HISTORICAL DEVELOPMENT

Talking about Spanish Legal Psychology is talking about the Present. Its past is brief, but some
historical moments must be mentioned.

The first historical generations appear with the Spanish Health Law called “Forensic
Practitioners” and which is developed and reorganized by the Decree-Law of 1891 creating
three sections:

1. Medicine and Surgery Section.

2. Toxicology and Psychology Section.

3. Mental Medicine and Anthropology Section

DEFINITION

Legal Psychology is an area of specialized psychological work and research whose object is the
study of the behavior of legal actors in the field of Law, Law and Justice.

This area is recognized by national and international Associations and Organizations of Legal
Psychology.

FUNCTIONS

1. Evaluation and diagnosis

In relation to the psychological conditions of legal actors.

2. ADVICE

Guide and/or advise judicial bodies as an expert on issues specific to their discipline.
3. INTERVENTION

Design and implementation of Programs for the prevention, treatment, rehabilitation and
integration of legal actors either in the community or in the penitentiary environment, both
individually and collectively.

4. TRAINING AND EDUCATION

Train and/or select professionals from the legal system (judges and prosecutors, police, lawyers,
prison staff, etc.)

5. PREVENTION CAMPAIGNS

Procedures, Techniques and Instruments

The Legal Psychologist uses common psychological evaluation techniques in his work, striving
to develop evaluation instruments appropriate to the context of application.

SCOPE OF ACTION

1. PSYCHOLOGY APPLIED TO COURTS

It refers to those activities that the Psychologist can carry out in the “FORUM”:

Legal Psychology and Minors.

Currently, the Juvenile Courts have psychologists who work in direct collaboration with judges
and prosecutors in multi-professional teams to resolve illegal conduct carried out by minors.
Their functions in the Juvenile Courts are:

• Issue technical reports on the specialty, requested by the Judge or Prosecutor.


• Advise the measures that should be applied.
• Monitoring of interventions.

Psychology Applied to Family Law.

The Family Court psychologist must not only evaluate how the separation affects the children,
but can also design programs that aim to make positive difficult situations that minors will
encounter.

Their functions in the Family Courts are:

• Issue technical reports of the specialty requested by the Court in the break-up processes
of couples with children (separation, divorce, annulment and modification incidents).

• Issue specialty reports in other situations posed by family law: guardianships, foster
care, adoptions, authorizations to marry, etc.
• Monitoring of cases.
• Advice to judges and prosecutors

Psychology Applied to Civil, Labor and Criminal Law.

The activity of the Psychologist in relation to Civil Law focuses on advice and expertise on
various legal constructs such as civil capacity in decision-making (contracts, guardianship wills,
sex change, sterilization of disabled people, etc.).

Psychology applied to Administrative Litigation Law

Its scope of action is the preparation of reports, both on non-contributory, controversial


disabilities, as well as on assessment and qualification systems in personnel selection or
promotion processes carried out by public administrations.

Psychology applied to Criminal Law

Criminal proceedings that will serve as advice to Judges and Courts, to determine the
circumstances that may modify criminal responsibility, moral damage, psychological
consequences, etc.
2. PENITENTIARY PSYCHOLOGY

The General Organic Penitentiary Law (LOGP) gives special importance to Psychology to the
point that the Penitentiary Regulation details in its Article 240 that the treatment will be
inspired by the following principles:

3. JUDICIAL PSYCHOLOGY (TESTIMONY, JURY)

In this area of Legal Psychology we could include the Psychology of Testimony and the
Psychology of the Jury, which are areas of growing interest, Psychology of Testimony, which
consists of the set of knowledge based on research results from the fields of Experimental and
Social Psychology. .

4. POLICE AND ARMED FORCES PSYCHOLOGY

In Spain there are two types of police, one at the State level such as the Civil Guard and the
Police with the capacity to act throughout the State Territory and other Autonomous Police.

Police, other more complex tasks are being incorporated such as specialized training of middle
managers and officers, as well as (minor units, crimes against sexuality, etc.). All of them have

5. VICTIMOLOGY

Attention to Victims is one of the areas of greatest interest and indisputable development in
Spain, especially in especially significant matters such as sexual abuse, mistreatment, etc.

Their functions are:

• Care, treatment and monitoring of victims in their different degrees.


• Study, planning and prevention in risk groups, and informative campaigns for the
general population.

6. MEDIATION

Mediation is an alternative to the traditional way of going to court in search of a solution. the
mediator, who tries to help them reach consensual agreements that allow them a peaceful
solution to the conflict situation.

Functions of the Mediator:


• Prepare an appropriate context so that the parties can communicate.
• Design the mediation process.
• Offer the parties tools that allow them to manage the conflict.

The Legal Psychologist needs specialized training.

CRITICAL ANALYSIS.

As evidenced through the development of the work, it is not about criticizing current
performance because it is understandable that professionals spend years in a position and
gain valuable experience, which makes them worthy of handling cases and even many
are handled properly. The problem is that you cannot live oblivious to this situation
forever; it is necessary to open your eyes and realize that with adequate training,
measures truly aimed at solving the problems that plague the population can be put into
practice. It is even understood that the lack of professionals in the area is due, on the one
hand, to the fact that in the country (the government, the relevant authorities).
