Important Disclaimers:
• This table is designed to provide driver license examiners/agents with documents required to PROVE
LEGAL PRESENCE ONLY. For proof of identity, see section IR09 of the Driver License Operations Manual.
• This table is constantly changing. If you print the table, make sure you are using the most recent version.
This can be done by comparing the revision date of your printed copy with the revision date of the table
posted on the intranet site.
• Immigrants are required to provide proof of legal presence for original transactions and/or to meet Florida
statute requirements (Incorporating provisions of REAL ID Act).
• Non-Immigrants are required to provide proof of identity and legal presence on every issuance
transaction.
Issuance Terms:
• Eligibility requirements for length of DL/ID issuance:
o U.S. Citizens and Immigrants
▪ Customers who are 79 years of age and under will be issued an eight-year license or ID card.
▪ Customers who are 80 and older will receive a six-year license or ID card.
▪ Customers who are five to 14 years old will receive a four-year ID card.
o Non-Immigrants
▪ Customers will be issued a license or ID card through the date they are legally entitled to be present
in the United States (the expiration date on the legal presence documents), not to exceed four
years from date of issuance.
▪ If the customer’s immigration documents do not have an expiration date, then the expiration date
of the credential shall not exceed one year.
o Non-Immigrants - Canadian Citizens
▪ Persons providing a Canadian citizenship document as proof of legal presence will be issued a one-
year driver license or ID card.
▪ Canadians providing United States Citizenship and Immigration Services (USCIS) documents as
proof of legal presence will be issued through the date they are legally entitled to be present in the
United States (the expiration date on the legal presence documents), not to exceed four years from
date of issuance.
▪ If the customer’s immigration documents do not have an expiration date, then the expiration date
of the credential shall not exceed one year.

• I-551 / I-151 cards containing the applicant’s baby photo are acceptable. However, inform the customer
that they should obtain a new card. These documents can be used for legal presence only. The customer
must show a separate document, such as a passport, for identity purposes.
• An expired I-551/I-151 Permanent Resident Card may be used for driver license/identification card
issuance as long as the customer’s immigrant status verifies through the VLS system.

Description
This form is used to apply for a replacement I-551, when there is a name change, lost/stolen card,
renewing an expired I-551, etc.
To issue with an I-90, a customer’s Immigrant Status must verify through VLS.
This form is NOT used for an applicant with a conditional resident card to remove conditional
status.

Description
This form is used by persons who were issued a conditional resident (I-551) card for two years due to marriage
to a United States Citizen (USC). The I-829 is used to remove the conditions for an E-5 investor. The I-751,
when approved, will extend the validity of the I- 551 for 10 years.

• The I-751 can be submitted even after the conditional resident card has expired.

• The hearing date must be a future date from the date of application for a driver license or identification
card.
• Notice of Hearing can be taken as evidence for issuance if verification has been made with the
immigration court by calling the Immigration Court line at: 1-800-898-7180. Press option 1 to verify that
there is a future court date or option 3 to hear the court’s decision. Another verification option is to check
the Executive Office for Immigration Review (EOIR) website at https://acis.eoir.justice.gov and enter the
alien number. If the future hearing date or case pending status cannot be verified by calling the court
line, or checking the EOIR website, refuse issuance and advise the customer that the future hearing date

Description
Notice of Hearing for Cancellation of Removal Proceedings (COR)
Required Documents
When COR is for Lawful Permanent Resident (LPR)
• Ask for Notice of Hearing (NOH).
• Ask for Alien Registration Number (A#) and request Document Validation Unit (DVU) confirmation that A#
is confirmed as LPR by Homeland Security (DHS). If A # is not confirmed, deny issuance.
Comments
• The hearing date must be at least 60 days after the date of application for license or identification card.
• When COR is for a Non-immigrant (filing an EOIR 42B) see Cancellation of Removal Proceedings in the
Non-Immigrant Section.
Description
This could be from an Immigration Judges Order (IJO) or USCIS through an I-797 Notice of Action.
Required Documents
• Wording should clearly state Application for Asylum is granted.
• They must have an Alien Registration Number (A#).
Comments
• Once an asylum applicant is granted asylum, and the applicant’s spouse and/or unmarried children
under the age of 21 come into the country with a valid passport, it will be stamped as “Admitted as an
Asylee”. This means they are also fully granted an asylum status even on the date of entry.
Refugee
Description
All refugees will have an alien registration number (A#) and have a valid passport and/or I-94.

