type written name and the full name of his firm with
its current address.
(i) Three similar completed works each costing not less than Rs. 201,08,31,460/- or
Two similar completed works each costing not less than Rs. 301,62,47,189/- or
One similar completed work of value not less than Rs. 402,16,62,919/-.

Note:
At least three out of above specialised E&M Services should have been executed
in the same contract of office Building. Remaining specialised E&M Services if
executed under a separate contract shall also be considered for the purpose of
assessing the Technical Competence only without adding its monetary value for
determining the Eligibility Criteria.
Note:
1) Eligible works required to satisfy conditions of Para 7(i) & (ii) above, should have
been executed under valid contract and Client Certificate in support of having
satisfactorily completed the works along with desired details shall be uploaded
with bids. In case non-government works are submitted in support of eligibility,
certified copy of the contract documents and Tax Deducted at Source (TDS)
certificates shall also be submitted and the TDS amount shall tally with the actual
amount of work done.
7.2 The Bidder should have had Average Annual Financial Turnover of
Rs. 150,81,23,595/- on construction works during immediate last three
consecutive financial years ending 31st March 2024. Year in which no turnover
is shown would also be considered for working out the average. The value of
annual turnover figures shall be brought to current value by enhancing
the actual turnover figure at simple rate of 7% per annum.
7.3 The Bidder should not have incurred any loss (profit after tax should be positive)
in more than two years during available last five consecutive balance sheets
(balance sheet in case of private/ public limited company means its standalone
financial statement and consolidated financial statement both), duly audited and
certified by the Chartered Accountant.
The Bidder should have Banker’s Certificate from a commercial Bank for
Rs. 201,08,31,460/- certified by his Bankers (on the prescribed Form B).
The Bidder should have Net Worth Certificate of Rs. 50,27,07,865/- issued
by the certified Chartered Accountant (on the prescribed Form B-1)
7.4 The bidder should have sufficient number of Technical and Administrative
employees for the proper execution of the contract. The bidder should submit a
list of these employees stating clearly how they would be involved in this work
within 15 days of award of work.
7.5 Bidding Capacity: The bidder shall submit the bidding capacity as per
form ‘C-3’.
Note:
1. Bidding capacity is applicable for all the contractors including CPWD enlisted
contractors.
2. Bidding capacity formula, for CPWD contractors who are enlisted based on Para
6.1 of Enlistment Rules-2023 i.e. government retired engineer/ architect for three
years from the date of issue of enlistment order, is as follows:

8.1 The details submitted by the bidders will be evaluated in the following manner:
8.1.1 The Initial Eligibility Criteria prescribed in Para 7.0 above in respect of
experience of eligible similar Works Completed, Loss, Bankers Certificate,
Financial Turnover and Bidding Capacity etc., will first be scrutinized and the
Bidder’s eligibility for the work be determined.
8.1.2 The Bidder’s (Non-CPWD enlisted Bidders) qualifying the Initial Eligibility
Criteria as above will be further evaluated for following Criteria by Scoring
method on the basis of details furnished by them (as per Annexure-1:
Criteria for Evaluation of the performance of bidder for Pre- Eligibility):
To become eligible for short listing, the bidder must secure at least 50%
(Fifty percent) marks in each of the above criteria (a, b, c & d) and 60%
(Sixty percent) marks in aggregate.
The department, however reserves the right to restrict the list of such qualified
bidders to any number deemed suitable by it.
Note: The average value of performance of works for time over run and
quality shall be taken on the basis of performance report of the eligible similar
works.
8.2 Even though any bidder may satisfy the above requirements, he would be
liable to disqualification if he has:
(a) Annual financial statement for the last Five years in Form ‘A’ and
(b) Banker’s certificate in Form ’B’ or Net Worth Certificate in Form ‘B1’

