<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>Trong thời


gian qua, thực hiện chủ trương cải cách hành chính của Đảng, Chính phủ, Bộ Xây
dựng và các địa phương đã kịp thời ban hành các quy định về&nbsp; cấp giấy phép
xây dựng, quản lý trật tự xây dựng đô thị theo hướng phân cấp mạnh cho cơ sở;
công khai và đơn giản các thủ tục xin cấp phép xây dựng; quy định cụ thể thời hạn
xét cấp giấy phép; trách nhiệm của các cơ quan, cá nhân trực tiếp thực hiện
công việc cấp giấy phép cũng như tăng cường công tác thanh tra, kiểm tra, xử lý
vi phạm trật tự xây dựng; một số địa phương đã triển khai cấp giấy phép xây dựng
tạm và giấy phép xây dựng nhà ở nông thôn. Nhờ đó, công tác cấp giấy phép xây dựng
đã được đẩy mạnh, số giấy phép xây dựng được cấp năm sau tăng hơn năm trước.</p>

<p class=MsoBodyTextIndent style='margin-bottom:6.0pt'>Bên cạnh những kết quả đạt


được, công tác cấp phép xây dựng và quản lý trật tự xây dựng vẫn còn những tồn
tại, một số địa phương đã tự đặt thêm các thủ tục ngoài quy định; triển khai
công tác cấp phép xây dựng chậm trễ; việc kiểm tra thực hiện xây dựng theo giấy
phép và quản lý trật tự xây dựng còn bị buông lỏng, xử lý chưa kịp thời, chưa
nghiêm minh; tình trạng xây dựng sai phép, không phép vẫn còn diễn ra và có chiều
hướng tăng cả về số lượng và quy mô xây dựng gây ảnh hưởng tới cảnh quan, môi
trường đô thị, thậm chí đã xẩy ra các sự cố nghiêm trọng thiệt hại về người và
của gây bức xúc trong dư luận xã hội.&nbsp;&nbsp; </p>

<p class=MsoBodyText3 style='margin-bottom:6.0pt'>Nhằm khắc phục những tồn tại


nêu trên và để đẩy mạnh hơn nữa công tác cấp phép xây dựng, tăng cường quản lý
trật tự xây dựng theo đúng các quy định của pháp luật, Bộ trưởng Bộ Xây dựng
yêu cầu:</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'><b>1. Ủy


ban nhân dân các tỉnh, thành phố trực thuộc Trung&nbsp; ương</b></p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>Chỉ đạo


các cơ quan chuyên môn và UBND các cấp thực hiện ngay các công việc
sau:&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>a. Về


quy hoạch xây dựng:</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>&nbsp;-


Đầu tư nguồn lực để đẩy mạnh công tác lập quy hoạch xây dựng, đặc biệt là quy
hoạch chi tiết xây dựng đô thị, bảo đảm quy hoạch xây dựng phải được đi trước một
bước làm cơ sở cho việc cấp phép xây dựng.</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>- Công bố,


công khai quy hoạch chi tiết xây dựng đô thị để nhân dân biết, thực hiện và
giám sát việc thực hiện xây dựng theo quy hoạch.</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>b. Về cấp


phép xây dựng : </p>
<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>-&nbsp;
Rà soát lại các quy định về cấp phép xây dựng trên địa bàn theo đúng các quy định
của Luật Xây dựng và các văn bản hướng dẫn thực hiện Luật; bãi bỏ các quy định
trái pháp luật, gây phiền hà cho người xin giấy phép.</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>-&nbsp;


