SYNOPSIS

1 The applicant is peace loving and law abiding

citizen of India and is residing permanently at

the address mentioned in cause title herein

above. The applicant submits that the

applicant has been arrested by Mahatma

Phule Police Station vide C.R. No. I-548 of

2015 for offence punishable U/s 302, 201,323,

34 of IPC 1860. The applicant has no criminal

antecedent and never come to the adverse

notice of the police prior hereto.

2 Applicant had preferred 2nd bail application at

Exh.24 due to the change in circumstances in

Session case no. 348/2015 and the same was

rejected by the Hon’ble Additional Session

Judge, Kalyan on 25/01/2016.

3 The applicant has preferred an application for

grant of bail before the Hon’ble High Court.

The Hon’ble High Court vide order dated


12/01/2017 was pleased to reject the said bail

application of the present applicant.

4 The applicant had thereafter again preferred

an application for grant of bail before the

Hon’ble High Court. The Hon’ble High Court

vide order dated 21/02/2018 was pleased to

reject the said bail application of the present

applicant.

5 The Hon’ble High had also directed that the

Learned Session Court, Kalyan seizes with

sessions case no.348 of 2015 shall make

endeavour to conclude recording of evidence

as far as possible within one year, however

there is no progress in trial as per directions

issued by this Hon’ble Court.

6 Since there was no progress in trial as per

directions issued by this Hon’ble Court. The

applicant has again filed an application for bail

bearing Criminal Bail Application No. 1633 of 2019

i.e the third bail application before this Hon’ble

Court. The Hon’ble Court vides order dated

15/10/2019 directed to the Hon’ble Sessions

Court, Kalyan shall conclude recording of

evidence by 30th May, 2021.

7 The Hon’ble Sessions Court, Kalyan yet not

concluded and even not a single witness was

examined by the trial Court in pursuance of

order dated 15/10/2019 as passed by this

Hon’ble Court in Criminal Bail Application No.

1633 of 2019. it shows that the trial is likely

to take a long time. The applicant cannot be

kept behind bars for indefinite period. The


applicant is relying the observations of the

Hon’ble Apex Court in the case of Sanjay

Chandra V/s CBI (2012) 1 SCC 40

8 Hence, this fourth bail application under section

439 of Cr.P.C
