A. Background
Government of India has exempted Coal India Limited and its subsidiaries from the applicability of
notification of the Govt. of India, Ministry of Labour and Employment vide no. S.O. 2063 dtd.
21.06.1988 in respect of employment of contract labour in the works specified in the schedule to the
notification, at sl. nos. 1 to 3, for a period of five years subject to the following conditions:

1. The interest of the workmen engaged in the above mentioned jobs to be protected;

2. Such workmen be paid wages and other benefits as the recommendations of the high
powered committee appointed by the Coal India Limited, Ministry of Coal, Government of
India and the rates notified by the Coal India Limited on the 13th February, 2013; and

3. The Central Advisory Contract Labour Board will have the right to inspect the establishment
to ensure and check whether such wages and benefits are given to such workers in Coal
India Limited and its subsidiary concerned.

In view of above exemption received by Coal India Limited and the contributions of Contractor
labours in various Mining and Non-Mining activities of the company, being the principal employer, it
is our prime responsibility to ensure compliances of above conditions, various provisions under the
Contract Labour (Regulation & Abolition) Act 1970 & Contract Labour (Regulation & Abolition) Rules
1971 and various Acts/Rules/Schemes applicable in case of engagement of contractor labours.

Following recent amendments have been incorporated in the obligations/formats:

1. The Labour Laws (Exemption from furnishing returns and maintaining registers by certain
establishments) Amendment Act, 2014 [published on 10.12.2014]
2. The Ease of Compliance to maintain Registers under various Labour Laws Rules, 2017 [GSR
154(E) dtd. 21.02.2017]
3. The Rationalisation of Forms and Reports under Certain Labour Laws Rules, 2017 [GSR
294(E) dtd. 28.03.2017]
4. The Contract Labour (Regulation & Abolition) Central Amendment Rules, 2017 [GSR 1128(E)
dtd. 05.09.2017]

B. Obligations of Principal Employer


B1. Obligations under CL(R&A) Act 1970 & CL(R&A) Rules 1971
Applicability:

a. To every establishment in which twenty or more workmen are employed or were employed
on any day of the preceding twelve months as contract labour.

b. To every contractor who employs or who employed on any day of the preceding twelve
months twenty or more workmen

1 Registration of Establishment [Sec. 7(1) & Rule 17(1)]
Every principal employer of an establishment to which the Act is
applicable shall make an application to the registering authority.
Moreover, the Principal Employer must send the details of amendment of
the certificate of registration periodically.
Form I

“Certificate of Registration of Principal Employer” is given by


Registering Officer as per “Form I annexed to the Rationalisation of
Forms and Reports under Certain Labour Law Rules, 2017”

2 Amendment of Certificate of Registration [Rule 18(4)]


If there is any change in the particulars specified in the certificate of
registration, the principal employer of the establishment shall intimate to

the registering officer, within 30 days from the date when such change
takes place, the particulars of, and the reasons for, such change.

To issue “Form of Certificate by Principal Employer” to Contractors (to

attach along with application for Licence) [Rule 21(2)]
Every application (by contractors) for the grant of licence shall be
accompanied by a certificate by the principal employer in “Form III
annexed to the Rationalisation of Forms and Reports under Certain Form III

4 To submit “Notice of commencement/completion work” [Rule 81 (3)]


Every principal employer shall, within fifteen days of the commencement
or completion of each contract work under each contractor, submit a Form VII
return to the Inspector, appointed under Section 28 of the Act, intimating (Rationalisation of

the actual dates of the commencement or, as the case may be,

5 To maintain Register of Contractors [Rule 74]


Every principal employer shall maintain in respect of each registered

6 To submit Annual Return [Rule 82(2)]


Form I
Every principal employer of a registered establishment shall send (The Labour Laws

