to issue laws that implement international and

regional treaties to which Ethiopia is signatory;

:OP 'R%R I '$>@"> j` information pertaining to rural
U Ok – (i landholding and land use rights';
4/ “ 9$" :; *< = "” 'W 9$" 4/ “Rural Land Administration” means a
:; ^_` : UR. I +< > process whereby rural land holding rights
UO 9. I :; x + are recognized and recorded, tenure
U :E I :; *$?@! vj[ security ensured, land property valued, a
U 9 " :; $?Uw : J land use plan is prepared and
implemented, land dispute among land

: ~ ^! ŸU : = ( YE<š livelihood depends on livestock

7/ “JK *" L * "” 'W “Z *+, 10/ “Semi-pastoralist" means a person, whose
:‰O : ~ ^! ŸU : = ( livelihood depends on livestock

7// “'}” 'W *E[ ` ^ U9{ 11/ “Parcel” means a portion of land that

J*E[ ^ gM %W^_`w ^_` held by an individual or jointly by more

71/ “ ^_`” 'W *"G * N ^! 13/ “Communal Landholding” means rural
*" L * N ^! JK *" L * N land that farmers, pastoralists, and semi-

74/ “ :EF< ^_`” 'W ^! F 14/ “State Landholding” means land which is
^_` d :; gE :EF< not held as communal or private and

YE<š > . j `w EI x^› EI organs, forest lands, wildlife, and
E_ E> ’Ž E :šš^ : q protected areas, lakes, rivers, and other

7C/ “ 9 . :; ^_`” 'W 15/ "Illegal Landholding" means any rural
% g :E9[ d> *F% %W( * landholding held illegally and not

given on administrative issues on

¨"X JWI W "n ŸŸ: by competent authority to carry out any

3/ “'Z Ÿ' ” 'W 'Z OR 20/ "Social Institutions" means organizations
*% E F" W:n` 'Z ORs established based on the will of
n? { ^ :<"L ŸŸ£ communities to solve problems of

3// “ nn ” 'W d ^! W 21/ “Distribution” means the allocation of
! E “Z F> ™ unoccupied land or land which has been
J%W^_`w $@ ^! W@@ reclaimed from holders because of
9$" :; i :; W’ o( ^! violations of obligations prescribed in
:; šo( Rw :<$ (i this Proclamation or other regional laws,
or land that was voluntarily relinquished
by previous holders to those who are
landless or with small holding size;
36/ “¢F¢F” 'W 9$" :; n © 22/ “Re-distribution” means the transfer of
W $?Uw YE =O< W'[OF ^_` land from those who have excess land to
o( :@ < W’ o( ^! ^_`o( those who have none or hold a small size
* < ~ WgM Rw :<$ F%" (i to ensure equity in landholding;

rights or, even if they have one, cannot

protect their rights because of their

economic and social problems;

34/ “:; E W * ¢ :<$ ” 'W *E[ 24/ “Share Cropping” means a contract
%W^_` ^_`(E ’ R( Ž where a landholder agrees, for a period
U RE f YE W'( Y> J“] of time to be determined by regions, with
U9h(E !" U<'£ :$E another person to use his landholding in
exchange for a share of the crop;

3C/ “ ± ²l—X : a . ” 'W 25/ “National Geodetic Reference Point"
*9" *@n OP < E R$( * means a point established by a nationally
:‰O ± ²l—X ![" authorized organ; a part of the national
:› $ . :O * g > geodetic control points network which
W@ ^ j š b : a gT U 9WF serves as a starting point for future
(i surveying activity;
38/ " " 'W 26/ “Region” means any region referred to
9 :EF< *E@• under Article 47 of the Constitution of
´• :‰O 'E~(! the Federal Democratic Republic of
gE [;=+ J ' *< = "E ^t! i Ethiopia and includes Dire Dawa City
Administration;
3•/ “Uµ<¶"” 'W F "> Uµ<¶" (i 27/ “Ministry” means the Ministry of
Agriculture;
3€/ “R(” 'W e.N R( ^! F 28/ “Person” means any natural or juridical
R( : R$( * 'W (i person;
3D/ “Z *+, 'E~(! E[ ·` 29/ In this Proclamation, any expression in
9Wp( ‚ ·`E! ` ‹‹ the masculine gender shall include the
feminine.
1. *+¬ e¸U RE 3. Scope of Application
// ^Z *+, (<. U9{ 1/ This Proclamation shall apply to any rural
'E~(! 9$" :; Y> J ' land in Ethiopia and certain rural kebeles
(<. ‘ Ž Y> J ' in the Regions and City Administrations
*< = N (<. RM 9$" in urban areas.
@ ’w ^ e¸U ^TO+ ‹‹
6/ “Z *E@• E¹< *E@• (/) 99( 2/ Without prejudice to Sub-Article (1) of
YE $ @ gT “Z *+, [E ºw this Article, this Proclamation shall apply
J ' RE (<. $?W‘ 9" FE to lands that are incorporated into urban
" % O9%o( ^_`w ^! boundaries but where such lands have
e¸U ^TO+ ‹‹ not yet been officially handed over to the
urban administration.

