Bruno, a 21 year old man, met Princess, aged 18 years, in a pub one evening. They sat
in a corner table chatting whilst they drunk their black label lager beers. At about
midnight, after having taken several drinks and being drunk, Bruno asked Princess to
accompany him to his apartment as it was late and she agreed. At the apartment, they
each had some shots of whiskey before retiring to the bedroom to sleep. Princess woke
up in the morning only to discover that she was undressed and had been engaged in
sexual intercourse which she claims had not been consensual as she barely knew
Bruno. She confronted Bruno and they had a heated argument as she accused him of
having raped her whilst he argued that she had consented. Princess has reported to the
police alleging that Bruno raped her and in her police statement says that she could
vaguely recall sexual intercourse having taken place between them but that she was
intoxicated at the time and she would not have permitted him to have intercourse with
her if she had been fully sober. She further claims that Bruno had taken advantage of
her intoxicated state and that she did not therefore believe that she could be said to
have willingly consented.
Bruno has admitted that he had sexual intercourse with Princess during the night but
that she had willingly agreed to follow him to his apartment and willingly got into bed
with him hence being meant to believe that she was consenting to sexual intercourse.
Bruno has been arrested and charged with the offence of rape contrary to the penal
Code Act.
Your law firm has been approached by Bruno to represent him as his defence lawyers
and the firm’s senior partner has tasked you to prepare a legal brief for the defence
challenging the charge.
