AN ORDINANCE PROHIBITING ANY ILLEGAL STRUCTURES AND
OBSTRUCTIONS ON PUBLIC ROADS AND OTHER SIMILAR PUBLIC PLACES
WITHIN THE TERRITORIAL JURISDICTION OF BARANGAY _______________ OF
THE MUNICIPALITY OF __________, PROVINCE OF ISABELA
WHEREAS, the clearing of roads aims to remove obstructions and illegal
obstructions that could help motorists to drive better and for pedestrian to find safe
areas to walk on. Further, by reclaiming the streets, alleys and walkways, pedestrian will
be encouraged to walk thereby promoting mobility and a healthy lifestyle. Conducting
road clearing operations, establishment/placing street signages and street and make
Local Government Units (LGUs) vibrant and more livable;
WHEREAS, the Department of the Interior and Local Government (DILG) issued
various polices on road clearing operations, the latest are Memorandum Circular No.
2020-085 dated June 20, 2022 and MC No. 2023-017 dated January 25, 2023 which
direct the LGUs to conduct road clearing operations and Barangay Road Clearing
Operations (BaRCO) in the case of barangays and to undertake other initiatives to
reclaim public roads which are being used for private ends and clearing;
WHEREAS, the above-cited Circulars clearly laid down the accountabilities and
responsibilities of the LGUs from the provinces, cities and municipalities down to the
barangays in the implementation of road clearing;
WHEREAS, on January 5, 2024, President Ferdinand R. Marcos, Jr. called on
Local Government Units to start with order and cleanliness and pronounced that “Let
our Barangays be the laboratory of workable ideas, a showcase of what we can achieve
together, and proof that the basic government unit, the barangay teems with best
practices. Simulan po natin sa kaayusan at kalinisan.Kaya kumilos tayo upang gawing
maaliwalas at malinis ang kapaligiran. Dapat walang lugar at puwang and dumi, dugyot
at dilim sa ating pamayanan.”
WHEREAS, the President also urged the local officials, including the newly
elected village and youth council officials to take the lead in clearing up all roads,
canals, markets and schools.
NOW, THEREFORE, BE IT ENACTED, AS IT IS HEREBY ENACTED BY THE
SANGGUNIANG BARANGAY OF ___________ MUNICIPALITY OF ______,
ISABELA, BY VIRTUE OF THE POWERS VESTED IN IT BY LAW, IN SESSION
ASSEMBLED, THAT:
Section 1. Short Title – This Ordinance shall be known and cited as the “Road
Clearing Ordinance of Barangay ____________”.
Section 2. Coverage – This Ordinance shall cover all kinds of obstructions on
barangay roads and other public places within the territorial jurisdiction of Barangay
__________ of the Municipality of Delfin Albano, Isabela committed by individuals,
entities, establishment and companies other than those obstructions committed by
persons while driving or operating motor vehicles and all other forms of conveyances.
Section 3. Definition of Terms – as a general rule, words and phrases embodied in
this ordinance not herein specifically defined shall have the same meaning as found in
legal dictionaries as well as in existing laws. Provided that, the following terms as used
in this ordinance, shall be construed to mean:
A. Obstruction – are structures, materials, whether permanent or temporary,
movable or immovable or activities within the road right-of-way that impedes the
free and clear passage of motor vehicles or pedestrian and/or pose danger or
cause injury to motorists, pedestrians, or occupants of nearby structures;
B. Public Roads – means all streets, roads, bridges, highways and other
thoroughfares constructed and maintained by the national government or by any
local government unit;
C. Barangay Roads – refer to minor tertiary roads, streets, alleys under the
management of the Barangay and other roads officially turned over to
Barangays;
D. Road Right-of-way – means the legal access established by usage with
precedence over others in a particular situation or place;
E. Sidewalk – means that portion of roadway assigned for the use by pedestrians,
which must be free from all forms of physical obstructions or anything found on it,
whether of value or not;
F. Sidewalk Vendor – means any person who sells or offers for sale any consumer
products, whether agricultural or manufactured, cooked foods and/or dry goods,
items or articles, including any person who attends to these products intended to
be sold at any temporary location, sidewalk, alley vacant space or portion
thereof; and
G. Street – means any open space established by eminent domain including the
space above for access of vehicles and people, for the continuous flow of
vehicular traffic and pedestrian;
Section 4. Prohibition – It is hereby prohibited and considered unlawful for any person