9$" :; *< = " RURAL LAND ADMINISTRATION
E¹< n / SECTION 1
9$" :; <W'Fh > <W:$@! ACCESS AND USE OF RURAL LAND

4. 9$" :; J:EF< <W'Fh 4. Access to Rural Land Through
Government Allocation
// F "> b Y = O W ^! 1/ A person may have the right to freely
W: = " Ue F R( 9$" :; access rural land where he has been
“Z F :‰O ¸ 'Fh : engaged or prefer to engage in
*W(‹‹ agricultural activities for a living.
6/ F "> b W: = " 9$" :; 2/ Applicants shall be above 18 years of age.
YE R$( U$^j *: v[•(
7€ c: > J“ ^ :gE *W ‹‹
1/ “Z *E@• E¹< *E@• (/) 99( 3/ Without prejudice to Sub-Article (1) of
YE $ @ gT Ž W‚L > L this Article, regional laws may create
YE ]! W* k= ° * E` [ n affirmative action rules for women and
U RE E *F% F ^ <>‘‹‹ youths as well as persons with
disablities.
4/ “Z *E@• E¹< *E@• (/) Y> (6) ^ 4/ The provisions in Sub-Articles (1) and (2)
‘ [E ºw , ( WU:ª of this Article shall also apply to
L ! e¸U ^g> ‹‹ organized youths.
C/ “Z *E@• E¹< *E@• (6) 99( 5/ Notwithstanding Sub-Article (2) of this
œT"! 7€ *: o( ®\o(E Article, orphans who are below 18 years
ª Z¯> I ®\o( 9$" ^TH of age whose parents used to live in rural
H> šo( :; o( Jg areas and did not have their own land
9$" :; 'Fh : * o(‹‹ holdings shall have the right to get rural
land.
8/ =" ^ ‘ œw *E¤ F ! g 6/ Where one of the spouses does not have
^_` J’W( YE 'E~(! :; joint or private holding, he shall have the
* % *: :; 'Fh : right to access land, like any landless
*W(‹‹ UR$( :; ! F ^_`( person. The land granted shall be
gT ^:d9% ‹‹ registered as a private holding of such a
person.
•/ :; ^_`( ]WQ! œw F 7/ Where the landholding is acquired during
^_` š^T o( 9h Jg ]WQ! their marriage and both spouses do not
^_` gT ^:d9% ‹‹ have private holding, it will be registered
as common property of both spouses.
C. :EF<` gM [",L I 'Z Ÿ' 5. The Right of Non-Governmental
Y> F %Wx 9$" :; 'Fh Organizations, Social Institutions and
: Private Investors to Access Rural Land
// :EF<` gM [",L > 'Z 1/ Non-Governmental organizations and
Ÿ' Ž U »o( ™ social institutions may have the right to
:‰O Wc 'o( 'š¼ U( 9$" access rural land as per regional laws.
:; 9| ^ ‘‹‹
6/ “Z *E@• E¹< *E@• (/) W 9W½ 2/ The rural land use right of institutions
Ÿ' 9$" :; :$@! : mentioned under Sub-Article (1) of this
f 9 gE f (! ‘ Article shall be limited by time and such
period shall be determined by regional
U ª ™ ^ R> ‹‹
laws.
1/ “Z *E@• E¹< *E@• (/) Y> (6) 3/ The land users mentioned under Sub-
$@y :EF<` gM [",L Article (1) and (2) of this Article shall
:; ^ UT o( : :$@! have only use right over the land, and
: \ gE 'J I W * ¢ they may not lease, sharecrop, bequeath,
:<$ I '(O<I <¡` '< WnI donate, create partnership contracts over

4/ “Z *E@• E¹< *E@• (/) $@y 4/ Social institutions referred to under Sub-
'Z Ÿ' ^_`o(E J'(O< Y> Article (1) of this Article shall have all
<¡` J'< Wn (z W%W^_`w holding rights other than bequeathing
Rª : L ]‘ ^T o+ ‹‹ and gifting.
C/ 9$" ' WUR'H F %Wx L 5/ Private investors who intend to engage in
> E¾< :E ™ rural development shall have the right to
e¸U ^g>‘‹‹ access rural land as per regional
investment laws and policies.
8. 9$" :; :$@! : pEL 6. Duration of the Right to Use Rural Land

*" L * N Y> ©^'T Ÿ' pastoralists, pastoralists and Religious
^_`o( ^ o( : f 9 Institutions have no time limit.

