THIS TENANCY AGREEMENT made this ………. day of ……………………202...

BETWEEN MRS. BILIKISU ORIYOMI ADELAKUN (By the Landlady through her
Representative, MR. AYINLA ISIAQ AKANDE) of 36, Valley View Estate, Oluodo,
Off Ebute-Igbogbo Road, Ikorodu, Lagos State (hereinafter referred to as “the
Landlady” which expression where the context so admits include her heirs, Legal
and Personal Representatives and Assigns) of the one part

AND

MR. IBRAHIM KABIRU BABATUNDE of 36, Valley View Estate, Oluodo, Off Ebute-
Igbogbo Road, Ikorodu, Lagos State (hereinafter referred to as “the Tenant”) of the
other part.

WHEREAS the Landlady is the beneficial owner of the premises situate at 36, Valley
View Estate, Oluodo, Off Ebute-Igbogbo Road, Ikorodu, Lagos State (Hereinafter
referred to as “the premises”)

AND WHEREAS the Landlady at the request of the Tenant has agreed to let to the
Tenant and the Tenant has agreed to take on let from the Landlady, the Room and
Parlour Self-Contained Apartment (Mini Flat) being part of the property situate at 36,
Valley View Estate, Oluodo, Off Ebute-Igbogbo Road, Ikorodu, Lagos State
(Hereinafter referred to as “the demised premises”).

NOW THIS AGREEMENT WITNESSES AS FOLLOWS:

In consideration of the rent of N550,000.00 (Five Hundred and Fifty Thousand Naira
Only) per annum and the total sum of N600,000.00 (Six Hundred Thousand Naira
Only) being payment for one (1) year in advance and N50,000,00 refundable
caution/damage fee (the receipt of which the Landlady hereby acknowledges), and
the tenant’s covenants and conditions hereinafter contained, the Landlady HEREBY
let unto the Tenant ALL THAT Room and Parlour Self-Contained Apartment (Mini
Flat) being part of the property situate at 36, Valley View Estate, Oluodo, Off Ebute-
Igbogbo Road, Ikorodu, Lagos State together with appurtenances for a term of ONE
(1) YEAR CERTAIN commencing from the 1 st day of October 2023 and terminating
of the 30th day of September 2024.

1. THE TENANT COVENANTS WITH THE LANDLADY AS FOLLOWS:

(a) To pay the rent hereby reserved yearly in advance promptly to the Landlady
or her Legal Representative.

(b) To bear, pay and discharge all future water rates and other taxes or
development charges appointed to the demised part of the premises and to
keep the Landlady indemnified against all damages, costs and expenses
thereof throughout the term hereby created.

(c) To bear, pay and discharge all account or charges in respect of electricity bills
on the demised premises during the term hereby created.

(d) To pay pro-rata waste disposal charges, all community and security
levies/charges, reservoir cleaning charges and all other common expenses
imposed upon the demised premises or upon occupiers in respect thereof
during the term hereby created.

(e) To keep the demised premises in good and tenantable condition and not to do
anything that would amount damage to the demised premises but reasonable
wear and tear exempted.

(f) To keep the fittings and fixtures within the demised premises in good
serviceable condition and to replace any damaged fittings damaged as a
result of usage of the demised premises such as PLUMBING FITTINGS
(TAPS, PIPES) ELECTRICAL FITTINGS, KITCHEN CABINET, WARDROPE,
PUMPING MACHINE etc as and when due.

(g) To carryout immediate repairs or replacement of any damaged or lost item in


the demised premises as soon as such damage or lost item is detected and
such repairs shall not be delayed or postponed for any reason.

(h) To use the demised premises strictly as a RESIDENTIAL ACCOMODATION


and not to use or permit same to be used for COMMERCIAL/RELIGIOUS
PURPOSES or for gaming or as a brothel or for any illegal or immoral
purposes.

(i) To always keep the demised premises clean and participate in the monthly
environmental sanitation exercise and/or general cleaning of the environment
from time to time and dislodging as of when necessary the septic tank and
soak away pit serving the demised premises.

