, e-tenders are invited by Executive Engineer R&B Div.Rafiabad (watergam) on (Aggregate
Percentage Basis) from approved and eligible Civil Contractors registered with J&K UT Govt.,
PWD, CPWD, Railways and other State/Central Govt. for the following work:-

The Bidding documents Consisting of qualifying information, eligibility criteria, specifications, bill of
quantities (B.O.Q), Set of terms and conditions of contract and other details can be seen/downloaded
from www.jktenders.gov.in as per schedule of dates given below:-
Special conditions:-
I. The intending tenderers must have sufficient skilled /unskilled labour force.
II. All intending Bidders have to upload Scanned copy of Earnest money @ 2% as per the circular
issued by Chief Engineer PW(R&B) Department Kashmir, vide No. CE/RBK/HD/32857-92, Dated:
01-01-2022.
III. Intending bidders shall upload scanned copies of documents of valid Registration card (2023-24)
PAN / GST registration with clearance of May/June 2024 or Ist Quarter 2024-25 (, Treasury
Receipt (Dated between the bid start date and the bid submission end date ) deposited in MH
0059 and CDR ,BG or FDR pledged to Executive Engineer R&B Div.Rafiabad (watergam) . However
successful bidder shall produce the original copies of same within 3 days after opening of tenders.
IV. The successful Bidder has to produce an amount equal to 5% of allotted cost as
performance security within 03 days after opening of tenders and same shall be released
after expiry of Defect Liability period (DLP) and additional performance security
as per break up given below in addition to Normal Deposit if applicable in shape of
CDR,BG/FDR within 03 days after opening of tenders and same shall be released after
successful completion of work.

Additional security deposit shall be released only after the completion of the work in all respects.
V. The Ernest Money Deposit of 2% of successful bidder shall be released after receipt of 5%
performance security and Additional Performance Security as per break up given above if
applicable.
VI. The undersigned reserves the right to accept or reject any tender or all tenders without assigning
any reason thereof.
VII. The typographical error in the BOQ like unit of item, quantity of item, rate of item etc. If
any found during e-NIT or after end date of NIT, shall be rectified as per the estimate in the
allotment/Agreement of work.
General Conditions:
1. The bidders will provide email ID and complete postal address including cell numbers.
2. The date and time of opening of Bids shall be notified on Web Site www.jktenders.gov.in and
conveyed to the bidders automatically through an e-mail message on their e-mail address. The bids
of Responsive bidders shall be opened online on same Website in o/o Executive Engineer R&B
Div.Rafiabad (watergam) (Tender Receiving Authority).
3. The bids for the work shall remain valid for a period of 90 days from the date of opening of Bids
4. The earnest money shall be forfeited, If:-
a. Any bidder/ tenderer withdraw his bid/ tender during the period of bid validity or make any
modifications in the terms and conditions of the bid.
b. Failure of Successful bidder to furnish the required performance security within the specified
time limit.
c. Failure of Successful bidder to execute the agreement within 7 days after fixation of contract.
5. Bidders are advised to visit and examine the site / location of work, its surroundings and
familiarize himself with existing facilities / difficulties and environment and collect all other
information which he may require for preparing and submitting the bid entering into the contract.
Claims and objections due to ignorance of existing conditions are in-adequacy of information will
not be considered after submission of the bid and during execution of work.
7. Instruction to bidders regarding e-tendering process.
7.1. Bidders are advised to download bid submission manual from the "Downloads" option as well as
from "Bidders Manual Kit" on website www.jktenders.gov.in acquaint bid submission process.
7.2. To participate in bidding process, bidders have to get 'Digital Signature Certificate (DSC)' as per
Information Technology Act-2000. Bidders can get digital certificate from any approved Vendor.
7.3. The bidders have to submit their bids online in electronic format with digital Signature. No bid
will be accepted in physical form.
7.4. Bids will be opened online as per time schedule mentioned in Para-1.
7.5. Bidders must ensure to upload scanned copy of all necessary documents with the bid. Besides,
original / photocopies of documents related to the bid .
Note:- Scan all the documents on 100 dpi with black and white option.
8. The department will not be responsible for delay in online submission due to any reasons.
Rates
9. The bidder/ bidders are advised to quote /upload their rates on (Aggregate Percentage Basis)
inclusive of all costs , taxes , royalty/ octari / GST/ Income tax /Labour cess etc. including cost of
necessary machinery, tools and plants and all other necessary consumable , for effective &
methodical execution of work.
i) The (Aggregate Percentage) uploaded by the tenderer for the work shall be entertained upto two
digits only after decimal for the evaluation / calculation purposes. As per BOQ (No item wise
percentage / rate be shall accepted)
10. Storage
The Successful contractor shall make his own arrangements for the transportation/ head load etc
for store material from store to actual site of work after proper receipt/ intent with custody certificate
and shall ensure its safe return / back after completion of work period to store with proper inventory
duly authenticated by the officer/ official concerned.
11. Accident / Injury to Workman: The department shall not be liable for in respect of any damage
or compensation payable to law in respect or in consequence of any accident or injury or natural
calamity to any workman / labour or other person in the employment of contractor.
12. Photography/ Videography
The contractor is require to take and furnish colored geo tagged photographs on stage based/
Videography files of all construction activities before during and after completion of works. All the
cost of such photographs/ videographs etc shall be deemed to have been included in the rates quoted
against various items and nothing external shall be paid for the above and no bill should be
processed without geo tagged photographs
13. Accommodation/ Electricity etc.
No accommodation will be available with the department for the contractor or for any of the
workman engaged by him and contractor will may his own arrangement for the electric power system
/ generator system at his own risk and cost.