6/ ’Ž $?Uw 9$" :; 2/ The duration of land use rights of other
:$@! : pEL U›^ f users shall be determined by regional
9 Ž U »o( ™ :‰O laws.

1/ “Z *E@• E¹< *E@• (/) Y> (6) 3/ Notwithstanding the provisions of Sub-
9k œTH! :EF< 9$" :; Articles (1) and (2) of this Article, the
WZ .j! W:(R[ W(E < E eminent domain power of the
U *^gE!‹‹ government to expropriate land may not
be restricted.
E¹< n 6 SECTION TWO
9$" :; ^_` c^ L Y> %W^_`w THE HOLDING TYPES OF RURAL LAND
:;`o( ^ <WUT o( : AND THE RIGHTS OF HOLDERS ON
THEIR LAND
•. ^_` c^ L 7. Holding Types
9$" :; ^ ‘ ^_` c^ L F I Rural land holding types include private,
Y> :EF< >o(‹‹ communal, and state holdings.
€. ^_` : 8. Holding Right
// W*"G * N I *" L * N I JK 1/ The right that farmers, pastoralists, semi-
*" L * N Y> ©^'T Ÿ' pastoralists, and Religious Institutions
R$( :; ^ o( : have over their land is a holding right.
^_` : (‹‹
6/ 9$" :; ^_` : :;Q 2/ Holding right includes the rights of use;
:$@!EI 'J EI W * ¢ lease; sharecrop; collateralize the use
:<$ EI :$@! : QE v= +< > right; jointly develop the land with
'< EI J%W © " ' ' EI investors; bequeath; donate; transfer
("< ^! <¡` '< WnEI 9$" through sale or in any form properties
fixed on the holding; consolidate;
:; ^_` ^ e E E O ¢ z
exchange with similar rural land holding,
'< nEI q` 9$! '[OFEI ^_`E
and cultivate the land through cluster
'@ O EI F ^_`E q` 9$! arrangement.

D. ¼ ^ 9. Lease
// 9$" :; %W^_` :$@! : QE 1/ A rural landholder may lease out part or
‘ U ª ™ WU RE f all of his land holding for a specific
9 Y> :; :$E 'J period of time that shall be determined
^ ‹‹ by regional laws.
6/ “Z *E@• E¹< *E@• (/) 99( 2/ Without prejudice to Sub-Article (1) of
YE $ @ gT ¼ ^ d:M Wc:` this Article, the lease period may not be
R J 7 c: YE ]! WŸU J more than 10 years for annual crops and
¿ c: . *^ !‹‹ 30 years for perennial crops.
1/ “Z *E@• E¹< *E@• (/) 99( 3/ Without prejudice to Sub-Article (1) of
YE $ @ gT *j: I this Article, the elderly, female-headed
Y' w I Z¯> I YE ]! W households, children, and other people
! E ^_`o(E W' ' \‘ who cannot cultivate their land for valid
%W^_`w ^_`o(E £‘ £‘ reasons may not be restricted from
J'J *^JWJ‘!‹‹ leasing out the whole of their
landholding.
4/ ¼ ^ (Ž B]n : OF> 4/ Lease contracts shall be authenticated and
< E R$( Ÿ! :O 9.> registered before an institution
:: 9 *W%o(‹‹ authorized by regional governments.
7. :; '< WnE :WJQ :OPw E 10. Organizing And Providing Information
<W' r > <W:<$ Related to Land Transfers
// 9$" :; *< = " Ÿ' 1/ Regional Rural Land Administration
I _E I „ O= I J ' I O=> Institutions shall establish working teams
@ ’ B/#`o( q *J > in their Regional, Zone, Special Woreda,
J EI ^_`o(E :W+ . Ue k City, Woreda, and Kebele offices that
%W^_`w E YE ]! ^_`o(E may gather and provide information
J%Wx " ' ' Ue k E about potential lessors and lessees,
landholders who intend to exchange their
%W^_`w Y :d9 U 9>{ Y>
holdings as well as jointly develop their
* %œ(E :; 9 Y $> :OP holdings with investors. Such working
UR. n Ÿ-'‘‹‹ teams shall conduct assessments on the
local land market, and avail information
to interested parties.
6/ n‘ * OPr > *R " b"c 2/ The Organization and workflow of the
‘ U ª ™ ^ R> ‹‹ team shall be determined by regional
laws.

