praying that in the circumstances stated in the alfidavit llled therewith" the High Courl may
be pleased to issue a Writ. Order or direclions more particularly a Writ in lhe nature o1'
mandamus declaring the inaction olthe respondent No.2 in taking action in pursuance ofthe
representation ol the petitioners dated 05.1 1 .2024 fbr conduct o1' a dotailed inquiry inlo the

Learned Assistant Govcrnment Plcader for Revenuc takes notice for the
respondents.
'fhe casc of the petitioncrs is that they arc the protected tenants ovcr the lands
forming part of various survev numbers, situated at Mogalpahad Village, Anthergaon
Mandal, l'cddapalli District and that their names ucre recorded iir the revenuc records
as pcr the provisions of the Telangana Rights in L:rnd and P:rttadar Passbooks Act,
l97l and Rules made thereunder. Thc grievance of thc petitioners is that evcn though
their names lverc recordcd in the revenue records, tvhile issuing e-pattadar passbooks
under the Telangana Rights in Land and Pattadar Passbooks Act,2020, the respondent
authoritics have changed the entries in the revenue records rvithout issuing notice to thc
persons rvho arc interested or without conducting enquiry.

Learned counsel fbr the petitioners has vehemently contended th2rt as per
Sections 5(2) and 5(3) of the Act, l97l a notice has to bc issurd to all the persons rvho
are intcrested/affected by the amendment in the revenue records. Le:rrned counsel has
also rclied upon the Full Bcnch judgment of this (lourt in the case of
Chinnant Panrlurangan v, Mondol Revenue Officer, Serilineompallv Mondal and olhers

Pending consideration of the said issues, respondent No.2-the District Collector is
directed to file a report over the nature of the subject lands and its classification and
rights of the petitioners, if anyn as protected tenants, within a period of two (02) months
from todat'.