PREAMBLE
WHEREAS the Principal has floated the Tender (NIT No. ...................................) (herein
after referred to as Tender) and intends to award, under laid down organizational procedure,
contract for the work: “Expansion of Supreme Court Building for creating Additional
Court Rooms including Constitutional Court, Chambers for the Judges and facilities
for Lawyers & Litigants (EPC Mode-I).” herein after referred to as the “Contract”.
AND WHEREAS the Principal values full compliance with all relevant laws of the land, rules,
regulations, economic use of resources and of fairness/ transparency in its relation with its
Bidder(s) and Contractor(s).
AND WHEREAS to meet the purpose aforesaid both the parties have agreed to enter into this
Integrity Agreement (hereinafter referred to as “Integrity Pact” or “Pact”), the terms and
conditions of which shall also be read as integral part and parcel of the Tender/Bid
documents and Contract between the parties.
In order to achieve these goals, the Principal will appoint Independent External Monitors
(IEMs) who will monitor the tender process and the execution of the contract for compliance
with the principles mentioned hereunder.
NOW, THEREFORE, in consideration of mutual covenants contained in this Pact, the parties
hereby agree as follows and this Integrity Pact witness as under:
Articles
4) The Bidder(s)/Contractor(s) will not instigate third persons to commit offences outlined
above or be an accessory to such offences.
5) The Bidder(s)/Contractor(s) will not, directly or through any other person or firm indulge
in fraudulent practice, wilful misrepresentation or omission of facts or submission of
fake/forged documents in order to induce public official to act in reliance thereof, with the
purpose of obtaining unjust advantage by or causing damage to justified interest of others
and/or to influence the procurement process to detriment of the Government interests.
6) The Bidder(s)/Contractor(s) will not, directly or through any other person or firm use
Coercive Practices (which shall include the act of obtaining something, compelling an
action or influencing a decision through intimidation, threat or the use of force directly or
indirectly, where potential or actual injury may befall upon a person, his/her reputation or
property) to influence their participation in the tendering process).
Without prejudice to any rights that may be available to the Principal under law or the
Contract or its established policies and laid down procedures, the Principal shall have the
following rights in case of breach of this Integrity Pact by the Bidder(s)/Contractor(s) and the
Bidder/Contractor accepts and undertakes to respect and uphold the Principal’s absolute
right:
1) If the Bidder(s)/Contractor(s), either before award or during execution of Contract has
committed a transgression through a violation of Article 2 above or in any other form,
such as to put his reliability or credibility in question, the Principal after giving 14 days’
notice to the contractor shall have powers to disqualify the Bidder(s)/Contractor(s) from
the Tender process or terminate/determine the Contract, if already executed or exclude
the Bidder/Contractor from future contract award processes. The imposition and duration
of the exclusion will be determined by the severity of transgression and determined by
the Principal. Such exclusion may be forever or for a limited period as decided by the
Principal.
2) Forfeiture of EMD/Performance Guarantee/Security Deposit: If the Principal has
disqualified the Bidder(s) from the Tender process prior to the award of the Contract or
terminated/determined the Contract or has accrued the right to terminate/determine the
Contract according to Article 3(1), the Principal apart from exercising any legal rights
that may have accrued to the Principal, may in its considered opinion forfeit the entire
amount of Earnest Money Deposit / Performance Guarantee and Security Deposit of the
Bidder/Contractor.
3) Criminal Liability: If the Principal obtains knowledge of conduct of a Bidder or Contractor,
or of an employee or a representative or an associate of a Bidder or Contractor which
constitutes corruption within the meaning Prevention of Corruption Act, or if the Principal
has substantive suspicion in this regard, the Principal will inform the same to law
enforcing agencies for further investigation.
This Integrity Pact begins when both the parties have legally signed it. It expires for the
Contractor, 12 months after the completion of work under the contract or expiry of defect
liability period or last payment made under the contract, whichever is later and for all other
bidders, 6 months after the Contract has been awarded.
If any claim is made/lodged during the time, the same shall be binding and continue to be
valid despite the lapse of this Integrity Pacts as specified above, unless it is
discharged/determined by the ADG/SDG, CPWD concerned.
1) This Integrity Pact is subject to Indian Law, place of performance and jurisdiction is
the Headquarters of the Division of the Principal, who has floated the Tender.
2) Changes and supplements as well as termination notice need to be made in writing.
3) If the Contractor is a partnership or a consortium, this Pact must be signed by all the
partners or by one or more partner holding power of attorney signed by all partners
and consortium members. In case of a Company, the Integrity Pact must be signed by
a representative duly authorized by board resolution.
4) Should one or several provisions of this Integrity Pact turn out to be invalid; the
remainder of this Pact remains valid. In this case, the parties will strive to come to an
agreement to their original intensions.
5) Issues like Warranty/Guarantee etc. shall be outside the purview of IEMs.
6) It is agreed term and condition that any dispute or difference arising between the
parties with regard to the terms of this Integrity Pact, any action taken by the
Principal in accordance with this Integrity Pact or interpretation thereof shall not be
subject to arbitration.
7) In view of the mature of Integrity Pact, the Integrity Pact is irrevocable and shall
remain valid, even if the main Tender/Contract is terminated, till the currency of the
Integrity Pact.
1) The Principal appoints competent and credible Independent External Monitor for this
Pact after approval by Central Vigilance Commission (Names and address of lEMs are
as mentioned in Schedule-F). The task of the Monitor is to review independently and
objectively, whether and to what extent the parties comply with the obligations under
this agreement.
2) The Monitor is not subject to instructions by the representatives of the parties and
performs his/her functions neutrally and independently. The Monitor would have
access to all contract documents, whenever required. It will be obligatory for him/her
to treat the information and documents of the Bidders / Contractors as confidential.
3) The Bidder(s)/Contractor(s) accepts that the IEM has the right to access without
restriction to all project documentation of the Principal including that provided by the
Contractor. The Contractor will also grant the lEM, upon his/her request and
demonstration of a valid interest, unrestricted and unconditional access to their
project documentation. The same is applicable to sub- contractors.
4) The IEM is under contractual obligation to treat the information and documents of the
Bidder(s)/Contractor(s)/Sub-contractor(s) with confidentiality. The IEM has also
signed 'Non Disclosure of Confidential Information' and 'Absence of Conflict of
Interest'. ln case if any conflict of interest arising at a later date, the IEM shall inform
the Engineer-in-Charge and recuse himself / herself from that case.
5) As soon as the IEM notices, or believes to notice, a violation of this agreement,
he/she will so inform the Management of the Principal and request the Management to
discontinue or take corrective action, or to take other relevant action. The IEM can in
this regard submit non-binding recommendations. Beyond this, the IEM has no right
to demand from the parties that they act in a specific manner, refrain from action or
tolerate action.
6) The IEM will submit a written report to the SDG/ADG concerned within 8 to 10 weeks
from the date of reference or intimation to him by the Principal and, should the
occasion arise, submit proposals for correcting problematic situations.
7) If the IEM has reported to the ADG/SDG concerned, a substantiated suspicion of an
offence under relevant IPC/PC Act, and the ADG/SDG concerned has, within a
reasonable time, not taken visible action to proceed against such offence or reported
it to the Chief Vigilance Officer, the IEM may also transmit this information directly to
the Central Vigilance Commissioner.
8) The Principal will provide to the IEM sufficient information about all meetings among
the parties related to the project provided such meetings could have impact on
contractual relations between the Principal and the Contractor. The parties will offer to
the IEM the option to participate in such meetings.
9) The word IEM or monitor would include both singular and plural.
All rights and remedies of the parties hereto shall be in addition to all the other legal rights
and remedies belonging to such parties under the Contract and/or law and the same shall be
deemed to be cumulative and not alternative to such legal rights and remedies aforesaid. For
the sake of brevity, both the Parties agree that this Integrity Pact will have precedence over

treated at per with Graduate Engineers. Diploma holder with minimum 10- years relevant
experience with a reputed construction company can be treated at par with Graduate

not be in excess of 50% of requirement of degree engineers.
(ii) The above given strength shall be required to be deployed as and when necessity arises
at site. The deployment of Engineer(s) shall be commensurate with physical and financial
progress of work. In case the work is hindered or slows down due to any reason,
Contractor need not deploy the engineers as per above table, In case it result in
prolongation of contract, the contractor shall deploy the engineers as per requirement. In
any case, no compensation due to engagement of Technical Representative(s) in
prolongation period of contract shall be payable.
(iii) The Bidder shall submit a certificate of employment of the technical representative (s) (in
the form of copy of Form -16 or CPF deduction issued to the Engineers employed by him)
along with every account bill/final bill and shall produce evidence of regular physical
availability of such engineers on the above project at any times if so, required by the
Engineer-in-charge.
(iv) The Recovery on account of non-deployment of technical staff shall be made by the
Engineer in Charge of the respective Discipline / Component.

