REAL STATE MORTGAGE
KNOW ALL MEN BY THESE PRESENTS
This Agreement made and executed and entered into by and between:
ALEXANDER O. AQUINO, Filipino, of legal age, married to DALLIA R. AQUINO and presently
residing at No. 174 Nueva St. San Roque Castillejos Zambales, hereinafter called as the MORTGAGOR;
-And-
MERCY M. GIRON, Filipino, of legal age, married to Rodolfo Giron Jr. and presently residing at
1224-A Clark St. Sta Rita Olongapo City, hereinafter called as the MORTGAGEE;
WITNESSETH THAT:
1. That for and in consideration of the loan of TWO HUNDRED SIXTY THOUSAND (P260,000.00)
PESOS, Philippine currency, which the MORTGAGOR has received from the MORTGAGEE upon the
signing of this agreement and to secure the payment of the same, the MORTGAGOR hereby transfer
and convey by way of Mortgage unto the MORTGAGEE, his heirs, successor and assign a portion of a
parcel of land including all the improvements found thereon consisting of 20 square meters more or less
which is a portion of 480 square meters more or less and located at No. 108 Irving St. East Tapinac,
Olongapo City and covered by Tax Declaration no. AC-00003-004562 (land) Tax Declaration No. AC-
00003-00463 (bldg..) and more particularly bounded as follows:
NORTH: NE-ALN 032 CAD L3922 SOUTH: SW-ALN 047 CAD L3920
EAST: SE-ALN 121 IRVING ST. WEST: NW-DRAINAGE CANAL
2. That the MORTGAGOR shall pay the amount of TWO HUNDRED SIXTY THOUSAND (260,000.00)
PESOS, Philippine currency within (2) years from execution hereof on or until June 23, 2025.
3. That the parties hereby agree on the above-mentioned conditions.
NOW THEREFORE, the MORTGAGORS in consideration of the premises hereby agree to the
following terms and conditions, to wit:
1. Said MORTGAGOR is prohibited to encumber, transfer and/or convey the said property subject of this
Mortgage, to any third person without the prior knowledge and written consent of the MORTGAGEE
while this contract is subsisting and enforceable.
2. The MORTGAGOR has agreed to deliver the possession of the mortgaged property to the
MORTGAGEE and allow the MORTGAGEE to stay and occupy the mortgaged property.
3. The MORTGAGEE can sublease the mortgaged property.
4. That the parties hereby agree that any damage caused by natural events such as typhoon, lightning,
earthquake, wild, flying debris and flood the MORTGAGOR shall be liable for major repairs.
5. Any damage caused by the MORTGAGEE in the above-described property through willful destruction
or negligence by the MORTGAGEE shall be shouldered by the MORTGAGEE.
IN WITNESS WHEREOF, we have hereunto affixed our signatures this 23rd day of June 2023 at
Olongapo City.

AKNOWLEDGMENT
BEFORE ME, a Notary Public for and in the City of Olongapo this 23rd day of June 2023, personally
appeared the above-named parties with their identifications indicated below their names and who represented
to me that their respective signatures on the foregoing instrument were voluntarily affixed by them for the
purposes stated in the instrument and who declared that they have executed the foregoing instrument as their
free and voluntary act and deed.
This instrument refers to Real State Mortgage and consists of two (2) pages including this page in which
this acknowledgment is written, duly signed by the parties and their instrumental witnesses on each and every
page hereof.
