Subject: - APPLICATION OF KASHIF KHAN

Kindly refer to your office Diary No. 1632/C-CELL, dated 13.07.2023.
It is submitted that the subject application was filed by applicant Kashif Khan
s/o Darwesh Khan r/o Nowshera Kalan regarding his innocence and impartial investigation in
case vide FIR No. 514 dated 21.04.2023 u/s 324/34 PPC PS Nowshera Kalan.
The instant application was sent to OII PS Nowshera Kalan wherein he
submitted a detail report stating therein that applicant/accused also produced a USB, containing
videos, which was sent to FSL, Peshawar for analysis on 08.06.2023 which was declared original
and no editing has been found in videos. According to the video footages applicant/accused
Kashif entered to his house on 20.04.2023 and left his house on 20.04.2023 at 14:00 hrs. after the
occurrence has taken place at 11:50 hrs. but in the footages applicant/accused Kashif has not
been seen at the time of occurrence. Similarly, applicant/accused has been charged directly by
the complainant Arif in the said case. Complainant Arif got hit 02 shots in thigh and 01 shot in
ankle which could not be a factitious/fake occurrence. It is worth to mention here that house of
applicant/accused is only 02 minutes away from the place of occurrence.
Likewise, applicant/accused also filed an application but failed to produce
any solid evidence regarding his innocence. Another application which he filed for his innocence,
wherein he produced 03 statements of witnesses on affidavit stating therein regarding his
innocence. CDRs of mobile NOs of witnesses were obtained according to which on eventful day
i.e. 21.04.2023 location of witness Muhammad Parvaiz is as Bara Khel and not Armor Colony
(different base station/tower) while no details were available of witness Abdul Qayyum on the
same day.
Moreover, the applicant/accused was cross examined which is attached
herewith on enquiry file. The Investigation Officer is not satisfied and not agreed with the CCTV
footage provided by applicant/accused as at the time of occurrence i.e. 11:50 hrs. he could not be
seen in the videos. Furthermore, applicant/accused has been charged directly by complainant in
injured condition.
