Unit Summary
This unit describes the skills and knowledge required to lead a business operation that covers the steps required to
develop and implement business plans.
The unit applies to individuals who are running an organisation or who take a senior role in determining the
effective functioning and success of the organisation. These individuals may oversee the work of a number of
teams and other managers.
No licensing, legislative or certification requirements apply to this unit at the time of publication.

9 What legislation might you need to consider when developing a business plan?
We must consider following legislation while creating a business plan:
Anti-discrimination laws: Australia has four national anti-discrimination statutes which
protect against unjust treatment due to unforeseen conditions. These include disability,
age, gender, race, and sexual orientation.
Fair Work Act of 2009: Fair Work Act is one of the primary state statutes governing
hiring practices. It outlines the terms and conditions of work and the rights and
responsibilities that apply to employers, employees, and labor unions.
Privacy Act 1988: The Privacy Act 1988, sometimes known as the Privacy Act, is the
primary Australian law governing the processing of personal data about individuals.
This covers the collection, use, storage, and disclosure of personal data by the federal
government's commercial and public sectors.
Competition and Consumer Act 2010:
The two basic goals of the law are to ensure that businesses treat customers fairly and to
enable fair competition among all firms in an open market. Covered topics include
price-fixing, unethical behavior, anti-competitive action, and advertising.1
Work Health and Safety Act 2011: WHS Act aims to maintain workplace and worker
health by giving employees and everyone else the highest level of protection against
dangers and risks.2

encourage staff to use the staff complaint system by offering incentives. Effective managers
are better at spotting and resolving underperformance problems. Underperformance-related
problems must be resolved as soon as possible. Not all underperformance issues require a
specific process. Examine additional options, such as using continual feedback, to improve
performance.

This project requires you to complete the assessment tasks in a workplace or simulated environment where
the conditions are typical of those in a working environment in an industry with which you are familiar.
The Project requires the student to demonstrate evidence of their ability to:
Develop a business plan according to the requirements of your organisation, in consultation with
relevant stakeholders.
Communicate the business plan to relevant stakeholders, confirming availability of skilled
resources to implement the business plan.
Implement and monitor the business plan prepared including testing the Performance
Measurement System (PMS) defined in the business plan.
Review the business performance against planned objectives in the business plan, and analyse
the strengths and weaknesses of the business plan.
Report to relevant stakeholders the review of the business plan
Each task comes with a set of instructions. You are to follow and perform these instructions while being
supervised by the assessor and/or submit any required documentation.
Before starting this assessment, your assessor will discuss with you these tasks, including instructions and
guidance for satisfactorily completing them.
You will be required to work with at least TWO (2) other people to complete this assessment task. Proof of
consultation with be required.
Scenario
You have been hired by two business partners (fellow students, family or friends) to assist in the
establishment of a new business, and specifically to develop the Business Plan.
The partners have decided to open a new business in a large local shopping centre. The business will be
unique to the shopping centre and the local area as it will sell women’s, men’s and children’s clothing made
only from sustainable materials including hemp, organic cotton, wool, silk and bamboo.
The shopping centre has a large BigW store, two specialist women’s clothing stores and one specialist men’s
clothing store. There is also a Rivers clothing store that sells clothing to for both women and men.
The shopping centre is located in Melbourne’s South East where the population demographic shows large
country of birth diversity and 45% of workers are employed in manufacturing, warehousing, hospitality and
cleaning services.
TASK 1: Prepare a Business Assessment report (This is NOT your business plan)
This task is to be completed with at least two other people playing the roles of the two business
partners. Proof of participation will be required. If your business owners are fellow students also
completing this unit, ORIGINAL work form each student is required. Identical, or near identical
assessments will NOT be assessed and will be returned for re-submission.

Establishing a business is an exciting undertaking that needs to be carefully planned and carried out. This report
outlines the objectives and demands of the company, assesses the needs and expectations of possible clients, identifies
competitors, sets performance goals, and ascertains the necessary resources in terms of funds, personnel, and tangible
assets. It also addresses the legal framework that affects the business.
Legislation impacting the business
The Competition and Consumer Act of 2010 (CCA) governs most market divisions, including those
involving suppliers, wholesalers, retailers, and consumers. This Act seeks to foster fair trade, competition,
and consumer protection to improve well-being in Australia.3 It include price-fixing, unethical behavior, anti-
competitive action, and advertising.
Needs, wants, and expectations of potential customers
Potential customers' wants and requirements include products for the garden, pets, and health and beauty.
The factors that can affect client loyalty, which is essential to any business's success, include customer
satisfaction, service quality, customer experience, and customer relationship management. 4 Happy

In summary, when launching a new business, thorough planning and consideration of several important factors are
required. We should promote fair trade and adhere to the Competition and Consumer Act of 2010 to maintain
legal compliance. We should also understand the customers' wants to build loyalty. Well-defined business needs and
objectives serve as the foundation for the company's strategy, and competitive awareness facilitates strategic
positioning. The management should set definite performance targets for the first year and secure the required funding,
