DECLARATION CUM UNDERTAKING

I, MR. ANKUR CHOUDHARY am Indian inhabitants, residing at


______________________________________________________________________________
_________________, do hereby state on solemn affirmation as under :-

1. I say that I have ownership, right title and interest and otherwise well and sufficiently
entitled to Residential premises bearing Flat No. 301, on the 3 rd floor, admeasuring
49.722 Sq. Mts. Carpet area + 2.000 sq. mtrs. balcony area in the building known as
“SATYAM PRECIOUS”, constructed on land bearing Plot no. 28, Sector no. 17, lying,
being and situated at Village-Kamothe, Navi Mumbai, Taluka-Panvel, District-Raigad,
within the jurisdiction of Registration District Raigad and Sub-District Panvel.
2. I hereby declare that I have offered the above referred property as a security for Home
Loan of Rs. ______________ _____________ granted by Bank of Baroda,
_______________ __________________ Branch to me and I have agreed to create an
Equitable Mortgage by deposit of title deeds of the said property in favour of Bank of
Baroda, ________________________ Branch.

3. I hereby declare that the title of the said property is clear, marketable and free from
encumbrances no other person has/have any right title and interest in the said property.

4. I hereby declare, confirm and undertake that the said property is free from
encumbrances/charges/lien/assignment, etc. except the present charges in favour of the
Bank of Baroda and the said property will not be sold delivered or disposed off,
alienated, dealt with in any manner whatsoever in favour of any person/persons or body
corporate or any other legal entity without the prior written consent of Bank of Baroda
and/or till the entire dues are liquidated.

5. I shall execute all other documents in the manner and form as and when required by the
Bank in this respect in future.

6. I shall not take recourse to outside borrowings on the security of the said property till the
dues and liabilities towards the Bank are fully paid.

7. I have not mortgaged, charged or encumbered in any manner the said property except
present mortgage with Bank of Baroda. The title of the said property is marketable, free
from encumbrances and doubts. I have not let or given on leave and licenses basis or sub
lease the said property.

8. There is no prohibitory order from the Income Tax, Sales Tax Authority or authorities
affecting the said property.

9. There is no lis – pendens, insolvency and attachment before or after the judgment
affecting the said property.

10. I shall not sell or dispose off, mortgage, charge or encumber in any manner whatsoever
said property to any person or persons as long as the amount due and payable to the Bank
have been fully paid and discharged.

11. I undertake to submit share certificate to Bank as and when issued by society and I also
undertake to insure the said property with comprehensive risk with Bank clause and
submit the same to Bank.
