Sir / Madam,
1) We are the Promoters of the Housing Complex known as “GAGAN
AVIVA” under implementation on a portion admeasuring 4242.36
sq.mtrs, out All that piece and parcel of land bearing Gat No.
94/1A/4/5/6/Plot No.1 ,94/1A/4/5/6/Plot No.2, 94/1A/4/5/6/Plot No.3 &
94/1A/4/5/6/Plot No.4 respectively admeasuring 3712.06 Sq.mtrs,
1060.59 Sq.mtrs, 530.30 Sq. mtrs and 1888.05 Sq.mtrs (earlier Gat
No 94/1A/4, 94/1A/5 and 94/1A/6) totally admeasuring 7,191 Square
Meters situate, lying and being at Village Kesnand within the
Registration Sub-District of Taluka Haveli, District Pune and within
the extended limits of the Municipal Corporation of Pune.
2) We have procured Registration of the said Project from the
Maharashtra Real Estate Regulatory Authority (“MAHA-RERA”)
bearing No. P52100018060.
3) By an Agreement dated 26-07-2021 [duly Registered under Serial
No. 15898 of 2021 with the Sub-Registrar, Haveli 10, Pune] we
have agreed to sell to you and you have agreed to purchase from us
the Residential Flat bearing No.106 to be situate on the 1st Floor of
Wing “A” of the Building forming part of the said Project known as
“GAGAN AVIVA” at or for the consideration and on the terms and
conditions therein contained. [ Hereinafter referred to as “Said
Project”]

4) In view of the Covid-19 Pandemic Situation declared by the World
Health Organisation and the Government of India imposed
Lockdown in whole India as well as Maharashtra Real Estate
Regulatory Authority, vide its Orders bearing Circular No.13/2020
Dated 02.04.2020 and bearing Circular No.14/2020 Dated
18.05.2020 has declared the period of six months extension to the
project which were previously getting lapse on 28/02/2022. After
Second wave of Covid–19 pandemic started in April 2021
Maharashtra Real Estate Regulatory Authority vide its Order bearing
no. 21/2021 dated 06/08/2021 No. MahaRERA/Secy/File no.
27/157/2021, MahaRERA authority grant the six months extension
upto 28/08/2022.
5) Further the promoter also applied for one year extension due to
force majeure situation aroused due to covid-19 diseases and the
same was duly granted by the Hon’ble MahaRERA authority, hence
the completion date of the said project is now 28/08/2023. The
same aspect is admitted and acknowledged by yourself. Now the
said project extent validates the Registration of the said Project
“GAGAN AVIVA” which is now extended upto 28.08.2023.
6) We Promoter shall also apply to the said Maharashtra Real Estate
Regulatory Authority for additional Six months extension i.e.,
28.02.2024 due to pandemic situation aroused and circumstances
caused hamper to the construction in the said project. Therefore, to
serve our customers best we have decided to extend our RERA
completion date 28.02.2024. The same aspect is well informed in
advance by us to yourself and you have admitted/acknowledge the
extended period.

7) However, for the purpose of wellbeing of Unit holders/customers we
will complete the said Flat and hand over the possession on or
before 28.02.2024 with a “Grace Period” of Three months
thereafter.
8) It is therefore mutually agreed by and between ourselves and
yourselves that we shall be liable to make payment of a sum of Rs.
86,907/- (Rupees EIGHTY SIX THOUSAND NINE HUNDRED AND
SEVEN Only) to you as and by way of mutually agreed
compensation for the said delay in possession as we mentioned
above. The said sum towards Compensation payable by us to you
will be adjusted against the BCC set off against the last instalment/ s
towards the agreed sale / purchase price of the said Flat payable by
you to us.
9) Such compensation shall not be liable to the customers whoever
breach the terms/conditions of the said letter. Otherwise, whoever
receives the possession of fit-out or furniture of their said unit in the
said project on or before 28.02.2024 then in that case the
compensation amount during the period they shall be barred by us
of the customers.
10) It is agreed by yourself that, the Maha RERA extension
previously granted and being taken from Maha RERA authority i.e.
during the period of Six Months, yourself shall not be liable to raise
any Kind of objection, complaints and seek additional compensation
during previous extension period and during the additional period of
one year extension for the delay in possession and further three
months grace periods before any court of law, authority, forum
against us.

11) Kindly sign a copy of this Letter and return the same to us in
token of your having confirmation, Acceptance, Consent,
Acknowledgement and admits the contents hereof.

That, I / we have read the abovementioned contentions and I / we hereby
confirmed, admit, acknowledged and give acceptance/confirmation for the
RERA extension period i.e. during 29-08-2023 to 28-02-2024 (excluding
three months grace period) for the RERA Completion of the said project to
the developer/promoter herein mentioned above.