Shram Suvidha Portal

Ministry of Labour & Employment, Government of India has launched unified Shram Suvidha
(श्रम सु विधा) Portal (https://shramsuvidha.gov.in/), a one-stop-shop for labour law
compliance, to facilitate reporting of Inspections, and submission of Returns. The Unified
Shram Suvidha Portal has been envisaged as a single point of contact between employer,
employee and enforcement agencies bringing in transparency in their day-to-day
interactions. For integration of data among various enforcement agencies, each inspect-
able unit under any Labour Law has been assigned one Labour Identification Number (LIN).
All Principal Employers are required to submit the Unified Annual Return under various
Labour Laws as under:

1. Create a Shram Suvidha Account in the portal in respect of each establishment


2. Check the details of existing LIN nos. and correct the details, if any, in the portal by
getting in touch with the respective controlling authority
3. If the name of unit is not present in the list enclosed, register the unit to generate LIN
no. The same may be communicated to this office for record purpose
4. Submission of Online Annual Return under CL (R&A) Act and CL (R&A) Rules (and
other applicable Labour Laws)

7 Welfare and Health of Contract Labours (Sec. 16, 17, 18, 19)
If any amenity required to be provided under following Sections/Rules for the benefit of the
contract labour employed in an establishment is not provided by the contractor, such
amenity shall be provided by the principal employer:
 Section 16/Rule 42-50 (canteen),
 Sec. 17/Rule 41 (rest-room),
 Sec. 18/Rule 51-57 (drinking water, latrine, urinal, washing facility),
 Sec. 19/Rule 58-62 (first aid facility)

All expenses incurred by the principal employer in providing the amenity may be recovered
from the contractor either by deduction from any amount payable to the contractor under
any contract or as a debt payable to the contractor.

8 Ensuring the contractor complies with various provisions under the Act/Rule
Payment of proper Wages [Rule 63-71]

As per GSR 1128 (E) of Ministry of Labour & Employment, GOI dated 05.09.2017 – Contract
Labour (Regulation and Abolition) Central Amendment Rules, 2017:
Provided that the appropriate Government may, by notification in the Official Gazette,
specify the establishment or class of establishments, the employer of which shall pay
to every workman employed in such establishment or class of establishments, the
wages only by cheque or by crediting the wages in his bank account.

B3. Other Obligations

3 Contract Labour Information Portal (CLIP)


Coal India Limited has launched CLIP for the purpose of monitoring various compliances
related to contractor workers and proper contract labour management. Principal employers
should ensure registration of contractor in CLIP and periodical updation of following
information:

1. LOI / Work Order details


2. Registration and updation of complete personal details of contractor workers
3. Work order wise details of wages payment to contractor workers

CLIP has the facility to generate employment card and wages slip by the contractors in
respect of their workers.

4 Miscellaneous
Ensuring various compliances under the CL(R&A) Act and Rules, other Acts/Schemes
applicable in respect of contractor workers

ANNEXURE TO FORM VI

The license is subject to the following conditions:


1. The license shall be non-transferable.
2. The number of workmen employed as contract labour in the establishment shall not, on any day,
exceed the maximum number specified in the licence.
3. Except as provided in the rules, the fees paid for the grant, or as the case may be, for renewal of
the license shall be non-refundable.
4. The rates of wages payable to the workmen by the contractor shall not be less than the rates
prescribed for in the Schedule of employment under the Minimum Wages Act, 1948 (11 of
1948), where applicable and where the rates have been fixed by agreement, settlement, award,
or by the appropriate Government, not less than the rates so fixed.
5. A. In cases where the workmen employed by the contractor perform the same or similar kind of
work as the workmen directly employed by the principal employer of the establishment, the
wage rates, holidays, hours of work and other conditions of service of the workmen of the
contractor shall be the same as applicable to the workmen directly employed by the principal
employer of the establishment on the same or similar kind of work; provided that in the case of
any disagreement with regard to the type of work the same shall be decided by the Deputy Chief
Labour Commissioner (Central), whose decision shall be final.
B. In other cases the wage rates, holidays, hours of work and conditions of service of the
workmen of the contractor shall be such as may be specified in this behalf by the Deputy Chief
Labour Commissioner (Central).
6. Every contract labour shall be entitled to allowances, benefits, facilities, etc. as prescribed in the
Contract Labour (Regulation and Abolition) Act, 1970 (37 of 1970) and rules made thereunder.
7. In every establishment where 20 or more women are ordinarily employed as contract labour,
there shall be provided two rooms of reasonable dimensions for the use of their children under
the age of six years. One of such rooms would be used as a play-room for the children and the
other as bed-room for the children. For this purpose the contractor shall supply adequate
number of toys and games in the play-room and sufficient number of cots and beddings in the
sleeping-room. The standard of construction and maintenance of the crèches may be such as
may be specified in this behalf by the Deputy Chief Labour Commissioner, (Central).
8. No women shall be employed by any contractor before 6 am or after 7 pm.
Provided that this clause shall not apply to the employment of women in pit head baths, creches
and canteens and as mid-wives and nurses in hospitals and dispensaries.
9. The licensee shall notify any change in the number of workmen or the conditions of work to the
Licensing Officer.
10. A copy of license shall be displayed prominently at the premises where the contract work is
being carried on.
11. The contractor shall comply with all the provisions of the Act and these Rules.
12. The licensee shall, within 15 days of the commencement and completion of each contract work,
submit a return to the Inspector appointed under Section 28 of the Contract Labour (Regulation
& Abolition) Act, 1970 (37 of 1970) intimating the actual date of commencement or, as the case
may be, completion of such contract work in Form VII.