Chỉ đạo các cơ quan có thẩm quyền có biện pháp tháo gỡ những khó khăn, vướng mắc,
phiền hà trong việc xác nhận giấy tờ hợp pháp về đất đai nhằm tạo điều kiện thuận
lợi đẩy nhanh việc cấp phép xây dựng.</p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>- Sắp xếp, củng cố tổ chức,


tăng cường cán bộ có đủ năng lực, phẩm chất đạo đức thực hiện công tác cấp phép
xây dựng, thanh tra xây dựng và đội ngũ quản lý trật tự xây dựng; trong đó phân
định rõ quyền hạn, trách nhiệm của cơ quan cấp phép, cơ quan thanh tra và UBND
các cấp trong việc kiểm tra, thanh tra, xử lý vi phạm đối với các công trình
xây dựng không phép, sai phép và vi phạm các quy định về an toàn, vệ sinh, môi
trường, kể cả những công trình được miễn giấy phép xây dựng. Kiên quyết xử lý
các vi phạm về xây dựng thuộc thẩm quyền hoặc kiến nghị cấp có thẩm quyền xử lý
khi phát hiện các vi phạm trong quá trình thanh tra, kiểm tra.</p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>c. Ban hành quy chế phối hợp


giữa các cơ quan có liên quan trong việc cấp phép xây dựng, thanh tra xây dựng
và quản lý trật tự xây dựng bảo đảm phát huy hiệu lực, hiệu quả của công tác quản
lý xây dựng ở địa phương. </p>

<p class=MsoBodyTextIndent3 style='margin-bottom:6.0pt'><strong><span


style='font-family:"Arial","sans-serif"'>2. Cơ quan cấp giấy phép xây dựng (Sở
Xây dựng, UBND cấp huyện, xã) </span></strong></p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>a. Chấp


hành đúng các quy định của pháp luật về cấp phép xây dựng, không được gây phiền
hà, nhũng nhiễu cho người xin cấp phép xây dựng. </p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>b. Niêm


yết công khai các thủ tục, quy trình cấp phép xây dựng tại nơi cấp giấy phép;
thực hiện cải cách hành chính trong việc nhận hồ sơ và trả kết quả theo cơ chế
một cửa. Khi cần làm rõ thông tin liên quan đến các cơ quan khác để phục vụ việc
cấp giấy phép xây dựng mà không thuộc trách nhiệm của người xin cấp giấy phép
xây dựng, thì cơ quan cấp phép xây dựng có trách nhiệm lấy ý kiến các cơ quan
đó.</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>c. Gửi bản


sao giấy phép xây dựng đã cấp cho UBND cấp xã nơi xây dựng công trình biết để
kiểm tra, theo dõi và quản lý việc xây dựng.</p>

<p class=MsoBodyTextIndent2 style='margin-bottom:6.0pt'>d. Kiểm tra thường


xuyên để kịp thời xử lý các vi phạm trong việc xây dựng công trình không phép,
sai phép kể cả trường hợp sai với thiết kế cơ sở đã được cơ quan nhà nước có thẩm
quyền thẩm định đối với những công trình được miễn giấy phép xây dựng trong đô
thị.</p>

<p class=MsoBodyTextIndent2 style='margin-bottom:6.0pt'>đ. Sắp xếp, củng cố tổ


chức, đầu tư cơ sở vật chất phục vụ cho công tác cấp phép xây dựng và kiểm tra
trật tự xây dựng; bồi dưỡng kiến thức chuyên môn và pháp luật cho cán bộ thực
hiện các công việc này. Kiên quyết xử lý những cán bộ vi phạm các quy định về cấp
phép xây dựng; thay thế những cán bộ không đủ phẩm chất đạo đức hoặc có biểu hiện
tiêu cực trong việc cấp phép xây dựng. </p>

<p class=MsoBodyTextIndent2 style='margin-bottom:6.0pt'>e. Sở Xây dựng có trách


nhiệm: </p>

<p class=MsoBodyTextIndent2 style='margin-bottom:6.0pt'>- Hướng dẫn về chuyên


môn, nghiệp vụ cho cán bộ quản lý xây dựng của cấp huyện, cấp xã về cấp phép
xây dựng và tăng cường kiểm tra việc thực hiện công tác này.</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>- Hướng


dẫn chủ đầu tư và nhà thầu thi công xây dựng thực hiện nghiêm túc quy định về
treo biển báo tại công trường theo quy định tại Điều 74 của Luật Xây dựng. Nội
dung của biển báo phải có đầy đủ các thông tin đã được quy định trong giấy phép
xây dựng về diện tích xây dựng, số tầng, chiều cao tối đa toàn công trình và
hình vẽ phối cảnh công trình.</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'><b>3. Chủ