3. The GCC and its amendments as mentioned above, though not attached with this tender
document, shall be deemed to be part of the Tender document and Agreement to be
signed with the successful bidder.
1.1 The intending bidders can contact the Executive Engineer & Senior Manager (C),
SCPD-II, CPWD, Additional Building Complex, Supreme Court of India, New
Delhi-110001, Email: [email protected], for inspection of the actual building and
other structure i/c electrical & mechanical installation to be demolished, to satisfy
themselves completely before submitting their bids to ascertain the nature of the site,
the means of access to the site, the accommodation they may require and in general
shall themselves obtain of necessary information regarding risks which may arise during
demolition, contingencies and other circumstances which may influence of affect their
bid. The scope of demolition work shall include structures with civil & electrical services
within the campus as directed by Engineer-in-Charge. Quoted price shall include cost of
required demolition and shifting of all utilities etc of if any encountered on the site.
Demolition of building structures as per plan (Drawing no. DWG-01 to DWG-04) in two
Phases. In Phase-I, two existing buildings, namely the Annexe Building (with a built-up
area of 8691.14 sqm) and the Museum building (with a built-up area of 1066.12 sqm)
and underground sump with capacity of 540 KL to be demolished. In phase-II, the East
& West wing connected with semicircular arc section of the Main Supreme Court Building
i/c Court No. 6 to 17 with a built-up area 18189.61 sqm to be demolished. The
demolition work of Phase-II is to be taken up only after the completion of Phase-I
construction and properly functional including all other structures and services such as
pump houses, water tank etc. compete.
1.2 The scope of demolition work shall include demolition of all structures & service viz.
Civil, Electrical and Horticultural complete within the site of work of construction
including boundary wall, gates, underground water tank, toe wall, park, huts, drainage
and sewer lines and other services etc.
1.3 The demolition work shall be started immediately after award of work and providing
temporary MEP services to the retained structures. It must be completed within a period
of 03 months. All the pre- construction activities including preparation and requisite
approvals shall be taken up simultaneously to avoid interruption in the execution
activities at site. Noise barrier to be provided so that no inconvenience is caused to the
functioning of court. The noise level in the retained area to be less then 50db during
court hour.
1.4 The buildings/ installations shall be handed over on "as it is where it basis" to the
successful bidder.
1.5 It shall be the responsibility of the successful bidder/ contractor to maintain the
security/watch and ward of the buildings to be dismantled after taking over of the
buildings and the Engineer-in-Charge shall not be responsible for any loss of any
materials from the site.
1.7 The EPC contractor shall be responsible for any damage done in the demolition and
indemnify the Government against any claim on account thereof including third party
and workmen's Compensation claims. If any damage is done to any adjoining property,
the Engineer-in-Charge shall be entitled to restore the same at the risk and expense of
the successful bidder or treat the default as a ground for terminating the contract.
1.8 The EPC contractor shall acquire no interest in the land comprised in the said property
except a permission to enter thereon for the demolition only aforesaid & for construction
of structure as per terms and conditions of this bid document and shall not be entitled to
reside or allow anyone to reside or remain on the property except the authorised
persons as per permission of the Engineer-in-Charge during the contract
period/extended contract period.
1.9 The work shall be executed without creating disturbance to the movement of the people
on the adjoining roads. Care shall be taken to prevent dust spreading beyond the
building to be demolished. The work shall be executed without making heavy noise and
without impacting the efficiency of the judiciary.
1.11 The EPC contractor shall take instructions from the Engineer-In-Charge for stacking of
construction materials. Surplus Excavated earth and building rubbish shall be removed
from site within 03 days of occurrence.
1.12 The EPC contractor should appoint a full-time qualified person as safety-in-charge for
taking care of implementation of safety system to safeguard the workers engaged for
the demolition of the building. Any untoward incident happened during demolition shall
be the responsibility of the EPC contractor.
1.13 No unauthorized person should be allowed to enter workspace without following the
prescribed safety norms. All the dangerous moving parts of the portable / fixed
machineries being used shall be adequately guarded. Inserting of bare wires for tapping
the power from electrical sockets is completely prohibited. All unsafe conditions, unsafe
acts identified by agency, reported by site supervisors and / or safety personnel to be
corrected immediately.
1.14 The Agency shall abide to the restrictions, rules, regulations and timings imposed by
the department on the working and on movement of labour, materials etc.
1.16 Wherever any reference to any Indian Standard Specification occurs in the documents
relating to this contract, the same shall be inclusive of all amendments issued there to or
revision thereof if any, up to the date of receipt of bids.
2.1 The debris / building rubbish waste and the like (Construction & Demolition waste
commonly known as C & D waste) generated from the demolition work, should be taken
out to be disposed it off the campus in a legal and environmentally friendly way to the
"declared dumping/Land fill sites" where the facility of re-cycling of C&D waste are
available. The documentary proof with respect to disposal of all C&D waste generated
out of demolition work shall be submitted to Engineer-in-charge on weekly basis. Some
of C&D waste processing units such as IL&FS (Waste Management & Urban Services
Limited at Bhalswa, Delhi or any other approved by competent authority can be used for
the purpose. The excavated earth only can be disposed of at suitable location as per
prevailing guidelines of competent authority.
2.2 The material like bricks, wooden doors, trusses, steel reinforcement rods and debris etc.
including the electrical installations and fittings shall become the property of agency.
However, the norms of disposal of C&D waste, earth or other disposable material shall
be a binding on the agency.
1.0 GENERAL:
1.1. The site is situated at on a triangular plot sparring 17 Acres amidst Tilak Marg to the
west, Mathura Road to the East, Bhagwan Dass Road to the south and Tilka Bridge to
the north of main block of the Supreme Court of India. The proposed project shall be
carried out in two district phases. The new infra structure will create possibilities for
expanding and reorganizing the significantly enlarged operation of the court complex.
In phase-I, two existing building, namely the Annexe Building (with approx. a build-
up area of 8619.14 sqm) and the Museum building (with approx. built-up are of
1066.12 sqm) shall be demolished. Additionally, the existing underground sump
(capacity 540KL) and services shall be shifted and demolished. All the current E&M
