1. An old person consults a doctor and is advised to undergo alternative


health care. The old person is apprehensive and doubtful of health care
option, instead of doing it, old person consulted a quack doctor for a
second opinion.

2. Upon scouting the area, neighbor A identifies a certain plant as a source


of an addictive substance. The area is owned by a rich businessman in the
city. Neighbor A reported the area in the respective authority.

3. A customer bought a whitening lotion in the supermarket. Unfortunately,


upon opening the product is found to be not in good condition. The
customer sends a letter of complaint to the Manager of supermarket
waiting for them to respond and make necessary action.

4. A couple is getting married in a few months. They are required to attend


seminars on family planning and the couple do it.

5. A cashier voluntarily underwent COVID 19 testing. The result shows that


the worker is positive with infection. He/ She reported about it to the
administration. He/ She is now hearing discriminatory remarks from the
co-workers. Apparently, the administrator spread the news of his condition
to the workers.

understand and apply the importance of Health-Related Laws. The scope of this
module permits it to be used in many different learning situations. The language
used recognizes the diverse vocabulary level of students. The lessons are arranged
to follow the standard sequence of the course. But the order in which you read them
can be changed to correspond with the textbook you are now using.

Lesson Health Trends, Issues and
1 Concern

Health Trends, Issues and Concern are issues concerned with the health of
individuals, the provision of health care laws and the operation of the healthcare
system. In this module we can find out the different laws or policies that can be the
guide of everyone’s awareness and safety.

Let us read this module, and attentively answer all the activities and quizzes
so that knowledge and understanding will be input in our minds. And now are you
ready?

Let’s begin!

In every aspect of health or of our life, there are rules that govern the rights
and responsibilities of governments, employees, companies, health professionals,
civil society and country’s population. Laws are used to formalize commitment
goals. People use law to create different organizations and relationships. In turn,
organizations have mandated policies and strategies based on legal rules that guide
their work.

There are also many rules that provide structure on what health organizations
and individuals should follow and what they will not do. This interaction between
different health related laws results in health system function.

The government in its effort to help address these problems has passed a law
to protect the people from hazardous elements. These laws are promulgated to
protect the people and help minimize the increasing problems in population,
environment, tobacco, drugs, diseases, and consumerism that affect the lives of the
people.

For us to be protected, you must read, analyze, and apply your deepest
understanding for the following laws.

Existing National Laws Related to Health Trends, Issues, and Concerns

I. Republic Act 7394 or the Consumer Act of the Philippines


This national policy aimed to protect the interest of the consumers and buyers
of products and services. This also aims to set and maintain standards of conduct

Importance of this Consumer Act Law are the following

1. Consumers are protected against hazards to health and safety.

2. Consumers should be aware against unfair sales, acts, and practices:

3. Provide information and education to the consumers so they can make sound
choices and decision

4. They can enjoy adequate rights and means of redress; and

5. Consumers will be allowed to be represented in the making of social and


economic policies

PROHIBITED ACTS AND PENALTIES


CONSUMER PRODUCT QUALITY AND SAFETY

It shall be unlawful for any person to:

a. manufacture for sale, offer for sale, distribute in commerce, or import into
the Philippines any consumer product which is not in conformity with an
applicable consumer product quality or safety standard promulgated in this
Act.

b. manufacture for sale, offer for sale, distribute in commerce, or import into
the Philippines any consumer product which has been declared as banned
consumer product by a rule in this Act.

c. refuse access to or copying of pertinent records or fail or refuse to permit


entry of or inspection by authorized officers or employees of the department

d. fail to comply with an order issued under Article II relating to notifications of


substantial product hazards and to recall, repair, replacement, or refund of
unsafe products.

e. fail to comply with the rule prohibiting stockpiling.

Any person who shall violate any provision of Article 18 shall upon
conviction, be subject to a fine of not less than one thousand pesos (P1,000.00)
but not more than Ten thousand pesos (P10,000.00) or imprisonment of not less
than two (2) months but not more than one (1) year, or both upon the discretion
of the court. If the offender is an alien, he shall be deported after service of
sentence and payment of fine without further deportation proceedings.

FOOD, DRUGS, COSMETICS AND DEVICES


The following acts and the causing thereof are hereby prohibited:

a. the manufacture, importation, exportation, sale, offering for sale, distribution


or transfer of any food, drug, device, or cosmetic that is adulterated or
mislabeled.

b. the adulteration or misbranding of any food, drug, device or cosmetic.

c. the refusal to permit entry or inspection as authorized by the law

Any person who violates any of the provisions of Article 40 hereof shall, upon
conviction, be subject to imprisonment of not less than one (1) year but not more
than five (5) years, or a fine of not less than five thousand pesos (P5,000.00)
but not more than Ten thousand pesos (P10,000.00), or both such imprisonment
and fine, in the discretion of the Court.

