“AN ORDINANCE AUTHORIZING THE MUNICIPALITY OF GARCIA-HERNANDEZ
TO ISSUE BARANGAY CLEARANCE AND COLLECT CORRESPONDING
BARANGAY CLEARANCE FEE IN THE APPLICATION FOR ANY BUSINESS
RELATED TRANSACTIONS SUBJECT TO THE
REMITTANCE OF THE AFORESAID FEES TO THE BARANGAY AND THE
CONDITIONS
HEREUNDER”.
WHEREAS, under Section 152(c) of the Local Government Code states that:
“Barangay Clearance - no city or municipality may issue any license or permit
for any business or activity unless a clearance is first obtained from the barangay
where such business or activity is located or conducted. For such clearance, the
Sangguniang Barangay may impose a reasonable fee. The application for clearance
shall be acted upon within seven (7) working days from the filling thereof. In the
event that the clearance is not issued within the said period, the city or municipality
may issue the said license or permit.”
WHEREAS, the EODB ACT of 2018 or the Republic Act 11032, otherwise known as
“An Act Promoting Ease of Doing Business and Efficient Delivery of Government
Services,Amending for the Purpose of Republic Act no.9485” was duly enacted;
WHEREAS, Section 11(f) of the above-mentioned Republic Act duly amended the
section 152(c) of the Local Government Code, and provides that “Barangay
clearances and permits related to doing business shall be applied, issued and
collected at the municipality in accordance with the prescribed processing time of
said act. Provided, that the share in the collection shall be remitted to respective
Barangays: and
WHEREAS, Barangay Cagwang, in accordance with the above provisions, and as an
implementation of “one stop shop”, hereby authorizes the Municipality of Garcia-
Hernandez, to issue barangay clearance and collect corresponding barangay
clearance fee in the application for any business related transactions subject to the
remittance of the aforesaid fees to the barangay and the conditions hereunder.
NOW THEREFORE, BE IT ORDAINED AS IT IS HEREBY ORDAINED by the
Barangay Council of Malinao in a session duly assembled the following:
SECTION 1. Coverage. This policy applies only to the issuance of Barangay
Clearance for the business permit and locational clearance (as a requirements for
the issuance of building permit) at the Municipality. Other clearances for other
purposes shall still be obtained at the Barangay.
This Circular shall cover all City and municipal Mayors, Punong Barangays,
Concerned local officials, DILG Regional Directors and BARMM Minister of Local
Government and all others concerned.
SECTION 2. Definition of Terms. The words and phrases used in this ordinance
are hereby defined as follows:
Barangay Clearance - refers to any and all documents issued by the
barangays with or without corresponding fees as defined in their ordinances
relatives to or in relation to the issuance of business permit and locational/zoning
clearance by the municipality or any other permit as may be required.(IRR OF RA

BARANGAY CLEARANCE FEES - is an amount imposed by the barangays through
an ordinance and collected by the municipality in relation to the issuance of
business
Permit and locational/zoning clearance by the municipality.
BUSINESS PERMIT - Is a document that must be secured from the municipality government.
Usually through its Business Permits and Licensing Office (BPLO), for a business to legally
operated in the locality. (IRR of RA 11032)
LOCATIONAL CLEARANCE - is a clearance issued by the Zoning Administrator/Zoning officer to a
project that is allowed under the provisions of an ordinance of a particular Municipality. It is a
requirements for the issuance of Building Permit. (House and Land Use Regularly Board
Comprehensive Land Use Plan Guidebook)
SECTION 3. Authority to collect Barangay Clearance Fee of Business Related Transactions- The
Municipality of Garcia -Hernandez is given the authority to collect Barangay Clearance Fee
subject to the remittance to the subject Barangay.
SECTION 4. Rate of Barangay Clearance Fee to be Collected - the rate of Barangay
Clearance Fee to be collected by the Municipality for the issuance clearance shall be computed
in accordance with the subject Barangay Revenue Ordinance herein attached as “Annex A”, and
made as an integral part hereof.
SECTION 5. Barangay Clearance Signatory- Electronic Signature of Punong Barangay
concern shall appear in all barangay clearance issued.
SECTION 6. Reporting and Remittance- the municipality shall remit the Barangay Clearance
Fee collected to the subject Barangay not later than seven(7) working days of the issuing month
with the list of the issued Building and Business Permit.
SECTION 7. Separability Clause- if for any reason, a part of this Ordinance is declared illegal
or invalid, other parts or provisions hereof which are not affected thereby shall remain valid and
in full force and effect.
SECTION 8. Repealing Clause- all previous ordinance and rules/regulations which are
inconsistent with the provisions of this ordinance are hereby deemed,modified or repealed
accordingly.
SECTION 9. Effectivity Clause- this ordinance shall take effect fifteen (15) days after its
publication.