services, including HVAC, Substation, Firefighting, UPS, DG Set etc., located in
Annexe Building, must be relocated. This relocation must ensure that no disruption to
operations of Court No. 1 to 17, while also maintaining the efficiency of the judiciary
and ensuring timely delivery of justice, before and demolition takes place. The total
constructed area in this phase is approx. 38252.35 sqm as per conceptual drawings.
The Scope of Phase-I is Construction of following: -
c) 1 No. Constitutional Court with an area of 660 sqm with dome as per
conceptual drawing.
g) 2 Nos. basements for approx. 266 Nos. car parking as per conceptual drawing.
In Phase-II the East and West Wing of connected with semicircular arc section of
existing Main Supreme Court Building shall be demolished including Court No. 6 to 17.
This said demolition work will be carried out only after the completion of Phase-I,
Construction and shifting. The total constructed area in this phase is approx.
48305.60Sqm as per conceptual drawing. The scope of Phase-II is Construction of
following: -
g) Conference Rooms
Site Survey plan and Soil Investigation Report of proposed site is available in this bid
document for reference. The entire development is to be designed adhering to the
local body norms/ NBC 2016 along with compliance to ECBC 2017, relevant BIS Code,
Green Building Norms of 5-star GRIHA/ BEE rating and applicable guidelines for court/
office building.
1.2. The present tender is for Engineering Design, Construction and Commissioning of
Modern Court Rooms/ Office Building with space for various functional requirements
of the Hon’ble Supreme Court of India, Substation, AC plant room, DG set panel
room, Underground sump and Pump room, all Civil and E&M services, development
works on Engineering, Procurement and Construction (EPC) on turnkey basis in
accordance to the Specifications and standard laid down in the tender document. The
brief scope of work is given below, however detailed scope has been provided in this
bid document. Brief details of buildings to be constructed is as below:
a) Two Basements in both phases with built up plinth area of 12958.19 and 17876.32
sqm (approx.) in Basement as per the architectural drawings. The basement to be
designed to cater for the parking and other services provided therein and also the
upper floors to cater for circulation requirements.
b) Superstructure – The Court Rooms/ Office building is designed to accommodate
the Court Rooms/ Office requirement of Hon’ble Supreme Court of India. The
building is an integrated Court Block having G+5/4/3. The building as per the
conceptual architectural drawings is having total built-up Plinth Area of both phase
is 55723.44 sqm (approx.) in Superstructure.
c) Boundary Wall – Construction of boundary wall (after demolition of existing
boundary wall) as per drawing and detailed specification in Section ‘C’.
1.3. As per the requirement of the Hon’ble Supreme Court of India, the detailed
conceptual architectural drawings of the project have been developed to indicate
functional space requirements and attached herewith in this bid document for
reference. The contractor will be required to engage competent Consultants as per
eligibility requirement given in this bid document and shall provide more detailed
working Architectural Planning/Design, furniture layout, Landscape Planning,
Structural Design, Design of required Services, obtaining mandatory approvals from
Local Bodies/ Statutory Authorities required before and during execution of Works &
1.4. All the Architectural, Structural design/drawings prepared by the consultant appointed
by the contractor shall be scrutinized by CPWD / Hon’ble Supreme Court of India
(Client) for sufficiency of functional requirements, compliance with scope of work etc
and issue No Objection Certificate (NOC) and work shall be executed based on these
drawings. However, issue of NOC by Engineer-in-charge does not absolve the
contractor for accuracy of designs and compliance to applicable regulations/by-laws
and sufficiency of functional requirements.
1.5. The project/buildings shall be designed and constructed to meet 5-Star Rating of
GRIHA/ BEE and contractor shall also obtain the Certification of the same.
1.6. The Contractor shall obtain all service connections like Water Supply, Sewerage,
Drainage etc. from the existing internal main lines and this shall be deemed to be
included in the quoted price. However, the statutory payments or fees (if any)
payable to Government/ Local Body shall be reimbursed to the Contractor by CPWD.
1.7. Testing, commissioning of all services, fittings and fixtures, equipment’s after
obtaining local body approval as applicable and handing over.
1.8. The statutory payments or fees payable to Government/ Local Body shall be
reimbursed to the Contractor by CPWD. Similarly, for E&M works all the statutory
payments or fees payable to Government/ Local body/ Electricity Board shall be paid
by the Contractor and CPWD shall pay/reimburse them. The contractor shall obtain
written prior permission from the Engineer-in-charge before making such payments.
1.9. The Contractor shall prepare and submit all as Built Drawings of buildings & services
and other related documents both in hard copy and the soft copy after completion.
1.10. The Contractor shall obtain Occupation Certificate from local body and hand over the
completed project in habitable state from all perspective to the client department.
1.11. All works have to be executed as per detailed conceptual Architectural Drawings, User
requirements & Technical Specifications provided in the bid document, CPWD
Specifications and National Building Codes 2016, (in case of difference if any,
stringent / higher specification of the two shall be followed. In absence of CPWD
Specification, IS Codes, MoRTH Specifications, National Building Code 2016, Sound
Engineering Practices and other standard specifications suitable for modern office
building and latest technology shall be adopted as per order of precedence defined in
the contract.
1.12. The scope of works & specification given in the bid document are general but not
exhaustive i.e. does not mention all the incidental works required to be carried out for
complete execution of the work. The work shall be carried in accordance with true
intent and meaning of the specifications and the drawings taken together, regardless
of whether the same may or may not be particularly shown on the drawings and/ or
described in the specifications, provided that the same can be reasonably inferred
there from.
1.13. There may be several incidental works, which are not mentioned in the contract
document/specifications but will be necessary to complete the item in all respect. All
1.14. In case, some of descriptions are missing in the scope of work or specifications in the
bidding documents shall be executed as given in the CPWD Specifications, NBC-2016,
IS Codes or according to sound engineering practices so as to make the building
including related services fully functional. No claim what so ever may be entertained
at later stage. All cost of providing and making buildings with services, landscape and
horticulture works fully complete in all aspect unless specifically mentioned in the
contract document and making buildings with services fully functional are included in
the cost tendered for this work.
1.15. It shall be deemed that the Contractor has satisfied himself with the nature and