REGULATION OF PRACTICES RELATIVE TO WEIGHTS AND MEASURES
GENERAL PROVISION
Fraudulent Practices Relative to Weights and Measures.

1. Stated in this article the official seal, any alterations, imitation, alterations,
sell or use any false or counterfeit seal, sticker, brand, stamp, tag, certificate
or license or any dye for printing or making the same or any characteristic
sign, reuse any restored, altered, expired, damaged stamp, tag certificate or
license for the purpose of making it appear that the instrument of weight of
measure has been tested, calibrated, sealed, or inspected.

2. Use or maintain with intention to use any scale, balance, weight or measure
that has not been sealed or if previously sealed, the license therefore has
expired and has not been renewed in due time. fraudulently alter any scale,
balance, weight, or measure after it is officially sealed

3. fraudulently misrepresent the weight or measure thereof; or any person to


knowingly use any false scale, balance, weight, or measure, whether sealed
or not.

Any person who shall violate the provisions shall be subject to a fine of not less
than two hundred pesos (P200.00) but not more than one thousand pesos
(P1,000.00) or by imprisonment of not more than one (1) year or both upon the
discretion of the court. b) Any person who shall violate the provisions of
paragraph (g) for the first time shall be subject to a fine of not less than five
hundred pesos (P500.00) or by imprisonment of not less than one (1) month but
not more than five (5) years or both, upon the discretion of the court. c) The
owner-possessor or user of instrument of weights and measure enumerated in
paragraphs shall, upon conviction, be subject to a fine of not less than three
hundred pesos (P300.00) or imprisonment not exceeding one (1) year, or both,
upon the discretion of the court.

HAZARDOUS SUBSTANCE

a. introduce or deliver for introduction into commerce of any mislabeled


hazardous substance or banned hazardous substance.

b. alter, mutilate, destroy, obliterate, or remove the whole or any part of the
label of a mislabeled hazardous substance, or banned hazardous
substance, if such act is done while the substance is in commerce or while
the substance is held for sale, whether it is the first sale.

c. receive in commerce any mislabeled hazardous substance or banned
hazardous substance and the delivery or preferred delivery thereof at cost
or otherwise.

Any person who violates is subject to a fine of not less than one thousand
pesos (P1,000.00) or an imprisonment of not less than six (6) months but not
more than five (5) years or both upon the discretion of the court.

DECEPTIVE, UNFAIR AND UNCONSCIONABLE SALES ACTS OR PRACTICES

The State shall promote and encourage fair, honest, and equitable relations
among parties in consumer transactions and protect the consumer against
deceptive, unfair and unconscionable sales acts or practices.

Any person who shall violate the provisions be subject to a fine of not less than
Five Hundred Pesos (P500.00) but not more than Ten Thousand Pesos
(P10,000.00) or imprisonment of not less than five (5) months but not more than
one (1) year or both, upon the discretion of the court.

CONSUMER PRODUCT AND SERVICE WARRANTIES

1. set forth the terms of warranty in clear and readily understandable language
and clearly identify himself as the warrantor

2. identify the party to whom the warranty is extended.

3. state the products or parts covered

4. state what the warrantor will do in the event of a defect, malfunction of failure
to conform to the written warranty and at whose expense.

5. state what the consumer must do to avail of the rights which accrue to the
warranty

6. stipulate the period within which, after notice of defect, malfunction or failure
to conform to the warranty, the warrantor will perform any obligation under
the warranty.

a. Any person who shall violate the provisions shall be subject to fine of not
less than five hundred pesos (P500.00) but not more than Five thousand
pesos (P5,000.00) or an imprisonment of not less than three (3) months

but not more than two (2) years or both upon the discretion of the court.
A second conviction under this paragraph shall also carry with it the
penalty or revocation of his business permit and license.

b. Any person, natural or juridical, committing any of the illegal acts shall
be liable for a fine of not less than one thousand pesos (P1,000.00) but
not more than fifty thousand pesos (P50,000.00) or imprisonment for a
period of at least one (1) year but not more than five (5) years, or both, at
the discretion of the court.