(j) To permit/allow the Landlady, her servants, agents, workmen to enter upon
the demised premises at all reasonable time during the term hereby granted,
upon prior notice for the purpose of carrying out inspection, with a view to
access the state of repairs and to enable either party carryout necessary
repair as may be required from time to time.

(k) To occupy the premises with a reasonable number of dependants, but shall
not maintain a crowd on the premises.

(l) To collectively contribute to the active pumping of water as well as disposal of


refuse to the appropriate channel as at when due.

(m) To maintain a harmonious co-existence with fellow tenants and adjoining


neighbors.

(n) To bear the responsibility for insuring personal goods in the demised
premises.

(o) Not to make or permit any structural alterations in or additions to the demised
premises or any part thereof without the prior written consent of the Landlady
(through her Solicitors/Representative) first sought and obtained and such
consent not to be unreasonably withheld.

(p) Not to use box Air-conditioner in the demised premises but may use Split Air-
conditioners if desired.

(q) Not to assign, underlet or part with the possession of the demised premises or
any part thereof without the prior written consent of the Landlady first sought
and obtained.

(r) Not to do, permit or suffer to be done on the demised premises any act or
thing which is or may be against the law of Lagos State or the Federal
Republic of Nigeria. AND not to do any act (such as fighting, operating loud
sound systems, burning of candles, incense and other allied materials etc)
which is or may be an annoyance or a nuisance to the Landlady, other
occupiers of the premises and/or of any adjoining premises.

(s) Not to keep unreasonable, unaccountable and unnecessary late night outside
the premises and not to turn the demised premises into a home or meeting
point for hoodlums or touts, thugs or other society miscreants.

(t) Not to use nail on any part of the wall or pierce hole or cause crack on the
wall of the demised premises by nailing or howsoever for any purpose except
for fixing of flat screen television and curtain rods/rails.

(u) Not to rear pets/animals within the demised premises without the written
consent of the Landlady first sought and obtained.

(v) At the expiration or sooner determination of the term hereby created, to


peaceably yield up and surrender to the Landlady the demised part of the
premises including the fittings and fixtures in tenantable condition, paint and
redecorate any and every part of the demised premises now or usually
painted in a proper and workmanlike manner.

(w) To commence repairs and or replacement of missing, broken or damaged


fixtures and fitting at the expiration or termination of the term hereby granted.

(x) To effect such necessary repairs, re-painting and redecoration on the


demised premises as stated above, one (1) month before yielding up
possession to the satisfaction of the Landlady OR to forfeit the caution fee/
pay the bills presented by the Landlady or her Agents in lieu of such repairs or
replacement of such items and/or re-painting/redecoration of the demised
premises.

2. THE LANDLADY HEREBY COVENANTS WITH THE TENANT AS FOLLOWS:

a. That the tenant having paid the rent herein reserved and performing and
observing all the covenants herein on his part contained shall peaceably hold

and enjoy the demised premises during the term hereby granted without any
interruption by the Landlady or any person lawfully claiming title under or in
trust for her.

b. To keep the demised premises structurally sound, wind and water tight and
keep the exterior of the building and additions thereto and all drains and the
boundary wall and fences thereof in a good and tenantable state and the
exterior of the building in a reasonable decorative state.

3. THE LANDLADY AND THE TENANT JOINTLY AGREE AS FOLLOWS:

a. That the tenant at the expiration of the term granted shall only be entitled to
seven (7) days’ NOTICE TO TENANT OF OWNER’S INTENTION TO APPLY
TO RECOVER POSSESSION.

b. That the rent herein reserved may at the option of the Landlady be reviewed
from time to time to attract the current market value in the area.

c. Notice referred to in paragraph (a) above shall be validly served or effected by


personal service on the Tenant or service on any adult member of the
occupier or by posting at the door of the demised premises.

IN WITNESS WHEREOF the parties have hereunto set their hands and seals the
day and year first above written.
