I have read the Certificate of Urgency dated 19/07/2024 signed by Counsel Abner Collins Mango, the
Notice of Motion Application dated 19/07/2024, and the Supporting Affidavit of Florence W. Muturi
dated 19/07/2024; all of which were filed on 22/07/2024 alongside a Petition dated 19/07/2024.
Consequently, I HEREBY ORDER AND DIRECT THAT:
1. The Application be and is hereby certified urgent and shall be heard on a priority basis.
2. Pending the inter-partes hearing and determination of the Application dated 19/07/2024, a
conservatory order be and is hereby issued suspending the Presidential Executive Order
No. 5 of 2024 carried as Kenya Gazette No. 8437 of 2024 dated 05/07/2024 establishing the
‘Presidential Taskforce on Addressing Human Resources for Health.’
3. Pending the inter-partes hearing and determination of the Application dated 19/07/2024, a
conservatory order be and is hereby issued prohibiting the Respondents and all other
persons and authorities from taking any action whatsoever pursuant to, in reliance of, or in
implementation of the Presidential Executive Order No. 5 of 2024 carried as Kenya Gazette
No. 8437 of 2024 dated 05/07/2024 establishing the ‘Presidential Taskforce on Addressing
Human Resources for Health.’
4. The Petitioner/Applicant shall serve the Application and the Petition on the Respondents and the
Interested Parties within the next 3 days and file an Affidavit(s) of Service in that regard by close
of business 26/07/2024.
5. The Respondents and Interested Parties shall file and serve their responses to the Application
dated 19/07/2024 by close of business 09/08/2024.

6. The Petitioner/Applicant shall file a rejoinder, if need, by close of business 23/08/2024.
7. Parties shall appear for further orders and/or directions on 24/09/2024.