location of the work, general and local conditions and particularly those pertaining to
transport including restriction of movement of traffic/ vehicles etc., handling,
availability and storage of materials, availability of labour, weather conditions at site
and general ground/sub soil conditions. Agencies are expected to quote their rates
accordingly and nothing extra shall be payable for any reason/s whatsoever it may
be. CPWD shall bear no responsibility for the lack of such knowledge and also the
consequences thereof to the contractor. The information and site data shown in the
drawings and mentioned in the tender documents are furnished for general
information and guidance only. The Engineer-in-Charge in no case shall be held
responsible for the accuracy thereof or/ and deductions, interpretations or conclusions
drawn there from by the contractor and no claim shall be entertained whatsoever on
this account; if the site conditions/ information is different or otherwise incorrect. It
will be presumed that the contractor has satisfied himself for all possible
contingencies, situations, bottlenecks and acts of coordination which may be required
between the different associate agencies by the main contractor.
2.1. Contractor shall propose one of the New & Emerging Technologies contained in List 1A
of OM No. F.No.17/SE(TAS)/BMTPC/2022/105(H) dated 24.03.2022 issued by the
Directorate, CPWD, New Delhi as the construction of the building is a permanent
structure.
3.1. Site Plan and Soil Investigation Report and other site details provided herein this bid
document are indicative only and accuracy of same is not guaranteed, therefore
Contractor has to mandatorily carry out Digital Survey, Geotechnical Investigation
and Tree Survey (if any) etc. on their own including all the allied preliminary works. If
required, contractor shall also carry out other surveys, required for the execution of
the Works/ Services.
4.1. The contractor shall carry out survey, identification, numbering, taking photographs
and marking of trees on lay out plan and submission to Tree authority with other
required documents and obtain statutory approval of Tree authority for cutting/
transplantation of required nos. of trees. Any fee payable to tree authority for issue of
tree cutting permission shall be reimbursed to contractor on actual basis on
submission of original official receipt in this regard.
4.2. The Contractor shall carry out cutting/transplantation of required nos. of trees as
requirement of tree cutting permission issued by tree authority. The tree cutting/
transplantation work shall be carried out as per direction of Engineer –in Charge.
4.3. The contractor shall also carry out the compensatory plantation in lieu of felled trees
as per requirement of tree authority and maintain these trees/plants at the
location/site approved by tree authority until completion and handing over of the
project to the client in all respects.
5.1. Scope of work includes Demolition and dismantling of buildings/ structure, in the
project site area as per requirement including shifting of utility lines e.g. Electrical
cables, Sewerage/ Drainage System, water supply lines, OFC/ Data cables, Pressured
GAS supply lines, HVAC, Sub Station, Firefighting, UPS, DG Set etc. with permission
and satisfaction of the concerned authorities owning these/such utilities. Quoted
price shall include cost of required demolition and shifting of utilities etc.
6.1. The contractor shall engage a Consultancy Firm which shall provide Comprehensive
Consultancy Services in Project Conceptualization covering space utilization,
functional relations, preparation of Master Plan including obtaining its Statutory and
Local Bodies Approvals, Detailed Architectural Drawings, Detailed Structural Analysis
& Design, Designing and Detailing of all Services, their Drawings, External
Development Works, Landscaping, etc. Consultant shall prepare and supply all the
coordinated, good for construction drawings duly proof checked and approved. The
Consultant shall be associated till completion of the project and obtain completion
certificate from the concerned local body.
6.2. Preparation of more detailed working architectural drawings as per applicable Bye-
laws and Controls / General Guidelines of Local Bodies /Any other applicable Statutory
Regulations and as per CPWD Specifications / BIS Codes / NBC 2016 /ECBC 2017 /
Green Building Norms of 5-Star GRIHA/ BEE rating Specifications contained in this Bid
document.
6.3. A 3D Physical model of the building complex in 1:150 or other suitable scale is
to be planned and prepared by the contractor within 45 days from award of work and
this model would be displayed at site office. This model shall become the property of
Government of India. The agency shall prepare and submit additional 3D Physical
Model of the Layout and Buildings on suitable scale as per requirement of local
bodies/Engineer-in-charge. Rates quoted by the contractor are inclusive of such
models.
6.6. Planning & designing of all Internal Services like Internal Water Supply, Sanitary
Installations and drainage, Development works like UG Sumps, Terrace water Tanks,
Rain Water Harvesting System, Internal Roads, Pathways, Parking facilities, Filtered
and Unfiltered Water Supply Lines, Storm Water Drains, External Sewerage System,
Service Trenches, Internal & External Electrical Installations, Fire Alarm System,
Firefighting system, Lifts, Sub-station, DG sets, UPS, HAVC , VRV/VRF Type Air
Conditioning System, Solar water Heating System, CCTV, IBMS, LAN, IP based
EPABX System, Audio Visual System, Access Control System, EV Charging Stations
etc. including other required Services and their integration complete for the Buildings
planned to include all its fittings, fixtures, testing etc. complete The necessary
arrangements are to be provided for supply of water through dual pipe system i.e.
recycled water duly treated pumped through underground tanks to overhead tanks
and piped to flushing as directed by the Engineer-in-charge. Municipal water obtained
from peripheral pipe lines would be stored in separate underground reservoirs and
pumped and piped to utility area areas.
6.7. Planning & designing of all external services like Water Supply, Rain Water Harvesting
Systems, System for Recycling of Waste Water, Sewerage, Drainage System, Roads,
Paths and all connected Sub-structures and Superstructures within the premises, as
per bye-laws and norms of the local bodies including making connections with the
peripheral services after getting the services design approved from the Local Bodies /
Central Ground Water Authority. Department’s role shall be limited only to sign the
application / drawings / documents for submission to the local bodies in the capacity
of the owner for approval. In case of Water Supply, Sewerage and Drainage, the cost
of getting the scheme approved from service provider is included in the Scope of
Work. The cost of connection of water supply lines/sewer lines from peripheral
connection point/outfall sewer shall also be borne by the agency apart from internal
and external water supply/sewerage lines to be laid to make the system of water
supply and sewerage functional/complete. However, infrastructure charges, if levied
by the service provider towards cost of laying of their peripheral services shall only be
reimbursed by CPWD on production of relevant documents by the EPC contractor to

