APPLICATION UNDER SECTION 22-A CrPC FOR
TRANSFER OF INVESTIGATION & ARREST OF
ACCUSED PERSON
The petitioner most respectfully submits as
under:-
1). That the petitioner is by profession shop
keeper and having shops in Qambrani Road,
that the on dated 05-05-2020 the compliant
was sitting in his shop the above mentioned
accused/persons are entered in the shop of
the applicant/complainant and start
snatching after snatching the Money, Mobile
Cards , Mobile and respondent left the shop,
complainant started shouting luckily at that
time the police Mobile was came from same
way and police follow the
accused/respondent, during the firing the
respondents left Motor Cycle bearing
No.QAT.3525.
2). After that the complainant lodged FIR
against the unknown persons bearing
No.61/2020 with police station Sairab Road
on dated 05-05-2020 It is pertinent to
mention here that the Motor Cycle was
recovered at the spot is belongs to accused
namely Ghulam Yaseen crime partner of
respondent No.2 to 5, and the accused Ghulam
Yaseen & Accused Israr Shaikh S/O unknown
were arrested.
3). That the after the arrest of accused Ghulam
Yaseen & Israr Shaikh identification preyed
was done at Police station sairab, and
petitioner identified the accused persons
Ghulam Yaseen & Israr Shaikh but the police
official without permission of concern
Magistrate released the accused Israr Shaikh
after the plea Bargaining, which are totally
against the law.
4). That the official respondent failed to
properly investigating the matter and also
hiding the reality, and trying to change the
nature of whole case, which shows that the
respondent No.1 is not co-operating with the
applicant and also hiding the whole story of
the case and giving benefits to the accused
namely Israr Shaikh, furthermore the
respondent No.1 also not arresting the
accused/respondents No 2 to 5 , as such if
the investigation is not transferred to
Police station crime Branch & if the
accused/respondent No. 2 to 5 are not
arrested, the applicant will suffer
irreparable loss and injuries, hence this
application.
It is accordingly respectfully prayed in view of
above submission the application of applicant may
kindly be accepted and the investigation may be
transferred to the Crime branch, further may kindly be
direct to the Crime branch to arrest the
accused/respondent No.2 to 5, in the interest of
Justice, equity and fairplay.
