Constitution of the DNLU Student Bar Association

THE CONSTITUTION OF STUDENT BAR ASSOCIATION

PREAMBLE

WE THE STUDENTS OF THE DHARMASHASTRA NATIONAL LAW UNIVERSITY,


JABALPUR HAVING SOLEMNLY RESOLVED TO CONSTITUTE FOR OURSELVES THE
STUDENT BAR ASSOCIATION.

AS AN EXPRESSION OF HOW THE MEMBERS OF THE ASSOCIATION ASPIRES TO BE


GOVERNED BY THE RULE OF LAW AND BE ACCOUNTABLE;

FOR THEIR RESPONSIBILITIES AND SEEK ACCOUNTABILITY FROM THE GOVERNING


BODIES OF THE UNIVERSITY;

THAT SHALL FUNCTION THROUGH ITS VARIOUS COMMITTEES TRANSPARETLY


ASSURING FAIRNESS IN THE INTEREST OF THE MEMBERS OF THE ASSOCIATION AND
THE UNIVERSITY;

THAT SHALL UPHOLD THE OBJECTIVES OF THE UNIVERSITY THAT WAS


ESTABLISHED FOR THE DEVELOPMENT AND ADVANCEMENT OF LEGAL
EDUCATION;

THAT WILL SERVE AS A FORUM THAT GIVES IMPORTANCE TO THEDEVELOPMENT


OF CHARACTER, PERSONALITY AND LEADERSHIP QUALITIES OF THE MEMBERS OF
THE ASSOCIATION;

BY VIRTUE OF THIS CONSTITUTION, ON THIS DAY OF AUGUST 14, 2024,

PART I – THE STUDENT BAR ASSOCIATION

1. THE STUDENT BAR ASSOCIATION

There shall be a Student Bar Association of all the regular students enrolled in the
undergraduate and postgraduate courses at the University as its members.

2. PATRON OF THE STUDENT BAR ASSOCIATION

The Vice-Chancellor of the University shall be the Patron of the Student Bar
Association provided that in the case of vacancy, the Vice-Chancellor (in-charge)
shall act as the Patron.

3. FACULTY ADVISOR TO THE STUDENT BAR ASSOCIATION

The Vice-Chancellor of the University shall appoint, with the suggestion of the SBA;
any full time professor/associate professor/assistant professor as the faculty advisor
to the Student Bar Association.

Provided that in the case of vacancy, the DSW shall be the faculty advisor to the
Student Bar Association.

4. OFFICE BEARER OF SBA

The President, the Vice-President shall be the elected office bearers and the
Secretary, Treasurer shall be the nominated office bearer of the SBA.

5. ORGANS OF THE STUDENT BAR ASSOCIATION

The Student Bar Association operates through their office bearer and its two organs
– Student Bar Council (SBC) and the Student’s Academic Council (SAC).

6. OFFICE OF THE STUDENT BAR ASSOCIATION

The office of the Office Bearers of the Student Body Association (SBA) shall be

situated in an accessible location on the university premises. The exact location shall
be determined and approved by the Vice-Chancellor after taking into consideration
factors such as convenience for students, visibility, and accessibility to all members.
The office space provided shall be adequate to accommodate the administrative
needs of the SBA, including storage space for records, meeting areas, and facilities
for communication. The office bearers shall be responsible for maintaining the
cleanliness, orderliness, and functionality of the office space, ensuring that it
remains conducive to the efficient operation of the SBA and accessible to all
members during designated hours. This office would be called as “SBA Activity
Room”

7. SBA FUNDS AND ALLOCATION

There shall be a SBA Funds of the university managed by the Treasurer, which shall
be used through allocation of funds to diverse student bodies, including ABCs, Clubs,
Societies, and other student welfare activities done by SBA, following annual budget
discussions. These allocations shall increase by 10% each financial year to adapt to
evolving student needs and initiatives.

Provided that any surplus funds from a given academic year shall be carried over
and added to the subsequent year's budget, ensuring sustained support for student
welfare and enrichment endeavors. Allocations decisions shall be made
transparently and democratically to best serve the interests of the Student Bar
Association.