Comments
• This could be an I-797 or some other form from USCIS.
• The applicant’s spouse and/or unmarried children under the age of 21 come into the country with a valid
passport; it will be stamped as “Admitted as a Refugee” or similar words indicating the same. This means
they are also fully granted refugee status even on the date of entry.
• All refugees will be treated as lawful permanent residence for license or identification card issuance
purposes.
Description
Issued by the U.S. Department of Health to children released to sponsors while seeking lawful presence status
in the U.S.
The office of Refugee Resettlement (ORR) Verification of Release Form is issued by the U.S. Department of
Health and Human Services. It is evidence that the minor child was released to a sponsor while properly filing
for immigration status. However, the document itself does not confer an immigration status based on
confirmation from the Office of Refugee Resettlement in Washington D.C.

I-766
Description
Employment Authorization Document (EAD)
Required Documents
• Valid I-766
Note: If a customer presents a post-completion EAD card, the 60-day grace period should be added to the
expiration date of the document for issuance.
Comments
• If the EAD card is expired, a license or identification card can only be issued if the customer provides a
receipt notice (I-797 for I-765) showing they applied for an EAD renewal prior to the EAD card expiring.
Description
Border Crossing card
Required Documents
• Valid Border Crossing Card (BCC) only if accompanied by an I-94
Comments
• The Border Crossing Card is issued for the purpose of temporarily crossing over the Mexican border to the
United States for business or pleasure. It cannot be taken alone. It must be accompanied by an I-94. Length
of lawful presence stay in the United States is determined by the I-94, not the Border Crossing Card.

etc., ask for employment letter from petitioner. If petitioner and beneficiary are the same, refer to
Document Validation Unit (DVU). If different from self, ask for employment letter.
Comments
• I-94 will sometimes be printed on the bottom of the I-797 for I-129 when the status is extended. The I-94
section from the bottom of the I-797 can be used by itself without the top of the I-797 or the passport.
• For all self-filers employing themselves, scan documents and send to DVU for verification.
• Application for extension of stay will be accepted if made prior to expiration date. If applicant is extending
status with the same employer, an employer letter is not needed.
• If the customer is changing status from a non-work authorized nonimmigrant status to a work-
authorized nonimmigrant status, an SSN or pending I-765 applying for work authorization is also
required.

Required Documents
• Evidence of petitioner’s status and
• Valid Passport and I-94 (I-94 may be expired) or
• DHS evidence of date of entry and duration of legal status and
• Documents showing relationship between petitioner and beneficiary such as:
o Marriage Certificate for spouse.
o Birth Certificate for siblings indicating same parents.
o Birth Certificate proving child parent relationship.
o Adoption papers when applicable.
• An I-485 receipt notice is required on a pending I-130 when it is an immediate relative of U.S. citizens.
Comments
• The I-94 or date of entry document may be expired if the I-130 was filed while in status.
• I-130 for immediate relatives may be over three years old (immediate relatives are spouse, parents, and
unmarried minor children under 21 years old of USC only).
• I-130 for all other eligible relatives must be less than three years old to be accepted.
Eligible relatives of US Citizens include- unmarried children 21 years or older- married son or daughter any
age - Your brother or sister (petitioner must be 21 or older).
Eligible relatives of Lawful Permanent Residents include – Spouse and unmarried children.
Immediate relatives who entered the United States legally and present a valid Passport, I-94 (may be expired)
and a pending application for both the I-130 and I-485 can be issued a license or ID card, even if they did not
file the I-130 and I-485 while in status.
In cases where the client may be in removal proceedings for an earlier application but has since become an
immediate relative, an I-485 will not be necessary since the applicant can only file this when the I-130 is
approved. The DL/ID can be issued based on the I-797 for the I-130 and the proof of the relationship as an
immediate relative.
Example- customer presents a valid Passport and I-94 from Brazil, entered as a visitor (B2) on 12-10-2006, is
now an overstay, married a US citizen and files the I-130 and I-485, customer can be issued a license or ID card
with these two pending applications even though she did not file these forms while in status. Accept even if
both applications have been filed separately. They do not have to be filed at the same time. This is allowed
because she married a US citizen, which now makes her an immediate relative and came into the US legally.