đầu tư xây dựng công trình</b></p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>Chủ đầu


tư xây dựng công trình phải thực hiện các yêu cầu sau:</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>a.&nbsp;


Chỉ được khởi công xây dựng công trình khi đã có đủ các điều kiện theo quy định
tại Điều 72 của Luật Xây dựng (có mặt bằng xây dựng; có giấy phép xây dựng đối
với công trình theo quy định phải có giấy phép xây dựng; có thiết kế bản vẽ thi
công đã được phê duyệt; có biện pháp bảo đảm an toàn, vệ sinh môi trường; có hợp
đồng xây dựng; có đủ nguồn vốn để thực hiện theo tiến độ).</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>b. Phải


thông báo ngày khởi công xây dựng công trình bằng văn bản cho Uỷ ban nhân dân cấp
xã nơi xây dựng công trình trong thời hạn 7 ngày làm việc trước khi khởi công
xây dựng công trình.</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>c.&nbsp;


Phải xây dựng theo đúng nội dung giấy phép xây dựng được cấp.</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'>d. Phải


treo biển báo công khai các thông tin về công trình được phép xây dựng tại công
trường theo quy định.</p>

<p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:6.0pt'><b>4.


Nhà thầu thi công xây dựng công trình </b></p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>a. Chỉ được khởi công xây dựng


công trình khi đã có đủ các điều kiện khởi công theo quy định.</p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>b. Thi công xây dựng theo


đúng giấy phép được cấp và hợp đồng đã ký với chủ đầu tư. </p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>c. Có biện pháp bảo đảm an


toàn đối với công trình và các công trình lân cận.</p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>d. Có biện pháp bảo đảm an


toàn, vệ sinh môi trường cho công trường và khu vực xung quanh. Những công
trình xây dựng trong đô thị phải được che kín xung quanh đảm bảo môi trường và
mỹ quan đô thị.</p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'><b>5.&nbsp; Cơ quan thanh tra


xây dựng các cấp&nbsp; </b></p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>a. Củng cố tổ chức bảo đảm đủ


về số lượng, chất lượng, tăng cường cơ sở vật chất để thực hiện có hiệu quả chức
năng, nhiệm vụ được giao.</p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>b. Đẩy mạnh công tác thanh


tra, xử lý kịp thời, dứt điểm các vi phạm đối với công trình xây dựng không
phép, sai phép.</p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>c.&nbsp; Phối hợp chặt chẽ với


UBND các cấp trong công tác thanh tra, kiểm tra và xử lý vi phạm bảo đảm giữ vững
trật tự, kỷ cương trong hoạt động xây dựng. </p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'><b>6. Các cơ quan khác có


liên quan </b></p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>a. Vụ Khoa học Công nghệ – Bộ


Xây dựng tổ chức nghiên cứu, rà soát quy chuẩn, tiêu chuẩn xây dựng để có kiến
nghị điều chỉnh, sửa đổi, bổ sung cho phù hợp với tình hình thực tế và điều kiện
cụ thể của từng địa phương và đặc điểm của từng khu vực.&nbsp; </p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>b. Trường Đào tạo Bồi dưỡng


cán bộ ngành Xây dựng phối hợp với các Sở Xây dựng tổ chức các lớp tập huấn về
chuyên môn, nghiệp vụ cho các cán bộ làm công tác cấp phép xây dựng và thanh
tra xây dựng ở các địa phương.</p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>c. Các tổ chức, cá nhân phát


huy vai trò giám sát và phản ánh kịp thời những hành vi vi phạm pháp luật trong
việc cấp phép xây dựng, thi công xây dựng công trình và quản lý trật tự xây dựng
đô thị tới cơ quan có thẩm quyền để có biện pháp ngăn chặn và xử lý kịp
thời.&nbsp;&nbsp;
</p>

<p class=MsoBodyText2 style='margin-bottom:6.0pt'>&nbsp;Vụ Xây lắp – Bộ Xây dựng


là đầu mối giúp Bộ trưởng Bộ Xây dựng theo dõi, kiểm tra việc thực hiện Chỉ thị
này. </p>
