Dear Sirs,
Subject: Permission to mortgage flat no. 105 on the 1ST floor of the building named as
RAGHULEELA CO-OPERATIVE HOUSING SOCIETY LTD. situated at Shankara nagar,
Sonarpada, Dombivli (East) – 421204.
We confirm that Name of MR. DNYANESHWAR RAMRAO DEVARE & MRS. PARIGA DNYANESHWAR
DEVARE are recorded in our books as the lawful and rightful owner of the said flat and the Seller has a
clear, legal and marketable title to the said flat and every part thereof, and that all taxes and dues in
respect thereof have been paid unto the date also the Seller enjoys a peaceful possession of the said flat.
We also confirm that there are no outstanding dues/charges payable by the Seller in respect of the said flat
and it has paid all the dues in respect of the same up to date.
We hereby assure ABHFL that the said flat, as well as the land appurtenant thereto are not subject to any
encumbrance, charge or liability of any kind whatsoever and that the entire flat is free and marketable.
We confirm that there are no restrictive /negative covenants in the bye-laws/rules of the above mentioned
Association/Society concerning the transfer of the said flat.
We have been informed by the Seller that he/she/it has/have agreed to sell the said flat and all
his/her/their right, interest and title therein to MR. AJAY SAKHARAM PUJARE & MRS. SHITAL
SAKHARAM PUJARE. (hereinafter referred to as the “Buyer”, which shall include his/her/their successors
and permitted assigns).
We hereby confirm that we have no objection to the same and we shall transfer the said flat to the name
of the Buyer, in our books, on completion of the sale formalities between the Seller and the Buyer.
We are also aware that the Buyer has approached Aditya Birla Housing Finance Limited (ABHFL) for a
facility and that ABHFL have agreed to sanction/grant the facility vide Facility Agreement dated to Buyer.
Accordingly the Buyer has agreed to mortgage said flat in favor of ABHFL as security to the said facility.
The Seller has requested us to permit the Buyer to create the said security over the said flat through
mortgage in favor of ABHFL.
We hereby confirm and agree that we have “No Objection” to the Buyer creating the security in favour of
ABHFL by way of a Mortgage of the right, title, interest in the said flat for repayment of the facility.
AND notwithstanding anything to the contrary contained in the said Agreement for Sale, we hereby agree
to note the aforesaid charge in our books in respect of the said flat and the Buyer will not be permitted to
transfer, assign, sell off/ cancel/ further transfer or in any other way/ manner deal with the said flat
prejudicial to the interest of ABHFL without the prior written consent of ABHFL.
And we agree to accept, in future, the application for membership from the persons, firm, Company to
whom the said flat and the right, title and interest of the Buyer will be transferred / sold, in the event of
enforcement of the said security.
We also inform that neither Conveyance Deed is executed, nor the Share Certificates have yet been and as
soon as they are issued will be handed over to member. Society is not responsible to send or handover the
certificate to Aditya Birla Housing Finance Limited.
Society or any of its Office Bearers will not be legally or financially responsible for repayment of said loan.