15.3. Four Nos. New Inspection Vehicles i.e. One No. (Category-A) Toyota Crysta /
Mahindra XUV700 & Three Nos. (Category-B) Maruti Suzuki Ciaz shall be provided by
the contractor during period starting from within one month of date of start of work
till 3 months after actual date of completion of construction work, which shall be
solely at disposal and use of departmental officers and shall be parked at designated
place directed by Officer-in-charge of vehicle. Generally, the duty hours of the drivers
shall be from 09.00 AM till 07.00PM on all working days however occasionally driver
services may be required beyond normal duty hours or on holidays as directed by
Officer-in-charge and average monthly running of vehicle shall be approximately 2400
km per month. The cost of fuel, Fast Tag Recharge, Repair & Maintenance and Traffic
challans etc. for the vehicle and salary including overtime of the driver(s) engaged to
drive the vehicle(s) shall be borne by the contractor. In case of non-providing of the
vehicle(s) as mentioned above, a recovery of Rs. 3000 for Category-A & Rs.2000 for
category-B per day/per vehicle will be made from running and/or final bills of the
work.
1.1. The contractor shall engage a Firm / Consultant (whether titled as an Architectural
firm or Engineering firm) which shall provide comprehensive consultancy services in
Project Conceptualization covering space utilization, functional relations, preparation
of master plan including obtaining its statutory and local bodies approval, detailed
architectural drawings, detailed structural analysis, designing and detailing of all
services, their drawings & approval, external development works, landscaping, etc.
Consultant shall prepare and supply all the coordinated, good for construction

