MPF and Over-Quota Tariff Rate Quota (TRQ) Goods


If goods subject to a TRQ are entered with the benefit of a free trade agreement (FTA) that
provides the MPF exemption but the in-quota allocation is filled, the MPF exemption does
apply even though the special program indicator (SPI) is not listed in the “Special” column of
the HTSUS corresponding to the over-quota tariff item.