8. OBJECTIVES AND OBLIGATION OF THE STUDENT BAR ASSOCIATION

The Student Bar Association shall have the obligation to advance the objectives of the
University as enshrined in Section 4 of the Madhya Pradesh Dharmashastra National
Law University Act, 2018, which is annexed in Annexure 1 of this Constitution.

PART II – ORGANS OF THE STUDENT BAR ASSOCIATION

9. THE GENERAL BODY OF SBA

The General Body of SBA shall comprise of all the full-time students enrolled in the
undergraduate & postgraduate courses of the University.

10. FUNCTIONS OF THE GENERAL BODY

The General Body of the SBA shall be the permanent and highest student body in
the University and shall function in accordance with the Constitution of SBA.

11. MEETINGS OF THE GENERAL BODY

The General Body of SBA shall meet at least once a Semester with the quorum not
less than 1/5th of the total members of the SBA provided that in special
circumstances apart from one mandatory meeting, a special meeting shall be called
by the President subject to the conditions fulfilled hereof -

a. Upon receiving a signed petition from not less than 1/10th members of the SBA, the
president shall put the matter before the SBC and subsequently receiving a simple
majority in SBC.
Or
b. If the SBC has resolved by a simple majority to call the General Body meeting of SBA.

12. THE STUDENT BAR COUNCIL AND ITS COMPOSITION

The SBC shall comprise of the President, Vice- President, Secretary and the
Treasurer of the SBA along with all the members of the Student’s Academic Council
and all the Conveners of the Activity Based Committees (ABCs).

13. TENURE OF THE SBC

The Tenure of the SBC shall begin on the fourteenth working day of the odd

semester and end on the day when the term of the succeeding SBC begins, that is,
on the fourteenth working day of the next odd semester.

14. FUNCTIONS OF THE SBC


Following shall be the functions of SBC –
a. The SBC shall be responsible for upholding the Constitution of the SBA and
other rules and regulations stipulated from time to time.
b. The SBC shall make rules for the functioning of the SBC and SBA.
c. The SBC shall represent the interest of the students of the University.
d. The SBC is responsible for taking up the concerns of the students of the
University in its agenda list and deliberate over the same and convey the
resolution to the officers of the University.
e. The SBC shall also apprise the students of the University of the Views of the
officers of the University on various issues concerning students.
f. The SBC shall function as a coordination body among various ABCs of the
University.
g. The SBC shall strive towards transparency and accountability in its own
functioning and the University’s functioning.
h. The SBC shall be responsible for the allotment of funds to various ABCs.
i. The SBC shall reserve the right to register peaceful protest.
j. The SBC shall strive to secure membership to observe the proceedings
governing bodies of the University such as the Academic Council, Executive
Council, General Council and Finance Committee for any representation.
k. The SBC shall have access to all the minutes of meetings of the governing
bodies of the University since the establishment of the University and shall be
responsible for releasing all the minutes of on any digital platform accessible by
all the members of the SBA. Provided that such records once uploaded on the
digital archiving platform shall not be deleted or modified.
l. The SBC shall be privy to all the agendas that are going to be taken up for
discussion in the meetings of the governing bodies.
m. The members of the SBC shall put resolution in the meetings of the SBC and the
resolutions of SBC shall be binding upon every member of the SBA including the

office bearers of SBA.


n. The SBC shall have the power to approve the regulation proposed by the
President and Vice-President.
o. The SBC through its faculty advisor shall suggest agenda to governing bodies.
The faculty advisor to SBC shall be bound to present the agenda in governing
body meetings after the same has been resolved by 2/3rd majority of SBC.
p. The minutes of the meetings of the SBC shall have to be published by the
Secretary of the SBA and shall be disclosed within 3 working days to all the
members of the SBA.

15. MEETINGS OF SBC

a. The SBC shall meet at least once in a month with a Quorum of not less than
50% of its members present with prior intimation to all the members of the
SBC of 2 days.