completion of the project and obtain completion certificate from the concerned local
body.
1.2. The contractor shall, within 15 days of award of work, submit proposal for approval to
Engineer-in-charge for engagement of consultant having experience of comprehensive
planning & design who comply with eligibility criteria/conditions laid down in this bid
document.
1.4. It shall be the obligation of consultant to get the structural design done through an
Engineer/consultant who has past experience of structural designing of office
buildings of comparable size and complexity in Earthquake Zone IV as per latest
Indian Standards.
2.1 (a) The tenderer(s) must associate reputed eligible Consultant for Architectural &
Engineering Planning / Design, getting Local Body Approvals and Statutory
clearances etc. The contractor shall submit proposal of (minimum three) reputed
firm / consultant (whether titled as an architectural firm or engineering firm) who

(c) All the Consultant proposed by the agency should given the presentation of the their
eligible work to the committee consisting of CPWD and representative of Supreme
Court of India representative and decision of committee on approval of consultant
shall be binding on the contractor.
2.2 The Consultant/Sub-consultant (s) should have sufficient number of employees for the
proper execution of the project. The Structural Consultant shall be equipped with

2.4 Eligible works required to satisfy conditions of Paras aforesaid, should have been
executed under valid contract/work order from client/main executing agency
appointed by client. Client Certificate (issued against work done by either the
firm/consultant or main executing agency appointed by client) in support of having
satisfactorily completed the works along with desired details shall be submitted with
proposal. In case Non-government works/ work order from main executing agency
are submitted in support of eligibility, certified copy of the contract documents and
Tax Deducted at Source (TDS) certificates shall also be submitted and the TDS
amount shall tally with the actual amount of work done.
3.1. General
3.1.1. The consultant shall provide Comprehensive Consultancy Services for Planning &
Design of the Building and Services, Landscaping & Horticulture as per scope of work
under the contract. Scope of the comprehensive consultancy services is broadly
described hereinafter. However, it should be clearly understood that the same is only
indicative, and the Consultant shall be required to perform any other services which
may be required whether expressly mentioned hereinafter in this contract document
of this work up to the entire project requirement and satisfaction of the client. The
services to be provided by the Consultant shall include but not be limited to the
following:
3.1.2. The conceptual drawings of the buildings with this document have been prepared by
the CPWD in house and are for guidance only. The consultant has to develop the
same in detail and as per the functional requirement and local body norms.
3.1.3. The consultant appointed by contractor shall prepare and supply all detailed
architectural drawings, structural drawings, design and detailing of all services, their
drawings, external development works, landscaping, etc. as well as shop drawings
w.r.t the minimum specifications and standards, fittings and fixtures prescribed in the
tender document and the local by laws.
3.1.4. The consultant appointed by the contractor under the conditions of bid document shall
have constant and regular interaction with the CPWD client or both for formulating the
design philosophy and parameters, designs/ drawings and specifications etc. and shall
be involved for the entire duration of the project till its completion and handing over.
3.1.5. The contractor shall get the conceptual approval of the Department /client or both
through presentations, physical models, computer walk-through etc. Comments and
suggestions or alternate proposal of the department and/or client and his
representatives shall be evaluated and suitably incorporated till the concept design is
accepted and frozen.
3.1.7. The officers of CPWD shall be responsible for broad oversight of functional, aesthetics
for engineering and architectural consideration only. The agency shall not be absolved
from his responsibility for functional and structural soundness of the buildings just
because the NOC issued to drawings by CPWD.
3.1.8. All drawings shall be submitted at least one month in advance to the Engineer-in-
charge for issue of No Objection Certificate and releasing them for execution.
3.2.1. Carry out topographical survey and the survey of all existing building/ structures
services and other constraints existing in and around the site.
3.2.2. Carry out soil investigation of the site to establish the soil characteristics required for
the foundation design of multi-storey buildings. Types of investigation/ test and their
qualities shall be get approved from Engineer-in-Charge. Soil investigation agency
should be experienced, specialized and should be got approved from Engineer-in-
charge.
3.2.3. The contractor /consultant shall also get ascertained the liquefaction potential of soil
to required depths using modern methodology e.g. Spectral Analysis of Surface
Waves (SASW) test or any other method and combination of tests approved by
Engineer-in-charge and suggest remedial measures and account for same while
suggesting the foundation system and suggesting bearing capacity/load carrying
capacity.
3.2.4. The soil report shall be got vetted/proof checked from the IIT Delhi or IIT Roorkee or
any other IIT as per the contract document or as approved by Engineer-in-charge.
3.3.1. Preparation and submission of the revised Master Plan / Layout for local body
approvals and incorporating changes, if any, suggested by them and re- submitting
the same.
3.4.1. Conceptual designs already provided in this bid document. The conceptual designs
shall serve as base line and the consultant shall further develop and validate them as
per scope of work and client requirements. Architectural Design should cover the
following:
Water and solid waste management with waste water recycling, water
conservation and rain water harvesting.
All the spaces in the building provided shall be adequately ventilated for light
and air.
Suitable escapes for fire shall be planned as per the requirement specified in
NBC 2016 and other applicable standard codes of practice.
The setbacks and height of the building shall conform to all regulatory authority
rules.
Premium quality materials shall be provided for walls, floors, windows, doors etc
in tune with the industry standards of similar buildings.
The façade of the building shall be appealing, by judicially mixing the use of
energy efficient glass, cladding materials, wall appropriate to the use of the
building. The ratio of glass to wall shall vary depending the direction and as
required for 5 STAR GRIHA/ BEE rating system.
Service routing and ducts shall be planned for easy access, maintenance and
scalability.
Green building materials shall be used as far as possible for obtaining desired
certification from proposed Green rating system.
Sufficient space for parking of vehicles as per the norms shall be provided
Vertical circulation shall be well planned to provide quick access to upper floors
by suitable location of stairs and bank of elevators.
3.4.2. Submission of the final concept design along with models, photographs, 3D-walk
through and as per the requirement etc. The cost of such models, walk through,
photographs, etc. shall be borne by the contractor.
3.5.2. Prepare and issue “Good for construction” drawings. Drawings shall be adequately
detailed and shall contain enough information to enable construction, full
measurement, pricing and production of bill for payment. The working drawing shall

3.5.5. Integration of design with the existing landscape including water bodies and suggest

3.6.3. The Building shall be analysed as a ‘Space Frame’. The building shall be modelled
using structural engineering software package ETABS/ STRAP/ STAAD or any other
standard proven software. SI units should be followed for entire analysis and design.
The modelled space frame should be analysed for Dead Loads (DL), Live Loads (LL),
Wind Loads (WL), Earthquake Loads (EQ), Temperature load stresses and their
combinations as per latest IS: 1893-2016 (part-1) and IS: 13920(2016), IS 800-2007
and other applicable BIS codes revised up to date. The Building should also be checked
for storey drift. All supports (foundations) of the Building columns and shear walls
shall be considered as fixed joints for analysis. Effective length of columns shall be
considered as per the standard codes of practice. This structure should be designed
and detailed as per Indian codes of practice. All disaster managements practices as
specified in latest NBC to be followed.
Column, walls, i/c diaphragm wall and beam layout plans i/c Shear Walls
Staircases, ramps, lifts shafts and machine room details, rain water harvesting

All other details and sketches required for proper execution of the works.

The consultant shall also submit the structural design / details (input / output) by