“AN ORDINANCE AMENDING THE BARANGAY REVENUE CODE
ORDINANCE NO. 01 SERIES OF 2023 OF BARANGAY CAGWANG,
GARCIA-HERNANDEZ, BOHOL”

BE IT ORDAINED by the Sanggunian Barangay of Cagwang, Garcia-
Hernandez, Bohol in session duly assembled:
Section 1 – TITLE. This Ordinance shall be known as Barangay Revenue Code of 2024 of Cagwang,
Garcia-Hernandez, Bohol, Philippines.
Section 2 – Barangay Business Clearance
Sari-Sari Store – two Hundred Pesos (₱200.00)
Chainsaw Operator/Micro-Finance/and other Business Establishment shall pay a Five Hundred
Pesos (₱500.00) to the Barangay Treasurer.
Section 3 – Barangay Clearance and Barangay Certifications
A Barangay Clearance shall be obtained first from the office of the Punong Barangay for any
business or activity located within the territorial jurisdiction of the barangay with a reasonable
fee of One Hundred Pesos (₱100.00).
The business or activities include fish vending, buying scrap, pigs for commercial purposes,
conducting of shows, fund raising activities such as benefit dance, disco, etc., operating of
chainsaw and all other business allowed under section 152 © of the Local Government Code of
1991 the barangay treasurer shall implement the collection of barangay clearance and
certification.
A Barangay Certification such as Business, Residency, Good Moral, No Pending Case, Lot
Ownership, Tree Ownership. Late Registration and Senior Citizen for any purposes shall pay a
fee of One Hundred Pesos (₱100.00).

Certification of Cutting of Trees – Three Hundred Pesos (₱300.00)
Indigency and Low Income Certification for Financial Assistance (Hospital Bill. Laboratory,
Medicine and Burial Assistance) – Free of Charge
Indigency and Low Income Certification for other purposes – One Hundred Pesos (₱100.00)
VIOLATION PENALTY. Any concerned individual or group of person refuses to secure barangay
clearance and certification as mentioned in preceding section shall be fined the sum of one
Thousand Pesos (₱1,000.00) and prohibited from conducting business or activities within the
jurisdiction of the barangay.
In case the violator refuses to comply the prescribed penalty, the Sanggunian Barangay shall
avail of legal means to file a case in the proper court.
SECTION 4 – SERVICES CHARGES OR FEES
Users of Barangay Owned properties and facilities shall pay service charges or fees as follows:
Barangay Chairs – Five Pesos (₱5.00) per day of use and replacement for every damaged chair.
Use of the Barangay Chairs outside of the Barangay is case to case basis and rental shall Five
Pesos (₱10.00) each per day of use and replacement for every damaged chair.
Tables – Twentyfive Pesos (₱25.00) per usage.
Barangay Basketball Court
two Peso (₱2.00) for every sack or a fraction of it if used for drying of copra, palay and other
materials.
Fifty Pesos (₱50.00) per game if used for playing with lightning to cover the power cost.
Six Hundred Pesos (₱600.00) per usage if used by an individual for gathering purposes, like
weddings or reunions and or any activities that is not related to the Barangay.
Grass Cutter or Mower per day or a fraction there for rent four hundred pesos (400.00)
Mixers. 20.00 pesos per sack
Barangay Sound Systems – One Thousand Pesos (₱1,000.00) per day. Use of the Barangay
Sound System for mini events. outside the Barangay the rental is Two Thousand Pesos
(₱2,000.00) per day and replacement for every damaged parts of the Sound System.
Interested users shall ask permission from the Barangay Treasurer for scheduling of usage of
Barangay Properties and Facilities and for Payment of Charges before releasing or using the said
properties or facilities.
The Barangay Treasurer or representative shall conduct ocular inspection on the usage of the
above-mentioned Barangay properties or facilities for proper assessment of charges and to
check damages, if any.
SECTION 5 – COMMUNITY TAX CERTIFICATES
All individuals liable for Community Tax as provided in section 157 of the Local Government
Code of 1991 shall pay and annual community tax of Fifty and an annual additional tax of one
(1.00) for every One Thousand Pesos (1,000.00) of income regardless of whatever form of
business, exercise of profession or from property which in no case shall exceed Five Thousand
Pesos (5,000.00).