Provided that in any special circumstances the meetings may be called by the
President through the Secretary of the SBA with prior intimation.
b. Any member of the SBC may call a meeting of SBC provided that the same is
supported by at least 1/10th members of the SBC with the agenda of the
meeting.

16. STUDENTS’ ACADEMIC COUNCIL AND ITS COMPOSITION

The SAC of the SBA shall comprise of all the elected class representatives from all
the batches of undergraduate and postgraduate course of the University, President,
Vice-President, Secretary and Treasurer of SBA.

17. ELECTION TO SAC

Election to SAC shall be made in the following manner –


a. Each Batch of undergraduate and postgraduate courses shall have two male
and two female representatives each.
b. The division of Batch for election of the class representatives shall be based
on the section wise scheme.

Provided that in cases where division on the basis of section is not possible,
the batch may elect two male and two female representatives each without
the demarcation of section.
c. All the students shall have the right to cast a single, non-transferable vote
through a secret ballot.
Provided that in case where it is not possible to conduct physical elections in
light of conditions that are extraordinary beyond human control the election
board may conduct the election using the official email handles of the
members.

18. REMOVAL OF CLASS REPRESENTATIVE

a. A class representative may be removed from his office by a removal


petition initiated by a request in writing made to the SBA President or
faculty advisor of SBA, by not less than 1/3rd of the total strength of the
class. Such request must lay down in detail the grounds on which
removal is being sought.
b. On such notice, the in President or faculty advisor shall provide a copy
of such request to the representative sought to be removed and such
person shall be permitted 24 hours to provide a written reply to the SBA
Office-Bearers and the concerned class.
c. The SBA Office bearers shall thereafter convene a Meeting with Quorum
of 50% of the concerned class on the third day after the notification. At
such meeting, one of the persons who made the request shall explain
the grounds mentioned in the request and the person sought to be
removed shall have the opportunity to argue for the defense.
d. The request for removal will need to be passed by at least two-thirds of
the members present and voting and shall take immediate effect.
e. A class representative removed from office by the members of the
concerned section and the post shall thereafter be filled up by
conducting election in presence of faculty advisor of SBA or Dean of
Student’s Welfare along with one of the office bearers of the SBA ,
within 7 days.

f. In case any Class representative resigns from his/her office then


provision of 17 would apply in the same manner for the re-election of
the new class representative.

19. POWERS AND FUNCTION OF SAC

Following are the powers and function of SAC -


a. SAC shall exclusively deal with the issues pertaining to academics and daily
concerns of the students including but not limited to course curriculum,
attendance, academic calendar.
b. SAC shall be responsible for maintaining the academic standards of the
University.
c. SAC shall have the right to seek audience from all the officers of the
University by giving a notice of 24 hours to any officer and 48 hours to the
Vice-Chancellor provided that the officer is present in the University.
d. SAC shall make rules for its business transaction.

20. MEETING OF SAC

SAC shall meet at least once in 15 days with the quorum of at least 1/2nd of its
members present in the meeting provided that any member may submit a request
calling for a meeting and the same may be called by the President.

PART III – OFFICE BEARERS OF THE SBA

21. PRESIDENT

There shall be a president of the SBA.

22. VICE-PRESIDENT

There shall be a Vice-President of the SBA.

23. SECRETARY

There shall be a Secretary of the SBA.

24. TREASURER

There shall be a treasurer of the SBA.

25. DUTIES AND FUNCTIONS OF THE PRESIDENT

Following shall be the powers and functions of the President -

a. The President shall be the chair all the meetings of the SBA, SBC and SAC.
Provided that the president shall co-chair the aforesaid meeting if it is being
presided by any officer of the University.

b. The President shall have the obligation to ensure the functioning of the
Student Bar Council, Student Academic council and Activity Based
Committee in a fair, democratic, transparent and efficient manner.

c. The President shall have the responsibility to ensure that incidents of


ragging, discrimination and consumption of illegal stimulants on campus
are kept in check.
d. The President shall be the sole point of contact to all the members of SBA.

