State of Texas vs. Michael McMahon

Identifying Information

Mr. Michael McMahon was convicted of Possession of Cocaine on December 4,2023 sentenced
to two years in prison, suspended to two years' probation, with an additional $500 fine. This
sentence commenced on December 14,2024.
Violation Information

I am writing to inform the court of multiple violations of Mr. McMahon's probation conditions
observed during the past 4 weeks. These violations raise serious concerns about his commitment
to successful rehabilitation and adherence to the court's orders.

Special Conditions Violated

Payment of Fine: As of today, Mr. McMahon has only paid $30 of the $500 fine, falling
significantly behind the approved installment schedule. He has provided no explanation for this
delinquency, despite repeated contact attempts from myself, and the court clerk's office.
Drug Treatment Program: Mr. McMahon has missed 4 scheduled appointments at the court-
approved drug treatment program in the past 4 weeks. He has offered inconsistent excuses for
these absences, citing transportation difficulties and work conflicts. However, further
investigation revealed no evidence to support these claims.

Random Drug Testing: Mr. McMahon has failed to appear for 4 out of the 4 scheduled random
drug tests. He initially claimed he was ill after missing a test, but then failed to appear in court
for unknown reasons.

Compliance with Probation Officer: Mr. McMahon has become increasingly unresponsive to my
attempts to contact him. He has missed 4 scheduled in-office meetings and 3 weekly telephone
check-ins without prior notice.

Standard Conditions Violate

Refraining from New Crimes: Mr. McMahon was recently arrested on January 20,2024 for
Burglary of a Habitation. While still awaiting trial, this new charge suggests a significant
departure from his expected behavior on probation.

Recommendations

Based on the severity and pattern of these violations, I recommend the following course of
action:
Immediate Revocation of Probation: Considering the multiple and deliberate violations observed,
continuing probation appears unlikely to provide Mr. McMahon with the necessary structure and
accountability for successful rehabilitation.

Reinstatement of Suspended Sentence: Considering the new criminal charge and repeated
disregard for probationary conditions, I believe reinstating the original two-year prison sentence
is warranted. This response would provide a clear outcome for Mr. McMahon's actions and
encourage him to take his recovery seriously.

Substance Abuse and Mental Health Evaluation: Upon return to custody, I recommend Mr.
McMahon undergo a comprehensive evaluation to assess his current addiction and mental health
needs. This will inform the development of an appropriate treatment plan for his incarceration or
potential supervised release.
Referral for Community-Based Resources: While incarcerated, I suggest connecting Mr.
McMahon with resources available through the prison system and local community
organizations. This could include addiction support groups, vocational training programs, and
housing assistance upon release, to increase his chances of successful reintegration into society.

I understand that returning to incarceration is a significant step, but I believe it is necessary to


address Mr. McMahon's repeated disregard for the court's orders and his own recovery. This
approach prioritizes public safety while offering him the opportunity to receive the support and
structure he needs to overcome his addiction and make positive changes in his life.

Conclusion

Mr. McMahon's recent violations represent a serious breach of his probationary trust. I urge the
court to consider the aforementioned recommendations to ensure accountability for his actions
and provide him with the necessary interventions to address his underlying challenges.