2. I-797-for I-130 Approved - Immigrant Petition for Relatives or Orphan
Required Documents
• Evidence of petitioner’s status and
• Valid Passport and I-94 (I-94 may be expired) or
• DHS evidence of date of entry and duration of legal status and
• I-797 for I-130 and I-485 (documents will be accepted even if the forms were not filed while in status)

I-797 must be within three years of DL application. I-140 must have been applied for while in legal
status.
For all self-filers employing themselves, scan documents and send to DVU for verification.
Family member names must be listed on page four of the I-140 application for the family members to
be eligible for a license.
Comments
• Per Section 245(k) of the INA, some Preference Classifications under the employment-based I-140 can
concurrently file the pending I-140 and the pending I-485 if visas are available (i.e., foreign nationals with
extra abilities). These categories will be listed in the PREFERENCE CLASSIFICATION section on the I-140. If
visas are available, current legal status would be 180 days after the expiration date of the I-94. For visa
availability, check the visa bulletin link below or call DVU for assistance.
• Employment based preferences are listed on the Department of State website at

cannot be filed, customers may show other valid non-immigrant status such as a valid Employment
Authorization Document (EAD), approved H1B or an application for H1B, or I-797 for I-129 while in status.
Comments
• Marriage certificates for spouses not listed on the approved I-797 for the I-140 can be used to show
relationship to the beneficiary of the approved I-140.
Description
1. Battered Spouse of Lawful Permanent Resident (LPR) or United States Citizen (USC)

• I-797 for I-360 approved or
• I-797 for an I-360 pending must state “Prima Facie Case” has been established or
• The I-797 for the I-360 on letterhead from USCIS stating “Prima Facie Case”

If a Minister, Certificate of Ordination in the denomination;
• The certificate must be over two years old.
• Must present valid passport and I-94 to indicate lawful entry.
• Filing of I-360 must be dated when I-94 was still valid.
• The I-797 for the I-360 can also be on USCIS letterhead.
If not a Minister, then they must show documents showing they are a member in the denomination for at least
two years (These documents would have been presented with the application).

Required Documents
• Copy of spouse’s death certificate–death within two years of filing.
• Copy of evidence that spouse was a US citizen such as spouse’s birth certificate, valid passport,
Naturalization Certificate, etc.
• Copy of Marriage Certificate to citizen spouse.
• The I-797 for the I-360 can also be on USCIS letterhead.