e. The President in consultation with faculty advisor may setup ad-hoc committees
for inquiry, investigation or advisory into any matters concerning the welfare of
the students. However, if a statutory committee already exists with relevant
jurisdiction, the President may forward the matter to such committee for
appropriate action.

f. The President shall lead the delegation of the SBA during all the
communication with the officers of the University during representations
provided that the President may authorize some other member of the SBA
to lead such delegation.
g. The President along with the Vice-President shall be responsible for effective
coordination amongst and within the different organs of SBA.
h. The President shall be privy to all the office orders released by the officers of
the University.
i. The President shall be the sole spokesperson of SBA provided that the
President may authorize any other office bearer of the SBA to be the
spokesperson.
j. The President may propose to make regulation for the welfare of student in
accordance to this constitution.
k. The President has the responsibility to foster positive relationships with
counterparts of other National Law Universities.

26. FUNCTIONS OF THE VICE-PRESIDENT

The following shall be the functions of the Vice-President -

a. The Vice-President shall accompany the President in all the delegations for
representation before the officers of the University.
b. In the absence of the President, the Vice-President shall act as the president
and assume the responsibilities of the President.

c. The Vice-President shall be the co-chair of all the meetings of SBA, SBC and
SAC when the meeting is chaired by the President.
d. The Vice-President shall be privy to all the office orders released by the
officers of the University.
e. The Vice-President of the SBA shall be the observer of SBA in all disciplinary
proceedings provided that if the President directs otherwise to the vice-
president in writing, the vice-president shall abstain from any such
proceedings.
f. The Vice-President shall work along with the Activity Based Committees to
raise awareness and promote student participation in University events and

other initiatives that are initiated at the behest of the Students or the
Administration.
g. The Vice- President is tasked with cultivating constructive connections with
counterparts from different National Law Universities.
27. SECRETARY OF SBA

The Secretary shall be responsible for -

a. Moderating the meetings of the organs of SBA.

b. Make rules for the transaction of business in the various organs and present it
before the SBC for approvals.

c. Maintaining the minutes of the meetings of SBA, SBC and SAC and shall
ensure that each ABC is recording minutes and that such minutes are made
known to the Student Bar Association.

d. Calling the meeting of various organs of SBA either through discretion


subject to the provisions of this Constitution or on the advice of the
President.
e. Secretary shall be the guardian of all the documents of SBA and documents
received from the University and shall provide it to any member of the SBA
who requests it.
f. In the absence of President and Vice-President, the secretary shall assume
the office of the President for the period of vacancy/absence.
g. The secretary shall be responsible for the making of extra-curricular calendar
in consultation with the SBC.

28. TREASURER
The treasurer shall be responsible for –
a. Making budget for the SBA in consultation with the conveners of all the
A B C .
b. Maintaining all the financial records of SBA including all the ABCs.
c. Auditing the financial records of SBA funds and all the ABCs.
d. Making of rules for disbursement of funds to various ABCs provided that
without the approval of the treasurer the no amount of money can be

disbursed for any activity.


e. Making of the reimbursement policy in consultation with the SBC of SBA.
f. Explore and pursue fundraising opportunities and would be privy and
accountable for the proper accounts of sponsorship, and grants to support
the association's initiatives and events and support to the activity based
committee.
g. Auditing and Privy all the financial records of SBA funds and all the ABCs at
the end of academic session by forming a committee of not less than 3
members including the treasurer and two members chosen from SBC. h.In
the absence of President and Vice-President and secretary, the treasurer
shall assume the office of the President for the period of vacancy/absence

P PART IV - ELECTION AND REMOVAL OF OFFICE BEARERS

29. ELIGIBILITY FOR THE POST OF PRESIDENT AND VICE-PRESIDENT

All members of the SBA shall be eligible to contest for the post of president and Vice-
President, provided that they are enrolled as regular student in the undergraduate
course offered by the University and have completed at least 6(six) and 4(four)
semesters of education respectively for contesting as president and vice-president
of the SBA.

AND
Within 24 hours of the announcement of election result, the wining candidates shall
vacate membership to any ABCs, post of class-representatives, Journal of the University
except the Research Centers functioning in the University.