 In the menu on right side, click on “ADMINISTRATOR SIGN IN”
 Enter Login details and click on SUBMIT
(Please contact your APM or Contract Labour Management Cell, SECL HQ for login details)
2 CHANGE OF PASSWORD
 Login into the portal (as per steps at 1 above)
 In the menu on left side, click on “PROFILE”
 Click on “CHANGE PASSWORD”
 Enter new password and enter SUBMIT
3 CHECKING CUIN NO. FROM LIST OF APPROVED CONTRACTORS
 Login into the portal (as per steps at 1 above)
 In the menu on left side, click on “CONTRACTOR [APPROVED]”
 The page will show details of all registered contractors
 Search for the desired contractor’s name, etc. and check the CUIN
4 WORK-ORDER APPROVAL
 Login into the portal (as per steps at 1 above)
 In the menu on left side, click on “WORK ORDER APPROVAL”
 The page will show details of all work orders pending for approval
(Area Nodal Officer can see work-orders in respect of her/his Area)
 Click on “APPROVE” button at the last column (work order will be visible under wages tab of
contractor’s login after approval)
5 CHECKING LIST OF APPROVED WORK-ORDERS
 Login into the portal (as per steps at 1 above)
 In the menu on left side, click on “WORK ORDER [APPROVED]”
 The page will show list of all approved work orders
6 ENTERING EXTENSION DETAILS OF WORK-ORDERS
 Login into the portal (as per steps at 1 above)
 In the menu on left side, click on “WORK ORDER [EDIT/DELETE]”
 The page will show list of all approved work orders
 Search for the desired work order and click on EDIT button at the last column
 A new pop up window will come with details of selected Work Order
 Enter DATE OF EXTENSION and new DATE OF COMPLETION and click on SUBMIT

 Wages sheet (in MS excel format) for the selected contractor, work-order, month & year shall

8 ENTERING DATE OF WAGES PAYMENT (FREEZING OF WAGES DETAILS)


THIS OPTION HAS TO BE ADMINISTERED BY UNIT/SUB AREA/AREA NODAL OFFICER TO ENTER THE
DATE OF WAGES PAYMENT AND DATE OF DEPOSIT OF CMPF CONTRIBUTION IN RESPECT OF ANY
WORK ORDER FOR ANY MONTH (WAGE PERIOD) UPON RECEIVING THE PROOF.
ONCE THE ABOVE DATES ARE ENTERED BY ADMINISTRATOR LOGIN, THE WAGES DETAILS SHALL
BE FROZEN IN CLIP AND BECOMES UNEDITABLE.