Description
1. Application for adjustment of status to Lawful Permanent Resident
Required Documents
• Valid passport or other acceptable USCIS document
• I-797 showing approved I-130 (along with supporting documentation, see “I-797 for I-130 Approved”
section) or approved I-140. See comments section below for exception to the approved I-130/I-140
requirement.
Comments
• The I-485 is a form used to file for adjustment of status to a Lawful Permanent Resident (immigrant). In
most cases, customers will have to show the approved I-797 for the I-130 or I-140, along with the pending
I-797 for the I-485. However, there are exceptions to this requirement. Some immigration classifications
are not required to show the approved I-797 for the I-130 or I-140 before filing the I-797 for the I-485. In
these cases, however, the customer must still provide immigration documents to show the prior approved
immigration status held before filing for the I-797 for the I-485. Some examples of immigration
classifications that do not require the approved I-797 for the I-130 or I-140 when filing the pending I-485
are as follows:
o Asylees
o Refugees
o K-1 classification (Fiancée of U.S. Citizen)
o Humanitarian I-797 petitions such as the I-360, i.e., Violence Against Women Act (VAWA) or
o Any other documents showing that the applicant’s prior approved immigration classification allows
filing for adjustment of status without the approved I-130 or the I-140.
• An I-797 receipt notice for the I-485 cannot be taken alone. It must be accompanied by the approved I-
130/140 or evidence of a prior approved immigration classification which does not require presenting the
approved I-130 or I-140.
• Before turning away customers for the above requirements, please call the Document Validation Unit for
clarification if there are questions.
• An approved I-485 welcome letter establishes immigrant status providing the immigrant status is
confirmed in VLS.
Description
2. Application for Adjustment of Status to Lawful Permanent Resident for Cuban nationals under the
Cuban Adjustment Act
Required Documents
• Proof of Cuban Nationality (i.e., valid Cuban passport or Cuban birth certification)
• Proof of primary identification per REAL ID requirements.
• Evidence of being inspected and admitted or paroled into the United States after January 1, 1959 ( i.e., I-
94 or parole stamp).
• Pending I-485
Comments
• Proof of Cuban nationality is required when presenting an I-797 for I-485 / Application for Adjustment of
Status to Lawful Permanent Resident for Cuban nationals under the Cuban Adjustment Act but does not
serve as proof of identity unless it’s an unexpired Cuban passport.
• The Cuban Adjustment Act allows all Cubans who are eligible to file I-485 for LPR status (the approved I-
130 or I-140 is not required).
• Only Cubans who are not yet U.S. citizens are eligible for benefits under the Cuban Adjustment Act.
o Spouses and Unmarried Children of Cubans can file an I-485 without an I-130/I-140 under the Cuban
Adjustment Act.
o Relatives of Cubans with U.S. citizenship must file an I-130/I-485.
o An I-485 approved under the Cuban Adjustment Act establishes immigrant status providing the
immigrant status is verified in VLS.
Description
This form is used by an entrepreneur to petition USCIS for status as an immigrant to the United States under
section 203(b)(5) of the Immigration and Nationality Act, as amended. Under the EB-5 investor program,
entrepreneurs (and their spouses and unmarried children under 21) are eligible to apply for a green card
(permanent residence).

• Valid Passport and I-94 (I-94 may be expired) or
• DHS evidence of date of entry and duration of legal status and
• Documents showing relationship between petitioner and beneficiary such as:
o Marriage Certificate for spouse.
o Birth Certificate for siblings indicating same parents.
o Birth Certificate proving child parent relationship.
o Adoption papers when applicable.
Comments
• When an approved I-797 for the I-526 and a pending I-485 is presented for issuance, no I-130 or I-140 is
required.
• To issue, I-526 must be approved.
• If the pending I-485 is not presented, deny issuance.

• If the customer is changing from a non-work authorized nonimmigrant status to a work-authorized

Comments
• The blue half-sheet is also acceptable as an I-589 receipt notice for issuance.
• If the customer has been granted asylee status, they are categorized as an immigrant.
Description
This form may be used by certain immediate relatives of U.S. citizens to request a provisional waiver of the
unlawful presence grounds of inadmissibility under section 212(a)(9)(B) of the Immigration and Nationality
Act (INA), prior to departing the United States to appear at a U.S. Embassy or consulate for an immigrant visa
interview.

• For Valid/expired Employment Authorization Document (EAD) with I-797 for I-765 indicating application
prior to expiration of EAD or

of an I-94 or other USCIS-approved document must be presented.
Description
Application for Temporary Protected Status (TPS)
This application can only be made for countries designated by Secretary of DHS. To process, see TPS in the
Non-Immigrant section.

Required Documents
• I-797 for an I-914 or
• I-797 for an I-914 ASC Fingerprint Notice with stamp indicating date when fingerprinted
• Documents must have an Alien Registration Number (A#)
Optional Documents
• I-797 for an I-914 Supplement B (This is optional and only if available)
Important
The I-797 for I-914 receipt notice can be accepted for issuance of DL/ID until such time that a customer can
produce an I-797 for I-914 indicating approval.
Comments
• This form is used by victims of human trafficking who have suffered abuse. Lawful entry is not required.
Many may receive their passports after entry and when filing for I-914. (Annually only 1100-1300 cases are
filed nationally. Hence large volumes in our offices should be brought to our attention. Florida processes
fewer than 50 in a year.)