II. Republic Act 8423 or the Traditional and Alternative Medicine Act of
1997 (TAMA)

This provides for the improvement of quality and delivery of health care
services, and it also identifies traditional medicinal plants in the country. This
medicinal plant shall be given care by different agencies. The act provision the
establishment of the Philippine Institute of Traditional and Alternative
Healthcare (PITAHC) (Physical Education and Health Learner’s Module by
Dept. of Education page 237)

Objectives of TAMA

1. To promote scientific research on traditional and alternative medicine and


health care systems.

2. To promote and encourage the use of alternative, traditional and


preventive health care that is proven safe and effective.

3. To set up policies for the protection of indigenous and natural health


resources.

4. To train individuals and develop skills for various forms of traditional and
alternative health care modalities.

5. Designed standards, guidelines, and codes of ethical practice appropriate


for the use and practice of traditional and alternative health care.

6. Strengthen the role of traditional and alternative health care delivery


system

7. To promote alternative and traditional health care in national and


international conventions, seminars, and meetings, in coordination of

other tourism related agencies as well as non-government and local
government units.

Definition and Importance of Traditional and Alternative Health Care

Alternative health care and traditional medicine refers to skills,


knowledge and practices on health care that are not included in the
regular practice of physician, but are also used to prevent and treat
physical illnesses (21st Century MAPEH in Action by Cipriano et.al 2018 page 387)

III. Republic Act 10354 or Responsible Parenthood and Reproductive


Health Act of 2012

It is a law in the Philippines, which guarantees universal access to


methods on contraception, fertility control, sexual education, and maternal

Responsible Parenthood

Parenthood It is about raising children and supporting their needs in terms


of morale, financial, education, educate them the essence of values and giving
them love care and attention (21st Century MAPEH in Action by Cipriano et.al 2018
page 368)

FOUR PILLARS OF FOUNDATION

1. Informed Choice- This pillar covers the provision for the integration of
reproductive health and sexuality education in schools, and other
educational settings (Physical Education and Health Learner’s Module by
Dept. of Education page 238-239)

2. Respect for Life- In this pillar stated that abortion is illegal and punishable
by law. (Physical Education and Health Learner’s Module by Dept. of
Education page 238-239)

3. Birth Control- It is stated in this pillar that Government must respect the
individual preferences and choices of family planning method (Physical
Education and Health Learner’s Module by Dept. of Education page 238-
239)

4. Responsible Parenthood

Couple should plan what ideal family size is, and couple should provide an
education so that they can plan an ideal family size (Physical Education and

Importance of Family Planning

1. Taking a 2- or 3-year interval for delivery helps a mother to recover and

2. Children get quality time and attention from their parents; they also enjoy
and feel secure because they know that their needs will be provided (21st
Century MAPEH in Action by Cipriano et.al 2018 page 370)

3. It lightens the burdens and responsibility of the father in supporting his


family (21st Century MAPEH in Action by Cipriano et.al 2018 page 370)

4. Members of the family have more opportunities to enjoy each other’s


companies (21st Century MAPEH in Action by Cipriano et.al 2018 page
370)

5. The community will be a healthful place to live if the family is planned,


and in this case the economic and social status of the community (21st
Century MAPEH in Action by Cipriano et.al 2018 page 370)

6. By practicing family planning in the country, the rapid use of resources


like land, food, and fuel can be reduced and sanitation control will be
observed (21st Century MAPEH in Action by Cipriano et.al 2018 page 370)

Birth Control- This is the part where in husband and wife will have to decide
on the prevention of a birth of child, particular procedure, device, or
medication that would prevent the chances of pregnancy (21st Century MAPEH in

7. Family Planning – Program that provides education, information, and a


means for couples and individuals to have the desired number of children
they want based on their capabilities (21st Century MAPEH in

PENALTY OF RA 10354 or the Responsible Parenthood and Reproductive
Health Act 2012

Violation of this act shall be penalized and imprisonment ranging from 1 month to 6
months or a fine of 10, 000 or 100, 000 or both such fine or imprisonment ( GBSB

IV. TOBACCO REGULATION ACT OF 2003 or RA 9211

An act regulating the packaging, sale, use, distribution, and advertisements


of tobacco products and for other purposes. This act protects people from hazardous
products and promotes the right to health and instills health consciousness. (Active
MAPEH by Glinore S. Morales et, al page 312)

Purpose of Tobacco Regulation Act 2003 or RA 9211

1. Awareness about the health risk associated with cigarette smoking and
tobacco use

2. Promote healthy environment

3. Regulate and subsequently ban all tobacco advertisements and


sponsorships.

