AN ORDINANCE REGULATING THE USE AND OPERATION OF VIDEOKE AND KARAOKE
AND OTHER SIMILAR MACHINES, AND DEVICES OR INSTRUMENTS IN PUBLIC STREETS OF
BARANGAY MABUYONG, ANINI-Y, ANTIQUE ALOOWING THE USE FROM 10:00 IN THE
MORNING UNTIL 10:00 IN THE EVENING ONLY, PROVIDING PENALTIES FOR VIOLATION
THEREOF AND FOR OTHER PURPOSES.

SECTION 1. TITLE- This ordinance shall be known as the “videoke and other similar
machines, and device or instrument, regulation ordinance of Barangay Mabuyong.”
SECTION II- DECLARATION OF POLICY- The barangay officials of Barangay Mabuyong
value the education of students. It shall support and promote their welfare by providing a
safe and healthy environment conducive for learning.
SECTION III. OBJECTIVE- Intend to regulate the use of karaoke, videoke and similar sound-
producing device, which may cause disturbance to the community and distractions to our
students and teachers in their blended learning activities, and to all vulnerable especially
the senior citizens and those with health problems/conditions.
SECTION IV- DEFINITION OF TERMS-When use in this ordinance shall mean as follows:
a. Noise Disturbance-means a disturbing or excessive sound or noise level, that a
noise or that create actual, mutual or eminent interference with the peace and order which
can be heard in the distance of 50 meters in which the system or sound amplify equipment
is located.
b. Videoke and Similar Sound Producing Device-means any machine or device that is
used for the amplification of the human voice, music or any other sound.
c. Vulnerable-means open to physical or emotional harm, unable to resist illness
debility or failure.
SECTION 5-ALLOWABLE ACTS- Allowed hour for use and operation videoke machine and
other sound system and prohibitions. The use and operation of videoke and other
audio/sound system in Barangay Mabuyong may only be allowed from 10:00 in the
morning until10:00 in the evening.
SECTION 6- Machines, devices or instrument actually used by student and teachers for their
learning activities shall be exempted from the implementation of the ordinance. Public
service announcements made by national and local government officials or employees using
sound producing devices shall be exempted. The use of machines, devices or instruments by
religious organizations during worship service and activities related to the exercise of
freedom of religion shall likewise be exempted.
Special occasions such as; Christmas, New Year, Fiesta celebration, barangay
sponsored activities, including the night occasions may be granted by the Sangguniang
Barangay but not later than 12:00 midnight.
Personal occasions such as; birthday celebration, exemption of until 12:00 midnight
maybe granted by securing an extension permit from the respective. The applicant must fill
out an application form provided by the barangay, at least five (5) working days before the
actual date of the function.
SECTION 7-ENFORCEMENT- One hour before 10:00 p.m. the member of the barangay
Tanod on duty shall courteously approach and remind the concerned parties to soften or
lower down the volume and eventually turn off videoke or sound system at 10:00 p.m. or 12
midnight. However, if such reminder has been obviously ignored or taken for granted by the
concerned parties for the second and third time, the Barangay Tanod shall call the attention
of the Kagawad Peace and Order or the Punong Barangay to intercede for, and on the behalf
of the barangay.
SECTION 8-PENALTY CLAUSE-Any person found violating the provisions of the ordinance
shall be penalized by a fine of the following:
A. First Offense-P300.00
B. Second Offense-P700.00
C. Third Offense and successive offenses-P1,000.00
