AN ORDINANCE FIXING THE PENALTIES FOR VIOLATION OF THE PROVISIONS OF
ORDINANCE NO. 2009-08 OF THE SANGGUNIANG PANLALAWIGAN OF CEBU,
KNOWN BY ITS SHORT TITLE AS THE “ANTI-RABIES ORDINANCE OF 2009”, AND
CREATING THE ANTI-RABIES TRUST FUND,
Be it ORDAINED by the Sangguniang Bayan, that:
Section 1, Explanatory Note. ~ On its regular session on January 18, 2010, this august
body unanimously passed Resolution No. 2010-014 which resolved to adopt the Ordinance No.
2009-08 of the Province of Cebu, as cited herein by its short title. The adoption, however, failed
to consider the maximum amount of penalty that a municipality like Lilo-an could validly
impose, as provided under R.A. 7160 or the Local Government Code of 1991 — which, for all
intents and purposes, should not exceed Two Thousand Five Hundred Pesos (Php 2,500.00) per
violation, Whereas, in that said Ordinance No. 2009-08, the penalty imposition reaches as high
as Five Thousand Pesos (Php 5,000.00) which is well within the power of the Sangguniang
Panlalawigan to impose but beyond that of the municipalities; hence, this Ordinance.
Section 2. Penalties. - As enumerated in Section 16 of the Anti-Rabies Ordinance of the
Province of Cebu, the following acts shall be subject to an administrative or compromised fine in
the amount fixed herein, to mention:
(@) Failure or refusal by the owner to have his/her dog registered and properly vaccinated
against rabies shall render him/her liable to pay an administrative or compromised
fine of One Thousand Pesos (Php 1,000.00).
(b) Refusal by the owner to have his/her dog properly vaccinated shall make him/her
liable to pay the cost for the proper vaccination of both the dog son/s bitten

64(©) Refusal by the owner to put his/her dog under observation after it has bitten a person
shall render him/her liable to pay an administrative or compromised fine in the
amount of Two Thousand Five Hundred Pesos (Php 2,500.00).
(@) Refusal or failure by the owner to put a leash on his/her dog when the dog is outside
its premises shall render him/her liable to pay an administrative or compromised fine
of Five Hundred Pesos (Php 500.00),
(©) Failure or refusal by the owner to shoulder the medical expenses of the person bitten
by his/her dog shall make hinvher liable to pay an administrative or compromised
fine of Two Thousand Five Hundred Pesos (Php 2,500.00),
Section 3. Trust Fund. — All proceeds from administrative or compromised fine shal]
accrue exclusively to an Anti-Rabies Trust Fund, which is hereby created, to be spent solely for
the campaign on the prevention, control and eradication of rabies, which includes the operation
and maintenance of the dog pound.
Section 4, Barangay To Share From The Proceeds Of Fine. ~ The barangay from where
the dog owner penalized herein resides or from where the act penalized hereof took place, shall
be entitled to a share equivalent to 40% of the fine paid for under such circumstance.
Section 5. Repealing Clause. ~ Any Ordinance or part thereof which is inconsistent or in
conflict with the provisions of this Ordinance, is hereby deemed repealed, modified or amended
accordingly.
Section 6. Effectivity Clause. ~ This Ordinance shall take effect after Ten (10) Days
following the posting of its copies in all the barangay halls in the municipality, and at the bulletin
board in the town hall.