7/. <¡` 11. Donation
// 9$" :; %W^_` ^_`(E 1/ A landholder may donate his landholding
# R k < d:= : J to his relatives by consanguinity as
<¡` ^! ( 9e ^¡O~ provided in the Family Code or through
b!! < n ^ ‹‹ maintenance contractual agreement.
6/ “Z *E@• E¹< *E@• (/) 99( 2/ Without prejudice to the provisions of
YE $ @ gT %W^_`( ( Sub-Article (1) of this Article, the
9e ^¡O~ <!! ( landholder may transfer his holding

•D. Uµ<¶H Ê K 59. The Responsibility of the Ministry
Uµ<¶H‹m The Ministry shall be responsible to:

support to relevant institutions;

systems; and

Ë. Ž Ê K 60. The Responsibility of Regions
// YE ‘ % ]¥` 9$" :; E 1/ Based on their reality, regions shall
U < =[" * OPr Ÿ-'‘‹‹ establish rural land administration and
use institutions.
6/ J“Z F " U ! " " F 2/ Regions shall issue detailed laws in
'( ^ZEE *+, '<ep! Ê K conformity with this Proclamation.

1/ ‚L > [ n U† Rw 9$" :; 3/ Regional States shall be responsible to
:$@! : E ‘ %‘ Ÿ' oversee the implementation of the rules
e¸U :g>o(E '<J " Ê K on the land rights of women and
*W%o(‹‹ vulnerable group by various regional
institutions.

Ÿ! Ê K Administration and Use Institutions
// 9$" :; *< = " Ÿ' 1/ Regional Rural Land Administration and
9$" :; J ' > Use Institutions shall lead the process
J: Q K YE ]! 9$" :; where rural land is expropriated for
W’ *9 FŽ YE ( OF – QE urban expansion or for other purposes.

Ë6. Er $ & 62. Criminal Liability
// 'E~(! R( F I ^! 1/ Any person who illegally invades private,

6/ 'E~(! R( F I ^! 2/ Any person who causes damage to private,
:EFb ^_` ^ k= OR communal or state holding shall be fined
J " •0 Y<J /2•0 ^! J1 with payment of 50,000 to 150,000 Birr
c: Y<J • c: U "< •M or punished with 3 to 7 years rigorous
Y< ^! ]WQ! ^@ ‹‹ imprisonment or both.
1/ 'E~(! R( % e@ ` ^ 3/ Any person who constructs or permits any
'E~(E! FE%` R ^! construction in an unauthorized place
YE R e@ J " 3C0 Y<J shall be fined with payment of 25,000 to
•0 ^! J/ c: Y<J 1 c: 50,000 Birr or punished with 1 to 3 years
imprisonment or both.

imprisonment or both.

C/ xR ~ :; ^_` 'ROP @O 5/ A landholder who submits a forged
%W^_`I '<OP R O ^! landholding certificate, a professional
šš '<OP R$ %W£ J " who hides evidence or gives false
evidence shall be fined with payment of

J“Z F " *F% o(> “Z F The Civil Code provisions shall apply as

Ë4. ^" 64. Period of Limitation
// :EF< ^! ^_`E 9 . 1/ A person who illegally possesses state or
:E9[ d R( ^" E YE :J J communal holding may not invoke a
š *^ !‹‹ period of limitation as a defense.

6/ ^_`Ó W*F% ’ R( <Á ~ 2/ An action to reclaim a holding which was
U R( : QE :$ j J O illegally possessed by another person
^! @ f r!N 7C c: shall be barred by period of limitation if
(<. < @O : Q ^" not brought within 15 years after the date
^`9= ‹‹ he should have brought the case or
having become aware of his rights.
33 1/ ’Ž : E W:$ j ’Ž ™ 3/ Period of limitation provided in other laws
@:ª ^" [E ºw e¸U shall apply in respect of claims of other
^g>‘‹‹ rights.

ËC. :Ä 9 [E º 65. Transitory Provisions
// “Z F [E ºw ^Z *+, J:• - 1/ The provisions of this Proclamation may
K > ={ * not apply to cases that are pending at
K @" ( " " Y O9%o( %‘ federal or regional judicial bodies before
k= ^ e¸U *^gM!‹‹ the coming into force of this
Proclamation.
6/ ^Z *+, J:( Q K Rª ^_` 2/ Landholding certificates, which were
'O 9) !< " O@L @%^ issued before the coming in to force of
* o(‹‹ this Proclamation shall be valid.

Ë8. E '( < E 66. Power to Issue Regulation
Uµ< N ! " # YE *<e f Q ^ZE The Council of Ministers may issue
*+, W'<ep! E E ^ ‹‹ Regulations to implement this Proclamation.

Ë•. <W aH> e¸U <W'^gM ™ 67. Repeals
// :EF< 9$" :; 1/ The Federal Rural Land Administration
*< = "> *$?@! *+, -." and Use Proclamation No 456/2005 is
42•8//0D2Õ• “Z *+, ¢Ã ‹‹ hereby repealed.
6/ ^ZE *+, U?OE 'E~(! FI 2/ No law, Regulation, Directive or Practice
*+,I E I :: ^! *R " shall, in so far as it is inconsistent with
![ “Z *+, 9k E k= this Proclamation, be applicable with
:WJ e¸U *^TO(!‹‹ respect to matters provided for in this
Proclamation.