14 Bidders are advised not to make any change in BOQ (Bill of Quantities) contents. In no case they
should attempt to create similar BOQ manually. The BOQ downloaded should be used for filling the
item rate inclusive of all taxes and it should be saved with the same name as it contains.
15. Price escalation and Taxes:- The (Aggregate Percentage Basis) uploaded by the bidder entirely
in Indian Rupees and the (Aggregate Percentage Basis) shall be deemed to include price
escalation and all taxes upto completion of the work, unless otherwise specified. Deduction on
account of taxes shall be made from the bills of the contractor on gross amount of the bill as per the
rates prevailing at the time of recovery.
16. Bidders are advised to use "My Documents" area in their user on e-Tendering portal to store
such documents as reqd.
17. Any bid/s received beyond 15% above the advertized cost of the work shall not be entertained
and fresh tenders shall be invited without any further notice.
18.The date of start of the work shall be reckoned within 2 days from the date of issuance of
LOI/Contract allotment as the case may be..
20. Time extension:-Suitable time extension shall be granted in case of increase in scope of work
and in the event of delay beyond control of contractor to be determined by the department.
21. Advance Payments:-No mobilization advance/equipment advance shall be paid unless otherwise
specified in the SBD.
22. The earnest money of successful bidders shall be released after expiry of DLP period which is
minimum 12-months from date of completion of work.
23. Bids from joint ventures are not allowed.
24. Retention Money:-10% shall be deducted from each running bill of the successful contractor
which shall be released after virtual completion of work with satisfactory report from concerned
quarters in all respects.
25. The tender receiving authority reserves the right to accept or reject any tender or all tenders
without assigning any reason thereof.
26. Restoration of work:- On completion of contract the contractor shall be responsible to remove
all un-used material and restore all work in its original position at his own cost.
27. Traffic regulations:-The contractor is bound to adhere to traffic regulations as is applicable from
time to time and ensure arrangements of smooth regulation of traffic during execution of work.
28. Arbitration:- The arbitration shall be conducted in accordance with the arbitration procedure
stated in the J&K conciliation and Arbitration Act No:-xxxv of 1997 issued vide SRO No:-403 vide
Notification of J&K Govt., "Law Department" 11th December-1997.
29. Discoveries:- Anything of historical or other interest or of significant value unexpectedly
discovered on the site shall be the property of the Govt.
30. Tests:-The contractor shall be solely responsible for carrying out the mandatory tests required
for the quality control at his own cost.
31. Termination:- The Department may terminate the contract, if the contractor causes a
fundamental breach of the contract and misconduct of behavior.
32. Pursuant to the process of termination of defaulted contract on midway, the Department reserves
the right to invite tender for the balance work at the risk and cost of defaulting contractor.
33. Major Labour Laws applicable to establishment engaged in building and other construction
Work:-
a. Workmen compensation act 1923.
b. Payment of Gratuity Act 1972.
c. Employees P.F. and Miscellaneous Provision Act 1952.
d. Maternity Benefits Act 1951.
e. Contract Labour (Regulation & Abolition) Act 1970.
f. Minimum Wages Act 1948
g. Payment of Wages Act 1936.
h. Equal remuneration Act 1979.
i. Payment of bonus Act 1965.
j. Industrial disputes Act 1947.
k. Industrial employment standing orders Act 1946.
l. Trade Union Act 1926.
m. Child Labour (Prohibition & Regulation) Act 1986.
n. Inter State Migrant workmen’s (Regulation of employment & Conditions of service) Act 1979.
o. The Building and other Construction workers (Regulation of employment and Condition of
service) Act 1996 and the Census Act of 1996.
p. Factories Act 1948.
q. Compliance with Labour Regulation Laws of J&K State.
34. Specification/Quality Control:- All items of works shall conform to specifications as per IRC/
MORTH/ NBO/ CPWD/ SSR/ Any other prescribed specifications.
35. Insurance:- Insurance cover to Labour / Machinery / Work / Plant material / Equipment by the
contractor shall be mandatory.
36. Laws Governing the Contract:-The contract shall be governed by Laws of the land.
37. Court’s Jurisdiction:-In case of any disputes/differences between contractor and Deptt. the
jurisdiction shall be UT J&K.
38. The tender / bid is liable to rejection if it does not fulfill the requirements as laid down in NIT.
39. Conditional tenders shall not be entertained at all.
40. All other terms conditions are as per PWD Form 25 (Double agreement Form) and General eNIT.
41. Deductions of Taxes shall be made from the bills of contractors on gross amount of the bills as
per the rates prevailing at the time of recovery, as admissible under rules.
42. Defect Liability period (DLP) shall be twelve months or (as per company standards) calculated
from the date of completion of work, if after physical completion of work in all respects, any
defect/imperfection in the work done by the contractor becomes apparent on account of bad
workmanship or use of sub-standard materials or on any other account within a period of one year,
the contractor shall make the same good, at his own expenses. If the Department deems it proper to
restore the damages / defects through other agency, the expenses incurred therein shall be recovered
from payment amount that may be due to contractor at any time or from the security deposit. The
Security deposit of successful contractor shall not be refunded before the expiry of (DLP).
43. In case the IRREVOCABLE POWER OF ATTORNEY is executed by the successful contractor in
favour of any other person or Bank, the same shall be entertained subject to acceptance by the
competent authority.
44. Schedule of payments:
The payment schedule shall be fixed as per standard norms in accordance with specification, terms
and conditions of award of contract accordingly the claim shall be prepared and processed further for
technical check. Payment shall only be released as & when funds are available with DDO.
46. The tenderer should study all the terms and conditions of e-NIT in carefully and fill up the
tender accordingly.