30. DISQUALIFICATION TO CONTEST THE ELECTION FOR THE POST OF


PRESIDENT AND VICE- PRESIDENT OF THE SBA
Any candidate shall be disqualified from contesting the election if –

a. They have served as the President; they shall be disqualified to contest for
the same post of the SBA.
b. They have been recalled from the post of President or Vice-President to
contest for same office, from which they have been recalled from.
c. They have been found guilty of serious misconduct by the University under
the Disciplinary rules, Prohibition of sexual harassment, Anti-ragging and
SC/ST rules.
d. They have been found guilty of election misconduct, politicization of the SBA
by bringing partisan politics by any means.

31. ELECTIONS FOR THE POST OF PRESIDENT AND VICE-PRESIDENT

a. The President and Vice-President shall be elected through an election


conducted by the Election Board of the University as nominated by the
competent authority.

b. The SBC shall make the rules of election for the subsequent elections in
accordance with this constitution.

32. DEBATE AND VISION DOCUMENT A SINE QUO NON

It shall be mandatory for the candidates contesting for the post of President and Vice -
President to -
a. Release a vision document containing the blueprint of the policies that the
candidate intends to pursue.
b. Undergo an open question round following the release of the vision
document wherein all the members of SBA may ask questions from the
candidates.
c. Undergo Presidential and Vice-Presidential debate both oral and written
debate.

Provided that these events shall be mandatorily be organized by the Election


board.

Explanation: The organization of the events includes notification of rules, dates,


venue and conduct or moderation.

33. ELIGIBILITY, ELECTION OF THE SECRETARY AND TREASURER OF SBC

a. Any member of SBA shall be eligible to contest the elections of Secretary


and Treasurer of SBC.
b. The rules of disqualification shall be same as the President and Vice-
President.
c. Every member of the SBC shall enjoy one vote each in the elections of
Secretary and Treasurer.
d. The Secretary and Treasurer once elected will have to vacate any other
office in any ABCs or Class representative.

34. REMOVAL FROM OFFICE


The following procedure shall be applied for removal of the office bearers of SBA.
a. The office bearer of the SBA may be removed from office on

disqualification arising after the election or by a removal petition. The post


shall thereafter be handled by any other officer of SBA according to this
Constitution till fresh elections are completed and the office bearer is
appointed.
b. A removal petition may be instituted to the faculty advisors by not less
than 1/3th of the total strength of the SBA. Such a petition must lay down
in detail the reasons for removal.
c. On the receipt of a petition, the faculty advisor shall provide a copy of such
request to the person sought to be removed, and such person shall be
allowed 48 hours’ time to give a written reply.
d. The removal petition along with the written reply shall be placed before the
SBC. The petitioners represented by one member from themselves along
with the office bearer shall present their case to the SBC.
e. The SBC shall resolve to either remove or dismiss the petition by a simple
majority.
f. The post of that office bearer shall thereafter be filled up by conducting
election as prescribed for the particular post in presence of faculty advisor
of SBA or Dean of Student’s Welfare along with one of the office bearers of
the SBA , within 15 working days.

PART V – ACTIVITY BASED COMMITTEES (ABCs) AND GENERAL RULES

35. ACTIVITY BASED COMMITTEES (ABCS)


a. The Committees mentioned in Schedule I are the Activity Based
Committees of the SBA.

b. All the ABCs must endeavor to have proportional member representation


from all the batches. Provided, that Campus Development and
Management Committee and Mess Committee shall have proportional
representation of all the hostels.

c. The total number of members of ABCs at any time shall not exceed the
limit of 20 students inclusive of Co-opts. Provided that for any event the
ABCs may invite as many volunteers as needed.

d. The tenure of ABCs shall be same and coincidental as that of SBC.

e. There shall be a convener, co-convener, secretary and treasurer of the


ABCs for the smooth functioning subject to the internal rules of ABCs.

f. All the office bearers shall be appointed by a merit-cum-democratic


process, as per the committee rules.

g. No student shall be allowed to be a member of two ABCs at any given


instance.