Description
The Form I-290B, Notice of Appeal or Motion, is used to file an appeal or motion to reopen or reconsider on
any denial decision under the immigrations laws over which the Board of Immigration Appeals (BIA) does not
have appellate jurisdiction. The appeal or motion must be filed with the U. S. Citizenship and Immigration
Services (USCIS). It may be used when: 1) to file an appeal with the Administrative Appeals Office (AAO); 2)
to file a motion to reconsider a decision of USCIS; 3) to file a motion to reopen a decision of USCIS; or 4) to file
a motion to reopen a decision OF USCIS, including decisions under the Northwest immigrant Rights Project
(NWIRP) Settlement, or the Special Immigrant Juvenile (SIJ), or the Perez-Olano Settlement Agreement
(POSA).

Deferred action is a discretionary determination to defer removal action of an individual as an act of
prosecutorial discretion. DACA was rescinded on September 5, 2017. Because of federal court orders on
January 9, 2018 and February 13, 2018, the United States Citizenship and Immigration Services (USCIS) has
resumed accepting requests for renewal (refer to Comments section).

1. Prosecutorial Discretion
Under a new initiative from the DHS, Immigration and Customs Enforcement (ICE) agents, their attorneys and
the Director/Deputy Director of DHS are allowed to use their discretion to close cases and allow applicants
currently in removal proceedings to remain in the country lawfully. This is a two-step process: The
applicant’s attorney and the prosecutors in ICE, etc., jointly file a motion to terminate the removal
proceedings case. Then the motion is heard by an immigration judge and a Final Order is issued. The Final
Order may be approved, granted, or denied.
In all such cases, we can issue the license/ID for one year upon receiving the following documents:
• Original of the Final Order “granting” or “approving” the motion.
Description
2. Administrative Closure
Administrative closure or termination of a removal proceeding case implies that the case has not been proven
by DHS to warrant removal and deportation, and the applicant can remain lawfully in the country. When a
case is administratively terminated, we can issue the license/ID upon receiving the order terminating the
case.

Description
Bearer is a military person invited under North Atlantic Treaty Organization (NATO) rules. He or she will have
no other document, such as an I-94 or valid passport. ITO for IMS with an ID from his/her home country is
sufficient.
ITO is a three-page document with personal details of the bearer. The last item specifies end date of training.
Item 11(e) lists number of days authorized in this country after training. The end date of training, added to
leave days, equals maximum period of DL or ID issuance.

If TPS customers present only Employment Authorization Documents (EAD) with either category code “A12”
or “C19” with the following expiration dates, they will be entitled to the full extension of the relevant TPS
countries. If TPS customers present approval notices for the I-797 for the I-821, they will also be entitled to
the full TPS extension if one of the following expiration dates are on the approval notices. TPS customers in
these scenarios will still have to present valid passports if they have never been issued a driver license or
identification card with our agency. If they do not have valid passports, make sure that they have presented
some type of primary identification (passport or EAD) in the past which was valid for issuance at that time.

Comments

Sudan TPS customers presenting only an EAD or approved I-821 receipt notices with an expiration date
of October 19, 2023, will need to present a recent I-821 receipt to be issued with the new extension date.
• If a TPS customer presents only an EAD Card with the A12 or C19 category code (can be expired), and it
does not include one of the expiration dates listed above, the customer is automatically issued a six month
extension but not to exceed the extended date for that TPS country.
• Some TPS customers may present Employment Authorization Documents (EAD) indicating a country of
birth that is not a TPS country. If the category code A12 or C19 is on the TPS EAD, it is acceptable. To
determine the TPS country and expiration date of the driver license or identification card, the TPS
customer must present the I-821 application for TPS (not the I-797 receipt notice). Page 2 of the I-821
application will list all countries of residence or citizenship/nationality before entering the United
States. Use the TPS country listed on this page of the I-821 application to determine the TPS expiration
date. If TPS customers present other documentation indicating the TPS country under which they were
entitled to file, please call the Document Validation Unit for assistance.
Withholding of Removal
Description
This is petitioned for applicants who lose their eligibility for asylum due to some adverse event, such as a
conviction for a felony.
