FORMAL OFFER:
This Judicial Affidavit/Testimony of the petitioner
Severino B. Ortiz is being offered to prove the following:
1. That he is the Petitioner in the instant case.
2. That he is the true and lawful owner of Transfer
Certificate of Title No. T-369306 with an area of Twelve
Thousand Four Hundred Sixty-Seven (12,467) Square
Meters located at Napaccu Grande, Reina Mercedes,
Isabela.
3. To prove the material allegations in the Petition
and to identify documents.

4. This affidavit shall form part of the direct testimony
of Petitioner.
I, REYMUNDO R. BALLESTEROS, of legal age, Filipino,
married and living at 67 Ballesteros Street Barangay Harana,
Luna, Isabela state under oath as follows:
PRELIMINARY STATEMENT
The person examining me is ATTY. CHRISTIAN F.
GONZALES with office address at 2nd Floor Antonio Building
Rizal Avenue District 1, Cauayan City, Isabela. The
examination is being held at the same address. I am
answering his questions fully conscious that I do so under
the oath and may face criminal liability for false testimony
and perjury.
Q1: Please state your name and other personal
circumstances for the record.
A1: I, Reymundo R. Ballesteros, of legal age, Filipino,
married and living at 67 Ballesteros Street Barangay
Harana, Luna, Isabela.
Q2: Are you the same Reymundo R. Ballesteros the
petitioner in this case?
A2: Yes, sir.
Q3: Why did you file this petition?
A3: To cancel the adverse claim that was
annotated/inscribed in my Certificate of Title, sir.
Q4: Do you have with you your Certificate of Title?
A4: Yes sir.
Q5: I will mark this as Exhibit “A” and Exhibit “A-1”,
do you confirm this?
A5: Yes sir.
Q6: Do you have with you a copy of your Deed of
Absolute Sale?
A6: Yes sir.
Q7: I will mark this as Exhibit “B”, do you confirm
this?
A7: Yes sir.

Q8: Who caused the annotation of adverse claim in
your Tax Declaration?
A8: It was the Registry of Deeds of Isabela who caused
the annotation of adverse claim upon the request of
Flora Sibal Vds. De Alvaro, through the filing of an
Affidavit of Adverse Claim.
Q9: Do you have a copy of the Affidavit of Adverse
Claim?
A9: Yes sir.
Q10: I will mark this as Exhibit “A-1-A” do you
confirm this?
A10: Yes sir.
Q11: Do you know the reason/s why Flora Sibal Vds. De
Alvaro, filed an affidavit of adverse claim with the
Registry of Deeds.
A11: I have no idea, sir.
Q12: What do you want the Court to do now?
A12: I pray, Sir, that the adverse claim that was
annotated/inscripted in my Certificate of Title be
cancelled.
Q13: I have no questions for you, are you willing to sign