h. Any office bearer of any ABC shall not be appointed for the same post more
than once.

i. The Convenor or the Co-Convenor shall be the regular student enrolled in


the courses offered by the University and have completed at least one year
as members of that respective committee.

j. The committee rules shall promote the intra committee democracy and
transparency.

k. No student member shall be allowed to leave any ABC before the


completion of one semester of induction.

l. All the ABCs shall have internal rules that must be presented before the
SBC.

m. ABC once formed shall not be dissolved.

n. Each ABC shall prepare and present the following, within 15 days of its
formation to the SBC –

-Agenda of the ABC for the academic year;

-Budget required for fulfilling the agenda;

-Working procedure of the Committee for its term.

o. Prior to the end of the academic year the Convener in consultation with the
co-convener, treasurer and secretary of the ABC shall make the progress
report of all the members and recommend the faculty advisory to retain at
least 30 percent of the student members and at most 50 percent of student
members.

p. At the end of the academic term, the office bearer of the each Activity
based Committee may require to conduct an open house discussion on the
activity performed along with the progress report which shall be circulated
via official email to the each member of the SBA.

q. Any Class representative shall not become the Convener and Co-Convenor
of ABCs or vice versa in order to avoid any conflict of interest.

36. REMOVAL OF THE OFFICE BEARERS OF ABCS

The office bearers of ABCs may be removed only after following the procedure
hereof.
a. There shall be a written complaint addressed to the President of SBA made
by not less than 2/3rd members of the ABCs against the office bearer or of a
written complaint signed by 1/3rd of the members of the SBA for removal
with detailed reasons for such removal.
b. On receipt of the complaint the President shall provide a copy of the same to
the office bearer against whom the complaint has been made and 24 hours’
time shall be given for a reply.
c. The President shall place it before the SBC, the SBC shall be made privy to all
the documents related to the issue and may remove the office bearer with a
simple majority.

37. FACULTY ADVISORS OF THE ABCS

The Dean of Student’s welfare along with Dean of Faculty/Academic shall appoint
faculty advisor for each ABCs within first seven working days of the odd semester
with consultation and suggestion of the retained members of the ABCs.
a. The Dean of Student’s welfare may appoint a maximum of two faculty
Advisors for any of the ABCs.

Provided that no faculty advisor shall serve as the faculty advisor of more
than one committee at a time.

38. EXTRA-CURRICULAR CALENDAR AND REPORTS

The Conveners shall be responsible for presenting the following –

a. The proposed activities for the academic session.

b. ABC report to be presented before the SBC two weeks prior to the end of
academic session.

39. FORMATION OF NEW ABCS, CLUBS AND SOCIETIES

The Student Body Association (SBA) may establish a new Activity-Based Committee,
Clubs and Societies, obtaining approval from the Student Body Council by a majority
vote and endorsement from the Vice Chancellor. The proposed committee's
objectives, structure, responsibilities, and budgetary requirements shall be
presented to the Student Body Council for evaluation. Upon receiving majority
approval from the Council and subsequent endorsement from the Vice Chancellor,
the new Activity-Based Committee shall be officially incorporated into the SBA
framework, with designated members appointed to oversee its operations and
initiatives

40. CONFLICT BETWEEN TWO ABCS

In case of any conflict between two ABCs, the same shall be mediated by the office
bearers of SBA. In situations where mediation is not possible the SBC by a simple
majority shall decide the case.

41. CONTROL AND REPRESENTATION IN EVENTS INVOLVING SBA RESOURCES


AND FUNDS.

In any event organized by the university, center or any individual/group within the
university where resources of the SBA, funds from the Student Bar Association (SBA)
are utilized, the SBC shall exercise control and representation. The organizing entity
must notify the SBC at least 10 days prior to the event, detailing the budget
allocation from SBA funds and the intended use. The SBA President or a designated
representative from the SBA President from the Student Body Council shall be
appointed as an official representative of the SBA in the event, overseeing the
utilization of SBA funds and ensuring compliance with approved budgetary
allocations. Post-event, the organizing entity shall submit a detailed report to the
SBC, including actual expenditure of SBA funds and outcomes achieved. This
provision aims to uphold transparency, accountability, and alignment with the SBA's
objectives in all events involving SBA funds.

