PREAMBLE
We, the bona fide students of Asian Institute of Technology-Digos Inc., imploring the aid of
Almighty God, aware of rights, duties, obligations, and responsibilities to organize representatives,
democratic and genuine student government, that shall serve as a medium of our ideals, promote and
protect students’ aspirations, develop a high degree of social, moral, spiritual, physical and intellectual
growth, establish harmonious relationship among students, the faculty, the administration, other
institutions and various sectors of the society of the advancement of the Asian Institute of Technology-
Digos Inc., students, do ordain and promulgate this Constitution and By-Laws.

NAME AND LOCATION


ARTICLE I
Section 1: This student body shall be known as the Asian Institute of Technology- Digos Inc. -
Peer Counselors, herein referred to as the AIT-Peer Counselors.

Section 2: The location of AIT-Peer Counselors’ office shall be at AIT Campus

STUDENTS’ RIGHTS
ARTICLE II
Section 1: Every student shall have the right to equal treatment, and protection and opportunities
regardless of gender, socio economic, political and religious orientation, physical and mental abilities.

Section 2: The right of every student to express objectively his views, grievances, comments, and
appreciations of the existing laws of the University.

Section 3: The right to have access to records, documents and other similar information concerning him
subject to rules and regulations issued by the University.

Section 4: The right to be informed about the orders and decisions of the administration affecting the
studentry.

Section 5: The right of every student to undergo the process of law before he/she is subject to any
disciplinary action.

Section 6: The right to form student associations, clubs, and organizations which should be duly
recognized by the Office of the Principal in accordance with the Student Handbook and subject to existing
law.
Section 7: The right to run for any office in the AIT-Peer Counselors in accordance with the provisions
stipulated in this constitution.

MEMBERSHIP AND DUTIES
ARTICLE III
Section 1: Members of AIT-Peer Counselors
1.1 The AIT-Peer Counselors shall be composed of all bona fide AIT students.
Section 2: Duties of AIT-Peer Counselors members
2.1 To uphold and defend the Constitution and By-Laws;
2.2 To cooperate and show respect to the studentry, to the faculty and staff;

2.3 To contribute to the development and welfare of the students; and


2.4 To exercise the right to suffrage.
2.5 Facilitating behavioral change of the members.
2.6 Improving the ability to establish and maintain relationships of their co-students.
2.7 To increase confidence and to develop communication and social skills.
2.8 Promoting the decision-making process and facilitating potential student clients.
2.9 Individual development and social change.

COMPOSITION OF THE AIT-PEER COUNSELORS


ARTICLE IV
Section 1: The AIT-Peer Counselor shall be composed of the officers comprising the Executive and
Legislative Bodies, the Commission on Elections.

Section 2: The Executive Body shall be composed of the President.


Section 3: The Legislative Body shall be composed of the Vice President, Secretary, Treasurer, and
Public Information Officer.

EXECUTIVE BODY
ARTICLE V
Section 1: The AIT-Peer Counselors President:
1.1 Executive Power shall be vested to the AIT- Peer Counselors President-defined as the
power to uphold the Constitution and By-Laws of the AIT-Peer Counselors and
execute the approved ordinance/resolutions and enforce them.
1.2 The AIT-Peer Counselors President shall have the following qualifications:
a. Must be a bona fide student of Asian Institute of Technology – Digos, Inc.
b. Must have a good moral character
c. Must have no failing grades and drop-outs before the School Election and during
his term of office as the Elected President.
d. Must have presented a certification from the School Registrar for drop-out
subjects on grounds of conflict between subject schedules.

e. Must not have drop-out subjects due to tardiness, absenteeism, and/or
other violations of existing classroom and school policies.
f. Must be full time student; and is not an STA of the University or a working
student outside the campus.
1.3 The AIT-Peer Counselors President shall have the following functions:
a. Shall be empowered either to veto or approve any ordinances or resolution passed
by the AIT-Peer Counselors Legislative Body.
b. Shall take charge of all the AIT-Peer Counselors activities.
c. Shall recommend members of special committees and such other committees
created whenever the need arises.
d. Shall open the first session of the organization.
e. Shall represent the AIT-Peer Counselors to the administration.
f. Shall establish linkages with other clubs, organizations and agencies for
the development of the AIT-Peer Counselors.
Section 2: The AIT-Peer Counselors Vice-President shall have the same qualifications as the elected
President.
Section 3: Duties and Functions of Vice-President.
3.1 Shall preside the other succeeding sessions of the organization.
3.2 Shall act as President when the elected President is temporarily incapable to discharge
his/her powers and duties.
3.3 Shall become the President when the latter died, permanently disabled and such other
cases that would warrant the vacancy position of the President.
3.4 Shall become the President when the latter resign or remove from the office.
Section 4: The Internal and External Secretariats shall have the same qualifications with the President
except Section 1: 1.1, 1.2 and must be computer literate.
Section 5: Duties and Functions of Secretary:
5.1 Shall process the internal communications of the AIT-Peer Counselors.
5.2 Shall keep all the letters resolutions, minutes/records and other pertinent documents of
the AIT-Peer Counselors.
5.3 Shall submit narrative reports, accomplishement reports, documentation, and other
related documents to the Administartor provided a furnished copy to the Guidance.
5.4 Shall take charge of the evaluation of the AIT-Peer Counselor activities.
5.5 Shall have the same qualifications with the President except Section 1: 1.1, 1.2, and must
have knowledge in making financial reports.

Section 6: Duties and Functions of the Treasurer:
6.1 Shall make the financial statements of AIT-Peer Counselor activities of which involve
fund and expenses.
6.2 Shall keep all the financial records of AIT-Peer Counselors.
6.3 Shall take charge of cash inflows and outflows of AIT-Peer Counselors.
6.4 Shall submit the financial statements of the Cashier towards the end of every semester.
Section 11: Duties and Functions of Auditor:
11.1 Shall receive and keep the financial reports prepared by the Treasurer.
11.2 Shall scrutinize the correctness of the financial statements done by the Treasurer
for accuracy and transparency.
11.4 Shall uphold financial quality control standards and policies in relation to the utilization
and acquisition of funds.
11.5 Shall scrutinize the correctness and accuracy of Audit Reports.
Section 12: Vacancy of the President:
12.1 The Vice-President shall take the place of the President in his/her absence due to
incapability to fulfill his/her duties and responsibilities, death, and/or removal from the position.
Section 13: As effective for school year 2021-2022, officer of the organization must render at least one
hour of service in the office located at Asian Institute of Technology – Digos City. This is to perform their
job efficiently in particular with consultation matters and paper works.

MEETINGS AND QUORUMS


ARTICLE VII
Section 1: There shall be a regular session of the AIT-Peer Counselors officers every 1st Friday of the
month, unless the other member fixes a different date, duly approved by two-third (2/3) votes of all
members of the organization.
Section 2: The Presiding Officer has no voting power in the regular, special or emergency sessions,
unless otherwise there is a tie.
Section 3: Simple majority constitute a quorum in the organization.
Section 4: The venue of the meeting shall be at the school campus.
Section 5: The presiding officer has the power to call for a special meeting or emergency meeting
anytime he/she would find it necessary. A letter must be send to each of the officers needed to attend, 3
days before the said meeting approved by the Peer Adviser.

EFFECTIVITY
This Constitution and By-Laws shall take effect after the ratification by a
majority vote of the UMDC-SSC members through a plebiscite and will take
effect prior to the succeeding National elections. The previous Constitution is
hereby declared void.