 Login into the portal (as per steps at 1 above)


 In the menu on left side, click on “WORKMAN WAGES PAYMENT”
 Enter the name of contractor (AUTO FILL option has been provided)
 The next tab will show drop-down list of all approved work-orders of the selected contractor
 Select the desired work-order from the drop-down list & select Month and Year
 Click on “GET PAYMENT DETAILS” & click on “DISPLAY WAGE DETAILS”
 Enter “BANK DEPOSIT DATE” and “PF DEPOSIT DATE” and click on SUBMIT
9 CHECKING LIST OF ADMIN LOGINS
 Login into the portal (as per steps at 1 above)
 In the menu on left side, click on “USER MANAGEMENT”

 Click on “PASSWORD RESET” to reset the password of login to default password
10 CREATING NEW ADMINISTRATOR LOGIN FOR AREA HQ/SUB AREA/UNIT/ETC.
 Login into the portal (as per steps at 1 above)
 In the menu on left side, click on “NEW ADMIN”
 The page will show a drop-down list of all Sub Areas/Units of the Area
 Select any “UNIT” from the list and enter LOGIN ID in the next tab
 Click on ADD (the new administrator login shall be created with username and password as entered)
NOTE
Please create new admin login with proper name like AREA-CODE_UNIT-NAME, HSD_BPM, etc.
11 REPORTS (MIS)
This feature has been provided to download various kinds of reports(in PDF or MS EXCEL format)
viz. list of all & approved work orders, location details of work orders, list of engaged workmen, etc.
 Login into the portal (as per steps at 1 above)
 In the menu on left side, click on any of the following options under “REPORTS”

 Click on REPORT PDF or REPORT EXCEL to download the selected report in the format
12 PREPARING SUMMARY OF WORK-ORDERS FOR WHICH WAGES ARE UPLOADED

 In the tab “OUR PEOPLE”, click on “CLIP” (@ menu bar below CIL Logo)
(this will take you to Home Page of Contract Labour Information Portal)
 At the Menu on Right Side Top, click on “PUBLIC INFORMATION”
 Select “COMPANY”, “MONTH” and “YEAR” from the drop-down lists, and enter GO
 Copy the details in an excel sheet
 Count the no. of work orders for which wages details have been entered
 Calculate the sum of workmen for which wages details have been entered

SL DETAILS
1 CONTRACTOR REGISTRATION (ONE TIME PROCESS ONLY)
 Open http://www.coalindia.in
 In the tab “OUR PEOPLE”, click on “CLIP” (@ menu bar below CIL Logo)
(this will take you to Home Page of Contract Labour Information Portal)
 At the Menu on Right Side Top, click on “CONTRACTOR REGISTRATION”
 Complete all the Personal Details of Contractor and enter SUBMIT
(Name of Contractor, Name of Firm, PAN Card No., Contact Details, Aadhar No. of proprietor,
any running Work Order) (The information provided will not be in public domain)
(Company Nodal Officer will approve the registration, after which contractor will get login details in SMS)
2 LOGIN INTO PORTAL BY CONTRACTOR
 Open http://www.coalindia.in, in the tab “OUR PEOPLE”, click on “CLIP”
 In the menu on right side, click on “CONTRACTOR SIGN IN”
 Enter Login details as received through SMS and login
(6 digit CUIN No. would be both username and password. Password can be changed after login)
3 CHANGE OF PASSWORD
 Login into the portal (as per steps at 2 above)
 In the menu on left side, click on “PROFILE”, Click on “CHANGE PASSWORD”
 Enter new password and enter SUBMIT
4 CHANGE OF PROFILE DETAILS
 Login into the portal (as per steps at 2 above)
 In the menu on left side, click on “PROFILE”
 You may change Permannent Address, Present Address, Mobile No, Email ID
 After entering the changed details, press SAVE CHANGES
5 ADDITION OF WORKMEN DETAILS (DETAILS OF ALL EMPLOYEES TO BE ENTERED)
 Login into the portal (as per steps at 2 above)
 In the menu on left side, click on “WORKMAN DETAILS (ACTIVE)”
 The page will show details of all registered active workmen
 At the bottom of the page, click on “ADD EMPLOYEE”
 Enter all the details of contractor worker and enter SUBMIT (AADHAR NO., BANK ACCOUNT
NO., PF ACCOUNT NO., ETC. ARE MANDATORY)
(Bio Data of contract labours must be entered correctly – Name, Surname, Father’s Name, DOB, Gender,
Designation, Type of Contractor {HPC/DGR/Min. Wages/NCWA/Others}, Category {Unskilled/Unskilled
Supervisor/Semi-Skilled/Skilled/Highly Skilled}, Work Order, Address, Mobile No., Email ID, PAN No., Aadhar
No., applicability & percentage of UG Allow./Pension/Bonus/Attendance Bonus/PF/etc., Bank A/c No., etc.)
6 TERMINATION OF WORKMEN PROFILE
 Login into the portal (as per steps at 2 above)
 In the menu on left side, click on “WORKMAN DETAILS (ACTIVE)”
 The page will show details of all registered workmen
 Click in the button in front of name of workman, whose name is to be deleted
 At the bottom of the page, enter “DATE OF TERMINATION” & “REASON FOR TERMINATION”
and enter SUBMIT
 This profile would be visible under “WORKMAN DETAILS (TERMINATED)” after selected date