P PART VI – AMENDMENT, SAVING, MISCELLANEOUS & REPEAL

42. AMENDMENT

Any provision of this Constitution may be amended in the following manner:

a. On the recommendation of the office bearers, any member of student bar


council, or on the recommendation of at least 1/10 th members of the SBA, the
SBA may consider any amendment to this Constitution, in accordance with the
provisions hereof.
b. A meeting of the SBC shall be called convened by the President with a quorum of
not less than 50% of the total strength of SBC and the SBC shall pass the
proposed amendment with a special majority which is 2/3rd of the total members
of SBC present and voting.
c. The proposed amendment shall be notified to the SBA and a special voting shall
be convened with at least 1/5th members of SBA present and voting.
d. The proposed amendment will need to be passed by simple majority of the
members participating in the voting.
e. The amendment shall then be forwarded to the Vice-Chancellor and shall come
into force after receiving assent of the patron, and being duly notified to the
SBA.

43. SAVINGS AND REPEAL

a. All existing policies of the SBCs and ABCs shall continue to be in force, to the
extent that they are not inconsistent with the provisions of this Constitution.
b. Every President, within the period of 30 days from election, shall be required to
circulate the electronic copy of this Constitution among the students.
c. Articles 32(c), 32(m) and 32(g) shall come into force from the academic session
2023 - 24.
d. The first Constitution hereby is repealed.

44. REMOVAL OF DIFFICULTIES

For the purpose of any difficulties, particularly in relation to the mandate of this
Constitution, shall be presented by the President in SBC, which shall be a simple
must eradicate any such difficulties provided that order as passed shall be annexed
with the Constitution.

45. COMPLAINTS AND GRIEVANCE REDRESSAL MECHANISM

There shall be a grievance mechanism to be established within the Student Bar


Association (SBA) and every ABCs for students to address concerns. Students can
approach the Student Body Council with grievances related to academic,
administrative, or other matters. The mechanism will be transparent, impartial,
and led by a designated Grievance Officer or Committee, ensuring timely
resolutions and maintaining confidentiality. This provision aims to prioritize
student welfare and foster effective communication within the college
community.

46. DISSOLUTION OF SBA, SBC AND SAC

The SBA, SBC and SAC shall not be dissolved under any circumstances.

ANNEXURE 1
SECTION 4 OF MPDNLU ACT, 2018

SECTION 4 - The Objectives Of The University Shall Be -

i. To advance, disseminate and impart comprehensive legal education, learning and


knowledge including through distant and continuing legal education at all levels to
achieve excellence with a view to ensure its proper role in national development, to
develop in students and research scholars, a sense of responsibility to serve society in
the field of law by developing skills in regard to advocacy, judicial and other legal
services, legislation, law reforms and the like, and to advance legal education in a
professional manner;

ii. To organize advanced studies and promote research in various branches of law.
iii. To disseminate legal knowledge and legal processes and their role in national
development by organizing lectures, seminars, symposium, workshops, conferences
etc.

iv. To promote cultural, legal and ethical values with a view to promote and foster the
role of law and the objectives enshrined in the Constitution of India:

v. To improve the ability to analyze contemporary issues of public concern and their
legal implications for the benefit of the public.

vi. To liaise with institutions of higher learning and research in India and abroad.
vii. To publish periodicals treatises, study books, reports, journals and other literature on
all subjects relating to law.

viii. to hold examinations and confer degrees, titles, diplomas or certificates and other
academic distinctions.

ix. To promote legal awareness in the community for achieving social and economic
justice.

x. To undertake research, study, workshop or training to judicial officers and training


projects relating to law, legislation, and judicial institutions etc.
xi. to hold administrative officers training programme and research on the legal subjects
and social importance; and
xii. to do all such things as are incidental, necessary, or conducive to the attainment of
all or any of the objectives of the University.
