In the reference cited above, Sri PJavachandra Reddy,
President, Legal Aid Welfare Society (( LAWS) R/o D No. 20-1-416/3A, Subash Naga,
Tirupati has submitted petition alleging that. the Sri G.Maheswaraiah, Panchayat
to
Secretary, Chandragiri GP & DDO/ Grama Sachivalayam, Chandragiri has failed
discharge his legitimate duties as per iob chart and requested to take necessary
action.
The petitioner further stated as detailed below:

1. It is the duty. of the Panchayath Secretary, Gram Panchayath to identifyvalid
Illegal Constructions who are residential houses without obtaining
Approvals / Permissions from the Gram Panchayath as per G.O.Ms.No. 67,
Panchayat Raj and Rural Development (Parts - IV) dated 26 - 02 - 2002.

Point No, 34:

"Under clause (5) of sub-section (5) of Section 44 of the Andhra Pradesh


Panchayat Raj Act 1994, an officer of the Director of Town and Country
Planning not below the rank of Assistant Director of Town and Country
Planning is hereby designated as inspecting authority/Enquiry Officer on the
matters concerned with the Land Development (Layouts and Buildings)"

Point No. 33 - (2):

"In the case of unauthorized constructions, the District Panchayat Officer or his
officers may take any of the above actions and issue suitable instructions to the
executive Authority or any other body for necessary action against the
unauthorized construction/layout, besides taking action on the Executive
Authority for allowing such unauthorized developments."

2. Petitioner enclosed a Sakshi Newspaper article with caption akrama


nirmanam pai aagraham" as an example about illegal housing construction in
Gram Panchayath / Chandragiri.
3. The Panchayath Secretary / Chandragiri GP is in-charge of Grama
Sachivalayam in chis capacity as Drawing &Disbursement Officer (DDO) that
means - The Panchayath Secretary knows about the Criminal attitude of above
Illegal Construction since they developed into 5-stroied building and public of
the area also approached him and made number of complaints against illegal
construction.

D. Because of the Mal-administration and abusing the powers vested On
Panchayath Secretary / Gram Panchayath - Chandragiri, There is huge loss to
the Ex-Chequer of Government by way of Developmental Charges, Layout
charges & Others which have to be paid to the Gram Panchayath.
6. Petitioner stated that, his survey revealed a number of such cases (ke abo)
i.e. House owners constructing their houses without obtainíng approvals rom
the local body i.e. Panchayath Secretary / Gram Panchayath - Chandragri
which leads to Huge loss to Ex-Chequer to Government.
7. Therefore, the petitioner requested to kindly take suitable action as perC
Rules against the Panchayath Secretary /Chandragiri Gram Panchayath to
safeguard the larger public interest.

In view of the above, the District Panchayat Officer, Tirupati is hereby


directed to take necessary action and submit detailed enquiry report in this regard. A
copy of the petition is enclosed herewith for taking necessary action.
