AN ORDINANCE ADOPTING THE CITY ORDINANCE 8355 AN ORDINANCE


CREATING A COMPREHENSIVE ANTI-DENGUE ORDINANCE OF MANILA, ,
PENALIZING VIOLATORS THEREOF AND FOR OTHER PURPOSES

Proponent: Hon. Francisco Vargas


WHEREAS: The Local Government Code OF 1991 mandates that the states shall
promote health and safety of its constituents by providing measures to
prevent and control the spread of diseases, particularly Dengue.

WHEREAS: there is immediate need to exert maximum efforts and avail of all means to
prevent and control dengue for all the constituents of this Barangay;

WHEREAS: in order to concert all efforts, activities, interventions and strategies for the
prevention and control of dengue in the Barangay, there is a need to pass
ordinance for the prevention and control measures of Dengue.

3Sampaloc, City of Manila in a regular session assembled that:

Section 1. TITLE– This Ordinance shall be known as “DENGUE PREVENTION


ORDINANCE” OF BARANGAY BARANGAY 466 ZONE 46, SAMPALOC, MANILA.

SECTION 2. PURPOSE. It is the purpose of this ordinance to safeguard public health


and ensure the well-being of all its constituents by protecting them from Dengue

SECTION 3. COVERAGE. This Ordinance shall apply to all persons, whether natural
or juridical, whether resident or not, and in all places found within the territorial
jurisdiction of Barangay 466 Zone 46, Sampaloc, City of Manila.

Section 4. DEFINITION OF TERMS. – as used in this Ordinance, the following terms


are hereby defined as follows:

4.a.) Dengue - an acute infectious disease caused by a flavivirus (species
Dengue virus of the genus Flavivirus), transmitted by aedes mosquitoes,
and characterized by headache, severe joint pain, and a rash – also called
breakbone fever, dengue fever.

4.b.) Aedes Aegypti/Aedes Albopictus- refers to a day biting mosquito


which lay eggs on the moist portion of the dark object (stick or rock) some
millimeters above the water level and also lay eggs in clear standing water.

4.c.) Stagnant Water - motionless water, not flowing in a stream or current,


also known as standing water.

4.d.) Water Containers- any open receptacles such as, discarded tin cans,
buckets/pails or “laton” (large plastic bucket/containers of margarine or
lard/orocan, empty pots, empty bottles);

4.e.) Vector- a mosquito that serves as carrier of dengue from an infected


organism to another person.

4.f.) 4:00 O'clock habit- refers to the general cleaning activities of all
concerned but more specifically the search and destroy of possible breeding
sites of mosquitos and proper waste disposal

4.g.) Breeding Sites of Aedes Aegypti Mosquito – refers to any artificial


or natural containers which can potentially collect water but which is not
properly manage thus allowing storage of water therein making it potential
for breeding sites of mosquito.

SECTION 3- BARANGAY ANTI-DENGUE TASK FORCE – The Barangay Anti-Dengue


Task Force shall be created, organized and composed of the following;

SECTION 4- DENGUE TASK FORCE TASK AND RESPONSIBILITIES

a.) The Dengue Task Force shall be responsible in the information


dissemination, surveillance and implementation of this ordinance in their
respective jurisdiction.

b.) Dengue Task Force shall be allowed to enter the premises of


establishment identified to have high vector density. These areas include
Schools, business establishment, institutions, or any places where
population concentration is high specifically among others abandoned
and/or idle lands, buildings and structures.

c.) In the event that more than one resident in a house is declared to have
been infected with dengue at one time or in close interval, Dengue Task
Force shall be allowed to enter its premises to conduct inspection/
surveillance on dengue breeding site to take appropriate action. Prior notice
to the residents thereof shall be required.

d.) Mandatory reporting of cases or persistent and high fever shall be


made to the nearest health centers for assistance and appropriate actions
by the Rural Health Midwives.

SECTION 4.- INFORMATION CAMPAIGN

a.) It shall also be the responsibility of the educational institutions in the


barangay to disseminate information on the Dengue Prevention and Control Measures
to form parts of its awareness campaign and/or advocacy program.

SECTION 5- NOTICES OR WRITTEN ORDERS

a.) A written order and/or communication duly signed by the Punong


Barangay and Committee Chair on Health in the area concerned to require the
destruction of the identified breeding site or proper management of potential breeding
site shall be sent and/or serve to concerned party(s) within (5) days actual receipt of the
order.

b.) Negligence and/or non-compliance with in five (5) days upon receipt of the
order shall;

i.) Cause the imposition of penalty upon the owner;


ii.) Authorized the City Dengue Task Force to institute legal means
to dismantle subject area: direct or indirect expenses incurred
thereat shall be borne by the owner/administrator.

SECTION 6 - PENALTIES

a.) Any person, entity, institution and/or agency who is caught violating this
ordinance shall be penalized by:

1st offence – WARNING AND COMMUNITY SERVICE plus attending lecture or


briefing in Dengue Prevention & Control to be conducted by the Dengue Task
Force.

2nd offence – a fine of P 1000 plus community work for four (4) CONSECUTIVE
SATURDAY to be directed by the Punong Barangay concerned.

3rd offence – a fine of P 2000 plus community work for eight (8) CONSECUTIVE
SATURDAY to be directed by the Punong Barangay concerned.

Provided that the community work as herein shall mean cleanliness search and
destroy of possible breeding sites of mosquitoes.

SECTION 7- SEPARABILITY CLAUSE. If any provision of this ordinance declared


invalid & unconstitutional the remaining provisions not affected thereby shall continue in
full force and effect.

SECTION 8- REPEALING CLAUSE. All ordinances, rules and regulations, or parts


thereof found contrary to or inconsistent with any of the provisions of this ordinance are
hereby amended, modified, and/or repealed accordingly.

SECTION 9- AFFECTIVITY CLAUSE. This ordinance shall take effect upon approval
and after posting in at least 3 conspicuous places.
