Summary of DENR DAO 2003-30 Sections 2.3
Monitoring, Validation and Evaluation/Audit Procedures
DENR-DAO 2003-30 ensures that all projects that granted with ECC shall
comply with the terms and conditions written. The revised procedural manual
provides a comprehensive information for the EMB to monitor, validate and evaluate
that all information given by the project proponent were true. DAO 2003- 30 Section
2.3 emphasizes that the primary purpose of monitoring, validation and
evaluation/audit is to ensure there is a good implementation of sound environmental
management (written in the Project Proponent’s Environmental Management Plan)
within a company/corporation and its areas of operation. Thus, implementing
effective environmental measures on prevention or mitigation of actual project
impacts. Also, continuous update of the EMP for sustained responsiveness to project
operations and
project impacts.
Proponents issued with ECCs must responsibly monitor their projects. The
detailed report on compliance to environmental standards specific to environmental
laws shall be submitted through the Self-Monitoring Report SMR) as required on a
quarterly basis to the concerned EMB Regional Office. The semi-annual CMRs shall
be submitted on the second (first semi-annual CMR on or before July 15) and fourth
quarter (second semi-annual CMR on or before January 15) SMRs. Projects that
have granted Certificate of Non-Coverage need not to submit CMR. Documents
included for the preparation of CMR includes ECC, Environmental Management Plan
(EMP) and records of construction and operation, etc., Environmental Monitoring
Plan and Records, Social Developmment Plan and IEC Programs. Thus, the
proponent may commission third party experts to undertake monitoring on its behalf.
Monitoring and validation of the CMRs were done by the Multi-partite
Monitoring Team (MMT). The EMB with the coordination of the proponent will
organized the MMT that are composed of the representative from an academe,
PENRO/MENRO, Religious Organization, Youth Organization, People’s
Organization, LGU, NGOs and other independent identified parties where the DENR-
EMB Regional Director will serve as the chairman. A MOA is agreed and signed with
the formation of the MMT. Services rendered by the MMT is then funded through an
Environmental Guarantee Fund (EMF). The Environmental Monitoring Fund (EMF) is
a fund that a proponent shall commit to establish in support of the activities of the
MMT for the compliance monitoring. The EMF will be established as agreed upon
and specified in the MOA between and among DENR-EMB RO, Proponent, LGU
and MMT representatives. An EMF/MMT is required for all projects and undertaking
classified as Category A. In selected cases, an EMF/MMT may be required for a
project and undertaking classified as Category B. The EMF shall be exclusively
utilized to cover all costs attendant to the operation of the MMT. It shall specifically
be used to defray MMT expenses such as cost of transportation, board and lodging,
MMT meetings, rental of equipment, etc.
When project is projected to pose risk in the adjacent environment and the
community an Environmental Guarantee Fund (EGF) shall be established. It shall be
used to answer for damage to life, property, and the environment caused by such
risk, or requiring rehabilitation or restoration measures. It shall also be used to
implement damage prevention measures, environmental education, scientific or
research studies, IEC, training. The MMT EC, acting as an EGF Committee, shall
manage the fund. In mining projects, the MGB shall be the agency that has primary
jurisdiction over the issues/aspects covered by the EGF including but not limited to
the responsibility of ensuring that proponent/s undertake rehabilitation of abandoned
mining sites as well as the prompt payment of claims by affected stakeholders.
However, no specified amount as to how much is cost of the potential impacts
that may arise as a result of changes in the use of natural and environmental
resources. In some large-scale projects like power projects, an estimate of the value
of environmental impacts is already included in the EIA costs and benefits. In
general, the EGF shall have two (2) major components: 1. The trust fund where it
will be used to compensate aggrieved parties for any damages to life or property,
undertake community-based environmental programs, conduct environmental
research aimed at strengthening measures to prevent environmental damage and to
finance restoration and rehabilitation of environmental quality caused by the project;
2. Environmental Guarantee Cash Fund that will be used for immediate
rehabilitation and compensation of affected communities in case of damage or
accidents. It shall also be used to cover costs of the operationalization of the EGF
Committee.
