EXECUTIVE ORDER NO. 02


Series of 2024

AN EXECUTIVE ORDER ORGANIZING THE ECOLOGICAL SOLID WASTE MANAGEMENT COMMITTEE


OF THIS BARANGAY AND FOR OTHER PURPOSES.

WHEREAS, Section 389 (b) (9) provides that, for efficient, effective and economical governance, the purpose
of which is the general welfare of the Barangays and its inhabitants pursuant to section of the Local
Government Code of 1991, the Punong Barangay shall enforce laws and regulations relating to pollution
control and protection of the environment.

WHEREAS, Section 6 and 7 of IRR of RA 9003 provide the creation of Barangay Solid Waste Management
Committee and its functions and responsibilities.

WHEREAS, Section 10 of RA 9003 stipulates that segregation and collections of solid waste will be conducted
at the Barangay Level specifically for biodegradable, compostable, and reusable wastes.

WHEREAS, to implement the said Act, DILG has issued Memorandum Circular No. 2001-38 for the creation of
Ecological Solid Waste Management Committee to oversee the implementation of Ecological Solid Waste
Management Program at the barangay level;

WHEREAS, with the election of new set of barangay officials, there is a need to reorganize the Barangay
Ecological Solid Waste Management Committee, specify their duties and functions pursuant to RA 9003 and
other related laws and issuances;

NOW THEREFORE I, FIDEL Y. NICART, by the powers vested in me by the law as Punong Barangay, do
hereby specifying their roles in the implementation of solid waste management in this Barangay.

B. Duties and Functions
1. Formulate a community solid waste management program consisted with the
municipality;
2. Be responsible for the segregation and collections of the solid waste specifically
by the biodegradable, compostable and reusable wastes;
3. Established within the Barangay or cluster of barangays as Material Recovery
Facility (MRF) a redemption or eco-centers in a barangay. Owned
4. Allocate a barangay fund for the barangay ecological solid waste management
program, approved by the Sangguniang Barangay;
5. Organized a Core of Area/street to assist the BSWMC in the barangay
implementation of program, project and activities;
6. Conduct training for barangay residents on segregations, composting and
recycling and livelihood from use of recyclable waste and to monitor their
implementations;
7. Integrate the Ecological Waste Management in the Barangay Development Plan
(BDP) and/or Annual Investment Plan (AIP);
8. Find alternative source of fund other than the barangay regular budget;
9. Submit a monthly report to MSWMC or MENRO on the progress of the program
copy furnished by the DILG Office;
10.Implement the plans and policies of the following:
A. Education
a. Development and dissemination of information education campaign
(IEC) materials to every household, business establishments and other
institution of the barangay.
b. Conduct community trainings and seminars on ecological solid waste
management, particularly on household segregations, composting,
reduction of waste for dispose and recycling;
c. Issue of community policies that will patronized friendly products and
packaging.
B. Engineering
a. Provision of support mechanism for segregated collection (i.e push
carts, pedicabs, mini trucks)
b. Setting up of redemption or eco-centers (MRF) within the barangay for
non-biodegradable or recyclable materials before selling in bulbs to
junkshop.
C. Enforcement
a. Enact barangay ordinance on the establishment of an award system
and other incentives and sanctions in the barangay and other rules
and regulations to implement the program.
D. Entrepreneurial
a. Establishment of a system of buying and selling of recyclable waste
and compost.
b. Promotion of livelihood activities from waste materials
c. Networking with the private /business establishment within the
barangay.
d. Micro financing for livelihood project from waste.
11.A Barangay ESWM (from community/Barangay Development Councils) shall be
formed to assist the committee in the performance of its functions. It shall
provide technical and administrative support to the committee whenever
necessary.
C. RESPONSIBILITIES OF THE PUNONG BARANGAY
1. Strictly observed the provision of RA 9003 and related Department Issuances.
2. Establish a Material Recovery Facility (MRF) in the barangay or in a cluster, in an
owned or lease land or any suitable space to be determined by the Barangay
through Sanggunian.
3. Allocate a certain parcel of land to the cluster barangay for the MRF.
4. Initiate information campaign through public consultation.
5. Implement a Comprehensive Solid Waste Management System enacted through an
Ordinance;
6. Communication with the concerned Municipal Environment and Natural Resources
Office or DENR for the technical support in the in the event there is a need to train
LGU Personnel or comprehensive solid waste management.
D. EFFECTIVITY
This Order shall take effect immediately
