COURSE DESCRIPTION/OUTLINE

Negligent invasions of interests in person and property; strict liability; invasions of privacy, nuisance.
Occupier’s liability; procedural issues in the law of torts.

AIMS AND OBJECTIVES OF THE COURSE

1. Enable students to grasp the meaning of negligence as a cause of action as well as its socio-economic
basis.
2. Enable student to understand nuisance occupiers’ liability, private and public nuisance and strict
liability.
3. Enable students to understand death as a cause of action and other provisions of the Law Reform
(Miscellaneous Provision Act).

LEARNING OUTCOMES

At the end of the course students should be able to:

1. Identify and explain the ingredients of the remedies and defenses to an action of negligence
2. Identify and explain as well as distinguish between the torts strict liability, public and private
nuisance and occupiers’ liability.
3. Identity and appreciate the nature of death as a cause of action and certain procedural elements in
relation to actions against the government.

shall only qualify to sit and write an examination for this course if he or she has 75% attendance

COURSE DELIVERY AND STRATEGY

Lectures, teaching and Socratic methods will be used. This shall be complimented with group discussions
and tutorials.

NOTE:

The course emphases a student-centred learning experience this means that the lectures will mainly be
active learning rather than passive. Students are encouraged to actively participate in the learning experience
and the Lecturer will only facilitate, provide resources to the students and guide the students as
opposed to presenting information to the students.
