Dear President Trump:

The House Committee on Small Business (Committee) writes to express its support for
the appointment of Casey Mulligan as the Chief Counsel of the Small Business Administration’s
(SBA) Office of Advocacy. The Office of Advocacy serves as the voice for small businesses
within the Federal Government and ensures Federal Agencies comply with the Regulatory
Flexibility Act (RFA). This position has been vacant for far too long, leaving the Office of
Advocacy rudderless and small businesses without a voice.

During the 118th Congress, the Committee sent former President Biden two letters urging
him to fill this position, yet he failed to nominate a candidate.1 Further, the Committee’s Staff
Report on the RFA found that Federal agencies repeatedly failed to comply with the RFA’s
requirements to the detriment of small businesses.2 With your appointment of a new Chief
Counsel, the Office of Advocacy will have a greater ability reduce regulatory burdens on small
businesses.

The Committee looks forward to working with the you, the SBA, and the Office of
Advocacy to reduce red tape and provide small businesses with a voice in the Federal
Government. A strong Office of Advocacy will help ensure that small businesses, which make
up 99.9 percent of all businesses in the United States, are brought into the golden age of
America.