3.7.1. The services to be provided by Consultant shall include planning and design of all
Services (Civil / E&M) involved in this work and as per scope of work.
3.8.1. Design of Public Health & Engineering services taking into account various
topographical, meteorological, Hydrological etc. reports, identify the source and
quality of water, conduct survey of existing water supply system, Sewerage system,
Drainage system, other site development works etc. for planning of services. All the
design and drawings should be well coordinated with Architecture, structure and other
services drawings.
Fire Fighting & Fire Suppression System with peripheral grid around each building
connected with fire main grid.
Dual plumbing system i/c untreated water supply system from STP for horticultural
operations.
3.9.1. The main contractor shall associate with a consultancy firm headed by a consultant
who should minimum 5 years of experience in the field of BIM modelling services.
Further, the firm should possess experience of having satisfactorily competed, as
mentioned below, during the last 7 (seven) years ending previous day of last date of
submission of bids.
“The BIM modelling services of one major Building, having built-up plinth area not
less than 69246.36 sqm (OR) two major Buildings having built-up plinth area not less
than 51934.77 sqm (OR) three major Buildings having built-up plinth area not less
than 34623.18 sqm”
(i) 3D BIM model for entire building shall be developed before taking up execution. It will
be developed from advanced detailed drawings on Revit / ArchCad software. Co-
ordinated construction drawings shall be issued from 3D BIM model for architectural,
structural, Public Health & all the internal and external E&M services in the building
before start of execution of work at site. Consultant should prepare BIM Model to
combine all services of the building to see if there are any clashes and to remove all
those clashes and then issue good for construction drawings.
(ii) The EPC Contractor shall engage a specialized BIM Consultant duly approved by
Engineer- in-Charge for Development of BIM Model to successfully facilitate the
generation of as planned design drawings, construction documents and specifications,
coordination, scheduling, phasing of the work and handover processes.
(iii) The overall design work (Structural, Architectural, Mechanical, Electrical, Plumbing
and other supporting infrastructure facilities) of the proposed buildings shall be done
by the specialized agency. Specialized agency is expected to seamlessly take up the
BIM model in line with the design work to a LOD 350/400 level to be utilized in
construction phase and LOD 500 for the Operations and Maintenance Phase.
(iv)The BIM Process shall be a complementary but integral part of project delivery and
shall be used for:
c. Tracking of quantities per area for procurement, cost control and progress
monitoring purposes.
d. Enabling all stake holders to view and track the project throughout construction
and close out and prepare the basis for later Facility Maintenance stage.
e. The contractor shall appoint BIM expert(s) to develop and oversee the BIM
Implementation Plan with the CPWD team and the other authorized by the CPWD
for setting up the appropriate templates and project boundaries, standards etc.
f. The EPC Contractor shall provide continued support during project implementation
period through sharing of interactive walk through’s, 3D cut sections, 2D
coordinated drawings, display of interplay of various MEP services to facilitate and
ease the construction and erection work at site and assist in project progress,
monitoring & control etc.
g. The EPC Contractor shall prepare & submit, on completion of construction work, ‘As
built'3DBIMmodelto be given as softcopy &‘as-built’ drawings extracted from ‘As-
built’ 3D BIM model, to Engineer-in-Charge of CPWD for maintenance, repair &
modification purposes. 3D BIM and 4D BIM Modelling work, coordination & clash
detection, BOQ extraction of construction materials, updating models during
construction phase, preparation & updating go base line schedule for project
progress, monitoring, & control purposes, 4D BIM simulation & development of “As
Built Model and “As Built Drawings”.
3.10.1. The contractor / consultant shall take all necessary Statutory Approval/ Clearance/
NOC/ Permission of ‘Completion Plan’ from all Local Bodies/Statutory
Bodies/Authorities as required for occupation of the buildings after completion of
construction and preparation of all submission drawings (any numbers)/ materials and
models for these approvals at his own cost.
3.10.2. Any other Approval/ Clearance/ NOC/ Permission etc. not expressly mentioned in
this contract but required before start/during construction and after completion for
occupation of building complex shall be obtained by the contract.
3.10.3. All statutory payments required for these approvals from local authorities shall be
made by the Engineer-in-charge. For saving of time if the payment is required to be
made urgently the contractor/consultant should make the payment and the amount
will be reimbursed by the department after production of original vouchers & receipts.
3.11.1. All the documents/drawings, designs, reports and any other details envisaged under
this agreement shall be supplied in six copies. All drawings as required for submission
to all the local bodies and other authorities shall be submitted as per the requirement
of local body. All the drawings for the comments, discussion and approval of employer
shall be submitted in triplicate. Six copies of all the final drawings shall be submitted
to the Engineer-in-Charge along with one reproducible in A-1 or large size along with
a soft copy in DVD. If there is any revision in any drawing/document for any reason,
six copies of drawing/document shall be re-issued along with soft copy in CD without
any extra charges. All these drawings will become the property of the Engineer-in-
Charge. The Engineer-in-Charge may use these drawings in part or full in any other
work without any notice to the consultant and without any financial claim of the
consultant.
3.11.2. The drawings cannot be issued to any other person, firm or authority or used by the
Consultant for any other project. No copies of any drawings or documents shall be
issued to anyone except the Engineer-in-Charge and / or his authorized
representative.
3.12.1. Ensure the preparation of AS-BUILT drawings and record all approved deviations and
changes in drawings.
3.13. Provide any other services not explicitly mentioned but reasonably required for
project development.

Whereas, This Memorandum of Understanding has been entered into for assigning
responsibility of execution of ………………. (mention category) component of Specialised
Civil/ E&M Work forming part of the above work to the Associate Specialised Civil/ E&M
Contractor by the Main Contractor.
1. Both the parties have gone through and understood the various Terms & Conditions and
Clauses of the Contract for the work awarded to the Main Contractor and willingly agree
to abide by them.
2. The ‘Associate Specialised Civil/ E&M Contractor’ will execute ………………. (mention
category) Component of Specialised Civil/ E&M Work in the wholesome manner as per
Terms & Conditions of the Contract. However, both Parties shall be jointly and
severally responsible for the execution of said Component of work as per the Contract.
3. It is understood that payment for ………………. (mention category) component of
Specialised Civil/ E&M Work even though executed by the Associate Contractor shall be
done by the Department (CPWD) to the Main Contractor as per Terms & Condition of the
Contract. The Parties have entered into separate agreement on Terms & Conditions for
payment to be made by the Main contractor to the Associate Contractor for the work
done by them. The main Contractor shall promptly make payment to the Associate
Contractor as per agreed Terms & Condition between them. In the event of failure to
make due payments to the Associate Contractor by Main Contractor, the Department
(CPWD) may make such payments directly to the Associated Contractor after deducting
the same from Bills payable to the Main Contractor.
4. In case of any dispute between Parties, either of them may go for mediation by the
Engineer-in-charge. In the event of disagreement with decision of Engineer-in-Charge,
either of the Parties may appeal against the mediation to the SE-cum-PD or successor