7 PHOTO UPLOAD OF CONTRACTOR WORKER


 Login into the portal (as per steps at 2 above)
 In the menu on left side, click on “PHOTO UPLOAD”
 The page will show details of all registered workmen
 Click on the ID no. of workman, whose photograpgh is to be uploaded
 Click on “CHOOSE FILE” and browse for the photograpgh in the computer, and enter SUBMIT
8 ADDITION OF WORK-ORDER DETAILS (ALL RUNNING WORK-ORDERS TO BE ENTERED)
 Login into the portal (as per steps at 2 above)
 In the menu on left side, click on “WORK ORDER”
 The page will show details of all registered work orders
 At the bottom of the page, click on “CREATE NEW ORDER”
 Enter the details of all running work orders and enter SUBMIT
(Work Order/LOI No. & Date, Name of Work, Establishment of Work, Date of commencement &
completion, Issuing Authority, Labour License, Name & Address of Principal Employer, Contract
Main Type, Contract Sub Type)
(IMPORTANT – ALL LOCATIONS OF WORK MUST BE SELECTED FROM THE DROP DOWN LIST AT
THE BOTTOM. MULTIPLE LOCATIONS CAN BE SELECTED)
(Area Nodal Officer will approve the work order)
9 TAGGING NAMES OF CONTRACTOR WORKERS AGAINST WORK-ORDER
 Login into the portal (as per steps at 2 above)
 In the menu on left side, click on “WORKMAN V/S WORK-ORDER”
 The page will show a drop-down list of all registered work orders
 Select any “WORK ORDER” from the list and enter GO
 Select the names of all workers to be tagged to the selected work order (check box at last
column) and enter SAVE
 Repeat for all work orders (the names of selected contractor workers shall be tagged against the work-order)
10 SHIFTING NAME OF CONTRACTOR WORKER FROM ONE WORK-ORDER TO OTHER
 Login into the portal (as per steps at 2 above)
 In the menu on left side, click on “CHANGE WORKMAN V/S WORK-ORDER”
 The page will show two drop-down lists, both showing all registered work orders
 Select “OLD WORK ORDER” from where worker’s name is to be moved and “NEW WORK
ORDER” where the name is to be shifted, and enter GO
 Select the names of all workers to be moved from old to new work order (check box at last
column) and enter SAVE
(the names of selected contractor workers shall be tagged against the new work-order)
11 ENTERING WAGES DETAILS OF CONTRACTOR WORKERS
 Login into the portal (as per steps at 2 above)
 In the menu on left side, click on “WAGES-NEW”
 The page will show a drop-down list of all registered work orders along with Month/Year
 Select the “MONTH” & “YEAR” for which wages details are to be entered and select the any
“WORK ORDER“ from the list and enter GO
 The page will show list of workmen
 Enter the attendance details (No. of days present) of all contractor workers and enter SAVE
(The system will calculate various components and net amount)
 Option of downloading of wages sheet is available at the bottom of the page.
 Repeat for all work orders