Any individuals requesting for Barangay Clearance, Good Moral Certificates and other forms
of certificates shall secure first or show his/her Community Tax Certificates before issuance of
Barangay Clearance or request certificates is made.
Every individual must declare his/her correct net income for proper guidance of the Barangay
Treasurer. In case of doubt on the income declared by the payee. The barangay treasurer may
request from his employer or employers for proper assessment of Community Tax
The Sangguniang Barangay enjoined all barangay residents liable for community tax certificate
from the Barangay Treasurer to avail of the Fifty percent (50%) share from the Barangay.
The Sangguniang Barangay may avail of any legal means to run after any individual found out
declaring incorrect net income for the purpose of evading tax.
SECTION 6 – Certification for light installation
Residencial ----100.00
Commercial / institutional --- 100.00
Industrial --- 150.00
Water installation – 100.00
SECTION 7 – OTHER FEES AND CHARGES
The Barangay hereby levies reasonable fees and charges on the following:
Pig buying for sale outside the Barangay – Twenty Pesos (₱20.00) for every Pig purchased
regardless of the size to be paid by the buyer.
Inspection or Verification Fee:
Coconut Trees, mahogany, Gemelina and other trees planted for lumber purposes – Fifty Pesos
(50.00) per Tree
Barangay Court Fee – the Sangguniang Barangay may avail of any legal means to prosecute any
person or group of persons evading the payment of fees and violating the provisions of this
section.
Filling Fee – The Sangguniang Barangay may file amounting to One Hundred Fifty Pesos (150.00)
and One Hundred Fifty Pesos (150.00) for the Barangay Service Fee.
SECTION 8 – SEPARABILITY CLAUSE – If any provision or section of this ordinance be declared by
competent body or court as invalid or unconstitutional, the remaining parts hereof shall not be affected
thereby.
SECTION 9 – EFFECTIVITY. This Ordinance shall take effect immediately.

“A RESOLUTION AUTHORIZING THE MUNICIPAL TREASURER TO ISSUE BARANGAY
CLEARANCE AND COLLECT CORRESPONDING BARANGAY CLEARANCE FEE IN THE
APPLICATION FOR ANY BUSINESS-RELATED TRANSACTIONS SUBJECT TO THE REMITTANCE
OF THE AFORESAID FEES TO THE BARANGAY AND THE CONDITIONS HEREUNDER”.
WHEREAS, there is a need to simplify the process of business registration in the
municipality of Garcia-Hernandez, to provide a more efficient and effective revenue
collection and to promote a friendlier atmosphere for taxpayers and investors;
WHEREAS, when regulations are simple and transparent, entrepreneurs need not
to suffer from red tape and time-consuming transactions;
WHEREAS, the ease of Doing Business Act of 2018 or Republic Act 11032,
otherwise known as “An Act Promoting Ease of Doing Business and efficient Delivery
of Government Services was signed into law seeks to make the process of putting
up and running a business in the Philippine easier and more efficient;
WHEREAS, Section 11(f) of the above-mentioned Republic Act duly amended the
section 152(c) of the Local Government Code, and provides that “Barangay
clearances and permits related to doing business shall be applied, issued and
collected at the municipality in accordance with the prescribed processing time of
said Act. Provided, that the share in the collection shall be remitted to the
respective Barangays;
WHEREAS, The Municipal Treasurer is given the authority to collect Barangay
Clearance Fee subject to the remittance to our Barangay;
WHEREAS, the rate of the Clearance Fee to be collected by the Municipal Treasurer
for the issuance of clearance shall be computed in accordance with the attached
Barangay Revenue Ordinance of our Barangay and the Electronic Signature of
Punong Barangay concern shall appear in the Barangay Clearance issued;
WHEREAS, The Municipal Treasurer shall remit the Barangay Clearance Fee
collected to the subject Barangay not later than seven (7) working days of the
ensuing month, together with the list of the issued Building and Business Permit.
NOW, THEREFORE, on motion by Hon. Perpetua S. Carido and duly seconded by
the body present in a meeting assembled, authorizing the Municipal Treasurer to
issue Barangay Clearance and collect the corresponding barangay clearance fee in
the application for any business-related transactions subject to the remittance of
the aforesaid fees to the barangay and the conditions hereunder;
“RESOLVED, AS IT IS HEREBY RESOLVED, that copies of this resolution be
furnished to the office of the Municipal Treasurer for proper endorsement and
implementation.