4. And the most important is to protect youth from being initiated to cigarette
smoking and tobacco use by prohibiting the minors of the product. (The

On January 1, 2004, new law mandates that;

1. All cigarettes sold in the Philippines, should bear the following government
warnings in either Filipino or English on rotating basis or separately and

b. Cigarettes Are Addicted
c. Tobacco Smoke Can Harm Your Children
d. Smoking Kills

Other Important matters:

1. Designated smoking areas may be placed in public, but they must be separate
areas with proper ventilation or open spaces. A visible smoking area must be
posted, and it must include a warning about health effects of direct or
secondhand exposure to tobacco smoke. (21st Century MAPEH in Action by Cipriano

2. The law mandates that there should be minimum age requirements for the
sale, purchase and use of tobacco by a minor (below 18 years old). If the seller
is doubt to the age of the buyer, he/she may ask for the identification card
with photo and date of birth (21st Century MAPEH in Action by Cipriano et.al
2018 page 376)

3. Selling tobacco is also prohibited within 100 meters away from a school,
public playground or other facilities frequented by minors. (21st Century
MAPEH in Action by Cipriano et.al 2018 page 376)

4. Stores selling tobacco products, must also post a notice that


“Sale/Distribution to or purchase by minors of tobacco products is
unlawful” (21st Century MAPEH in Action by Cipriano et.al 2018 page 376)

5. In addition to this, all packages of cigarettes or tobacco products must also


contain on one side of the panel the statement “Not for Sale to Minors” (21st
Century MAPEH in Action by Cipriano et.al 2018 page 376)

Penalty of Violation of the Law

a. On the first offense, a fine of not less than Five Hundred Pesos (Php500.00)
but not more than One Thousand (Php1,000.00) shall be imposed. On the
second offense, a fine of not less than One Thousand Pesos (Php1,000.00) but
not more than Five Thousand Pesos (Php5,000.00) shall be imposed. On the
third offense, in addition to a fine of not less than Five Thousand Pesos
(P5,000.00) but not more than Ten Thousand pesos (Php10,000.00), the
business permits and licenses to operate shall be cancelled or revoked

b. On the first offense, any person or any business entity or establishment selling
to, distributing, or purchasing a cigarette or any other tobacco products for a
minor shall be fined the amount of not less than Five Thousand Pesos
(Php5,000.00) or an imprisonment of not more than thirty (30) days, upon the
discretion of the business licenses or permits in the case of a business entity
or establishment. If the violation is by establishment of a business entity, the
owner, president, manager, or the most senior officers thereof shall be liable
for the offense. If a minor is caught selling, buying or smoking cigarettes or
any other tobacco products, the provisions of Article 189 of Presidential

Decree No. 603 otherwise known as The Child and Youth Welfare Code, as
amended, shall apply. c. Violation of Sections 13 to 27 - On the first offense,
a fine of not more than One Hundred thousand pesos (Php100,000.00) or
imprisonment of not more than one (1) year, or both, at the discretion of the
court shall be imposed. On the second offense, a fine of Two hundred
thousand pesos (Php200,000.00) or imprisonment of not more than two (2)
years, or both, at the discretion of the court shall be imposed. On the third
offense, in addition to a fine of not more than Four Hundred thousand pesos
(Php400,000.00) or imprisonment of not more than three (3) years, or both at
the discretion of the court, the business permits and licenses, in the case of a
business entity or establishment shall be revoked or cancelled. In the case of
a business entity or establishment, the owner, president, manager or officials
thereof shall be liable. If the guilty officer is an alien, he shall summarily be
deported after serving his sentence and shall be forever barred from reentering
from the Philippines.

V. Republic Act No. 8504 or the Philippine Aids Prevention and Control
Act of 1998

Stated in this law are the prescribed measures for the prevention and
control of HIV/AIDS in the Philippines. It is also included here the promotion
of public awareness about the causes, modes of transmission, and

This law was created to aware and promote the public about the
following issues related to HIV/AIDS. The causes, consequences,
modes of transmission, and the means of prevention and control (21st

ACQUIRED IMMUNE DEFECIENCY SYNDROME (AIDS)- It is a disease


characterized by a combination of signs and symptoms, caused by HIV. It
attacks and weakens the body’s immune system. (21st Century MAPEH in Action

The government imposed this policy to deal with the state’s problem with illegal

authority.

4. A cashier voluntarily underwent COVID 19 testing. The result shows


that the worker is positive with infection. He/ She reported it to the

the co-workers. Apparently, the administrator spread the news of his
condition to the workers.

5. A customer bought a whitening lotion in the supermarket.


Unfortunately, upon opening the product is found to be not in good
condition. The customer sends a letter of complaint to the Manager of
the supermarket waiting for them to respond and take necessary
action.
