Dear Sir,
(1) This has reference to your quotation and negotiations held with you on above
subject, we are pleased to award you the work of Upgradation in Nursing School
Block. The work includes construction of Lift supporting structure, Construction of
Plateform between existing two buildings at 2 levels and Rectification work in
Operation Theatre as detailed in your quotation. The Job Description, Scope of
work, specifications, BOQs drawings, payment & other terms and conditions are
enclosed/given in the order.

(2) The total estimated value of all works based on specifications and descriptions of
items given in the Scope of works will be Rs.50,82,926.44 (Rupees Fifty Lacs Eighty
Two Thousand Nine Hundred Twety Six and paisa forty four only). Amount is
exclusive of all taxes and duties as applicable. Rates includes all lifts and lead and
are valid for all heights. The estimated cost includes cost of material, labour,
wastage, tools, machinery, transportation, technical and supervisory staff, steel /
ply, shuttering material, scaffolding, builder hoist and other equipment in sufficient
numbers which may be required in full execution and timely completion of the
work. The contract cost is also inclusive of consultancy charges for architectural
lesigns and structural designing and also liabilities under PF, ESI and other
applicable labour and other laws including workmen's compensation Act. Whereas
the schematic architectural and structural drawings shall be forming a part of the
contract, these drawing shall be given to SDMH.

(8) COMMERCIAL CONDITIONS


Works to be carried out under the proposal shall include:-
(i) All labour, tools, equipment and transports of labourers and tools & in
accordance with good practice, recognized principles, and B.I.S., specification. The
proposal include adequate skilled and unskilled labour, technical and supervisory
staff, tools, machinery which may be required in full execution and completion of
the work.

(i) The several documents forming the proposal are to be taken as mutually
explanatory of one another, detailed drawings being followed in preference to
scale and special conditions in preference to general conditions of B.I.S
specification.
(ii) Temporary construction necessary for the site office, material godown, chowkidar
room etc at no extra cost.

iv) There will not be any payment for the material shifting required during the
construction period.

(v) NO SUBLETTING:
The contractor shall execute the entire work with his own capital. Subletting of
full work to any third party is not allowed. However, part of the work can be
sublet on labour rate basis to another sub-contractor, that too under intimation

to authorized official of SDMH, but in no way SDMH will be liable for its TDs, PE.
ESI and payments. M/s R. K. Garg & associates will sublet the work at
his own
risk and will be solely responsible for any default or any other
complexities
arising out of it.

(9) MODE OF PAYMENT:


i. A lumpsum advance of Rs 5 lac ( Rs five lac only) will be made to contractor for
mobilization to start the work immediately. Adjustment of the advance will be
made in three equal installments from the
i.
running bills.
Payment terms for project will be as per the progress of work and schedule and
payments of running bills will be released within 10 days from the date of
receipt.
ii. All payments will be made after deduction of TDS
and other taxes as per
Government rule.
iv. All Bills should be submitted in the printed form at the office of the Engineering
In-Charge.
N. Final payment will be made as per actual measurement/ quantity on the
recommendation/verification by Manager-Civil Maintenance SDMH.
(10) SECURITY AMoUNT:
Security @ 5% from each running bill will be deducted and will be released after
completion of six month of successful completion and handover of the work
assigned and recommendation/verification of Manager-Civil Maintenance of any
official authorized by SDMH.

(11) COMPLETION PERIOD:


The above described work shall be completed within two months. It would be the
sole responsibility of M/s R. K. Garg & Associates to ensure timely completion of
the entire work to the satisfaction of SDMH.

(12) STATUTORY REQUIREMENTS(PE,ESI, LABOUR LAWS):


The contractor shall have registration with all relevant applicable authorities and
ensure compliance with their rules and regulations and contractor shall abide by all
prevailing Laws in respect of child labour welfare etc.
All payments relating to labour including PF, ESI compensation to worker and other
statutory liabilities under the relevant labour law shall be borne by the contractor.

(13) LABOURLAW&SAFETY CODES:


Contractor shall adhere to the requirement of the workmen's compensation act,
Building and other construction workers welfare cess Act 1996 and other labour
legislation in force from time to time and be responsible for and shall pay all taxes
and compensation to his workmen which would be payable for injuries under
Workmen's Compensation Act.
II. The contractor shall take utmost care and will follow proper safety measures

during the course of construction under this work under. In the event of any
miss-
the TRUST shall not own
happening or casualty during construction of the building,

any responsibility and the contractor alone shall be solely responsible for such
casualty and all the consequences arising thereof, including any financial
civil
damages,
liability or criminal liability etc.
(14) WATER &ELECTRICITY SUPPLY: -
The SDMH will arrange electric and water
supply at free of cost at one point,
during the tenure of the project for the purpose of its use in the office
build at site. temporarily
(15) SITE CLEARANCE:
I.On completion of work, the proposer shall remove all
debris, workers,
machinery and tools and any personal material/belonging at his own cost
leaving the site clean and clear to the satisfaction of the SDMH.
I. During execution also as per instructions of the Site Engineers, the
contractor
will keep the site clean Y clear by
shifting lifting of malba & site clearance at all
stages.
(16) GENERAL TERMS:
. SDMH shall reserve the right to ask for
remolding of designs and drawings at any
stage of the work in consultation with you.
II. The contractor shall have a third
party group insurance policy for their all
employees like viz skilled / semi skilled labourers, supervisors, engineers etc. in
his name for the work given to him at his own cost.
. Any additional items/works may be added to or subtracted from this work order
after due deliberations with you and the
official authorized by SDMH.
Manager-Civil Maintenance or any
V. All statutory obligations under PF, ESI, Labour Laws will be followed by you. If
any mishap/untoward incident happen during the course of the construction.
SDMH will not be a party to it in any condition.
