BNS VIS-À-VIS IPC (A COMPARISON)

Bharatiya Nyaya Sanhita (BNS) came into force from 1st July 2024. BNS replaced the Indian
Penal Code (IPC), reducing the number of sections from 511 to 358 and adding 21 new
offences, including hate crimes and mob lynching. It also introduces offences like terrorism,
organized crime, and hate speech and redefines sedition as acts endangering national integrity
(treason). Following are the key changes in BNS:

KEY CHANGES BETWEEN INDIAN PENAL CODE (IPC) AND BHARATIYA NYAYA
SANHITA (BNS)-

Sexual intercourse by employing deceitful means

BEFORE (IPC)

No provision regarding Sexual intercourse by employing deceitful means, etc this in IPC.

AFTER (BNS)

New Provision of Section 69 added in BNS that penalizes Sexual intercourse by employing
deceitful means, etc, which shall be punishable with imprisonment for a term which may
extend to 10 years and shall also be liable to fine.

Mob Lynching

BEFORE (IPC)

No provision regarding Mob Lynching in IPC.

AFTER (BNS)

Section 103(2) of BNS talks specifically about the punishment for murder on grounds of
race, caste, or community by a group of persons (Mob lynching), which is punishable with
death or with life imprisonment, and shall also be liable to fine.

Causing Death Due to Negligence

BEFORE (IPC)

Punishment for causing death due to negligence was imprisonment of maximum 2 years as
per section 304A.

AFTER (BNS)

Increased Punishment for causing death due to negligence u/s 106 (1) from a maximum of
2 years to 5 years.

Increased punishment for causing death in hit-and-run cases from a maximum of 2 years
to 10 years u/s 106(2).

Medical Negligence under section 106 (1) by a registered medical Practitioner shall be
punishable with imprisonment for a term which may extend to 2 years, and shall also be
liable to fine.

Organised Crime

BEFORE (IPC)

No provision regarding Organised Crime in IPC.

AFTER (BNS)

Section 111 talks in detail about a new offense of Organised Crime, where the offender
engages in any continuing unlawful activity which is a cognizable offence punishable with
imprisonment of three years or more and its punishment as per section 111, depending upon
the intensity of the crime committed.
New definition of ‘Organised Crime,’ ‘Economic Offense,’ and ‘Organised Crime Syndicate,’
given u/s 111 of BNS.

Section 112 defines the term ‘Petty Organised Crime’ along with the meaning and scope of
terms such as- Snatching, Theft, and Cheating.

Terrorism and Terrorist Act

BEFORE (IPC)

No provision regarding Terrorist Act in IPC.

AFTER (BNS)

Section 113 discusses Terrorist Act in detail and lays down the kinds of crime that may be
committed which are punishable with Death, Life imprisonment, or imprisonment of a term
not less than 5 years, depending on the intensity of the crime.

Sedition and Treason

BEFORE (IPC)

Section 124A of the IPC talked about the offense of Sedition.

AFTER (BNS)

The offense of Sedition is replaced by Treason without using any of the term u/s 150 and
152 of BNS.

Possession of Fake Currency Notes

BEFORE (IPC)

Section 242 of IPC regarding possession of Fake Currency Notes is amended.

AFTER (BNS)

Section 180 of BNS states that mere possession of fake notes and coins from a lawful
source, shall not constitute an offence under this section.

‘Community Service’ as a Punishment

BEFORE (IPC)

Section 53 of the IPC provided for 5 types of punishments and Community Service was not
among those punishments

AFTER (BNS)

‘Community Service’ introduced as a sixth kind of punishment u/s 4(f) of BNS. Punishment
introduced for the first time for petty offences which are as follows-

 S. 202 - Public servant unlawfully engaging in trade;


 S. 209 - Non-appearance in response to proclaimation u/s 84 of BNSS, 2023;
 S. 226 - Attempt to commit suicide to compel or restrain exercise of lawful power;
 S. 303 (2) - Where in case of theft, the value of stolen property is less than 5000, the
person is a first-time convict, and the stolen property is restored.
 S. 355 - Misconduct in public by a drunken person.
 S. 356 - Defamation charges in particular cases.

Theft of Intangible Items

BEFORE (IPC)

Theft was limited to tangible assets in IPC.

AFTER (BNS)

Scope of offence of ‘Theft’ expanded to cover theft of intangible items such as Data Theft
and Identity Theft.

Snatching

BEFORE (IPC)

No provision regarding Snatching in IPC.

AFTER (BNS)

New offense of ‘Snatching’ introduced u/s 304 of BNS. However the difference is maintained
between section 112 and 304.

Unnatural Offences

BEFORE (IPC)

Section 377 of IPC- Unnatural Offences i.e., Carnal intercourse against the order of nature
with any man, woman, or animal, shall be punishable with life imprisonment or a term which
may extend to 10 years, and shall also be liable to fine.

AFTER (BNS)

Section 377 regarding Unnatural Offences has been removed from the new act and is no
longer described as an offence in the new law.