or group of persons, entity, establishment to obstruct the free flow of people, goods and
vehicles through the barangay road network within the territorial jurisdiction of Barangay
____________ by using, utilizing or otherwise appropriating any road, street, sidewalk,
or pedestrian walkway, avenue, alley, bridge, park and other public place or portion
thereof, for commercial or personal purposes. The prohibition includes all kinds of
obstructions such as but not limited to:
4.1 Illegally parked vehicles including e-bike and e-tricycle along public roads,
shoulders or sidewalks;
4.2 Vehicular terminals except in areas designated by the barangay for such
purposes;
4.3 Vending sites for any kind of item;
4.4 House encroachments that obstructs the road right-of-way, protruding gates,
conduct of household activities, and tents, except those being temporarily used
for funerals and other similar activities;
4.5 Store encroachments and indiscriminate signage and advertisements;
4.6 Obstructing barangay outposts, halls, markers, directories or fire hydrants;
4.7 Conduct of sports, sport facilities, and other related activities;
4.8 Drying of rice or other crops;
4.9 Construction materials including sand, gravel, cement, steel bars, logs, and the
like;
4.10 Steel plates, make shirt shelters, banners that obstruct the safe movement of
vehicles and pedestrian; and
4.11 Other structures, materials, or activities identified as obstructions under Municipal
Ordinance No. 53-2019.

Section 5. Designation of one side parking – the following Barangay Roads are
designated as one-side parking:

Section 8. Exemptions – For purposes of exempting an activity as an obstruction from
the coverage of this ordinance, the following criteria shall be observed:
A. That it has proper coordination and duly approved by the barangay in which the
duration of the activity is properly determined such as religious/community
activities (preaching, processions or holding of a wake or other affairs of the
community like birthday, fiesta celebration, games and amusement);
B. In cases of construction and repairs along public roads, equipment and materials
used in such undertaking shall not be considered as obstructions under this
ordinance, provided, that such undertaking has proper coordination with the
appropriate government office and duly approved by the latter;
C. In cases where such obstructions are necessary incidents dictated by reasons of
emergency to protect and save lives or properties from any calamity or public
danger whether natural or man-made;
D. For one-way traffic rule, all emergency trip vehicles, and other vehicles which are
to bring patients to have medical attention; and
E. Other cases when expressly permitted or allowed by law or an ordinance
promulgated to meet a momentary necessity of order and public safety.
Section 9. Declaration – All obstructions and illegal structures, including those not
specified by the foregoing section, are hereby declared as public nuisance and are
subject of summary abatement.
Section 10. Other Administrative Provisions
10.1 Conduct of religious activities or the holding of wake or other community affairs
like games/amusement activities should be coordinated with the Barangay
__________ concerned and the Local Police Station.
10.2 All items, goods and structures found on or along roads, streets, sidewalks, other
public places and spaces within the jurisdiction of Barangay _________ shall be
confiscated by the barangay without prior notice.
10.3 Barangay ________ shall not be held liable for any damage arising from the
removal, confiscation, or disposal of all confiscated items.
Section 11. Penalties – Violators of this Ordinance shall be penalized as follows:
11.1 First Offense : Fine of Five Hundred Pesos
11.2 Second Offense : Fine of One Thousand Pesos
11.3 Third and Succeeding Fine of Two Thousand Pesos and
Imprisonment
Offenses : of one (1) month, or both at the discretion of
the Court.
Section 13. Information and Education Campaign – Information, education and
communication (IEC) Materials for such awareness campaigns will be produced and
disseminated by the barangay using all forms of media informing
Section 15. Repealing Clause – All ordinances and resolutions, or parts thereof, the
provisions of which are in conflict with or contrary to the provisions of this ordinance are
hereby repealed, amended and modified accordingly.
Section 16. Separability Clause – If for any reason or reasons, any provision of this
ordinance be declared invalid, the other provisions not affected thereby shall remain in
full force and effect.
Section 17. Effectivity Clause – This ordinance shall take effect immediately upon
compliance of the posting requirement following its approval.
