AFFIDAVIT

I, Mamilla Victor, S/o. M.Sampath Kumar, aged about 36 years, Resident


of H.No.49/50A-107, Sree Ram Nagar, Kurnool City and District., now having
temporarily come down to Amaravati, do hereby solemnly and sincerely affirm
and state as follows:
1. I am the petitioner herein and as such I am well acquainted with the
facts of the case.
2. I humbly submit that, Ijoined in the 5 years LLB course at
PrasunnaLaw College affiliated to Rayalaseema University, Kurnool.
3. I humbly submit that, Admission in 5 YEARS LLB for the academic
year 2020-2025 through LAW CET 2020 entrance test.
4. I humbly submit that, the course was scheduled to be completed by
MARCH 2025 However, due to COVID-19 university not conducted
semester examinations, while other universities conducted semesters
and also given COVID-19 pass without conducting semester. but
rayalaseema university not followed same COVID-19 guidance for the
course to complete the semesters based on that our course was not
completed as of now.
5. I humbly submit that, I followed all academic participating in exams up
until the point the institution failed to meet its obligations.
6. I humbly submit the respondent started 1 st semester examinations in
the month of February 2022.
7. I humbly submit that, I made 1st representation on 11.09.2024 &
another 2nd representation to the Respondent Nos.2 to 5, in the
month of December 2024 to the Respondent , requesting the
completion of the course and a timely declaration of results. However,
despite repeated efforts, the Respondent has failed to provide a
satisfactory response or take necessary corrective actions.
8. I humbly submit thatrecently Respondent Nos.3& 4 announced 8th
semester examination fee on 29th November 2024,but university was
conducting those examinations from 9th January 2024,by delaying
examination timetable announcement.

9. I humbly submit that, The Honourable High Court of Kerala by its


judgement dated 01.10.2020, in the case Reshma.S.Nair V/s Cochin
University of Science And Technology (CUSAT) in clear terms held that
even 4 months extension of the academic calendar is intolerable and
not allowable as the University could have conducted the examinations
for the supplementary papers of LLB students by online considering the
outbreak of COVID-19 pandemic and therefore directed the university to
conduct the examinations through online instead of offline immediately
and publish results immediately without delay for avoiding the extension
of the academic calendar year.

In the circumstances stated above, the petitioner has no efficacious


alternative remedy, except to seek the redressal before this Hon'ble Court
seeking the indulgence of this Hon’ble Court to exercise the extraordinary
original jurisdiction vested in this Hon’ble Court by virtue of Article 226 of
the Constitution of India.
The petitioner have not filed any writ petition, suit or other proceedings
for the relief or relieves sought herein.

It is therefore prayed that this Hon'ble Court may be pleased to issue an

order, or a direction, or a writ, more particularly one in the nature of Writ of

Mandamus directing the Respondent to immediately take all necessary steps

to complete the petitioner’s 5 YEARS LLB course within a specified period and

declare the pending results., and to pass order 9th and 10 semesters for

consider early written 1 & 2 semesters as 9th and 10 semesters as other

order or orders as this Hon’ble Court may deem fit and proper in the

circumstances of the case.

It is also just and necessary that this Hon'ble Court may be pleased to

direct Respondents to provisionally complete the academic requirements and

issue a provisional degree certificate or confirmation of course completion,

pending disposal of the above writ petition, and to pass such other order or

orders as this Hon’ble Court may deem fit and proper in the circumstances of

the case.
